I'd definitely withdraw the petition when and only when you know you're done. It is best to withdraw the petitionin case either party wants to start a k-1 process again.

We withdrew our petition. We were advised not to let it sit unattended. All we had to do was send a letter.

"Don’t Make Decisions When You’re Angry. Don’t Make Promises When You’re Happy"

Take it as a time off then re-evaluate your relationship. Also maybe, you need to work on the 'nagging' issue.

Good luck!

You still have at least a month before you get approved if he hasn't spoken to you since then you know its done so you should withdraw. My fiance and I had to wait almost 6 months to get approved and in the beginning we would fight a lot which is not like us at all. This process is stressful. We decided that we were so stressed and fighting bc EVERY SINGLE CONVERSATION was about the visa. Once we decided we are done talking about the visa and will not discuss the visa again unless we had to the fights stopped immediately. I highly recommend that if you do get back together you don't talk about the visa unless its necessary. Just let him cool off stop writing and talking to him if he truly loves you and wants to marry you he will come back shortly and if not cancel the petition and move on. Good luck.

Hello guys this came as a suprise to me. I and my fiance have been going through tough times like arguing, fighting and he complains i nag too much and suffocates him. Finally after our last argument, i deleted him from our blackberry chat messenger. Since then going on 5 days no word from him. Last convo we had he says he doesn't want to make it work.I sent three apology text messages; still nothing. Initially i though he needed some space and time but now it's beginning to seem like it's really over. I should be expecting out NOA 2 in feb or early Mar. I have 2 questions, is it better to withdraw it now before it gets approved or wait til it get approved and gets returned to NVC? I don't know if we are going to get back together but i'm not putting my hope in that...

Ok, so, apparently he's been clear that 'he doesn't want to make it work.' On top of that, you've outreached to him with several apologies, in hopes to get him to change his mind. Not only he claims 'your nagging suffocates him,' he then totally ignores you.

That's what I got from your message. Correct me if I'm wrong.

Mostly everyone has replied to wait it out and to never make a decision angry. Although I agree with that approach, it seems to me that mostly everyone is forgetting the other half of the equation: it seems HE has already made his decision. I'm not judging you, nor I intend to give you relationship advise whatsoever. I will just pose a question for you to answer (privately if you will): how far in your outreach campaign will you go to try to make amends and make it work?

If you are not putting your hope in getting back together, I'd say withdraw and move on. You do have time to think and weight your options- if any.

Good luck

Don't ever do anything you're not willing to explain the paramedics.

It'll take at least a couple of weeks from when the petition is approved until it reaches the embassy. You can still withdraw it at embassy stage. If doing it this way, then you'll need a waiver when/if you get a petition filed in the future.

I'd take some time to maybe think about your relationship. If he thinks that you're nagging now, how will things be when you're reunited - not right away, but after a while of being together. Unless you both want to, you can't just disappear from each others lives for a week(or more) and then hope things will work out. At least not when immigration is involved and his stay is based on your relationship and marriage. However, if the fights are only about the wait, then I'd wait and see if he'll come around, and if you could find some common ground to stand on.

K1 process, October 2010 > POE, July 2011

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

There is a proper procedure to withdraw and cancel a petition. 3 letters 2 of which need to be certified return receipt USPS. The 3rd to the Embassy of the country your petition will end up at. You will need your name address date of birth his name address date of birth. You need the case number. Do not go into details. If you do not follow this format or you leave out an address date of birth your letter will be tossed out. If you are lucky they might return it to you. There will be no explanation as to why it is returned. Make copies of all the letters. Save the receipt from from the USPS. So you now have 6 letters 3 to send & 3 copies. They still do not have to remove it you may need a lawyer to do it for you. I withdrew 2 petitions. I have experience bad experience none-the-less.

Send one to the NVC and USCIS

Please withdraw my petition for His/her Name.

We had a very long talk for over an hr. After the convo looks like i will be calming down and controlling my mouth. From the convo i sensed he was having some cold feet but wanted reassurance that i wont drive him away with my mouth. We are hoping for the best still. Thanks to you all

After reading the original post, I was thinking, "So, if dating and dealing with immigration makes him disappear and pout, how is he going to deal with marriage? Then more importantly PARENTHOOD???"

The experienced side of my heart/brain says to tell you that he has already clearly shown you through his actions that he will NOT be around for the long haul.

The emotional side of my heart/brain says to wait it out. Maybe he is just scared/lonely/carrying his own baggage/etc.

In my experience, waiting it out has only prolonged and intensified the pain in the end. And the problems. A runner in small disagreements certainly won't improve when situations gets really intense.

What if a friend of yours was going through this situation? What would your advice be?

I never get nagged I tell my wife yes at most things (unless its serious decisions) and life

is beautiful, sometimes we men have to learn to tune out the small things say yes for a peaceful

life, just make sure you dont get to being manupilated or on a short leash, ladies sometimes count

to 10, a man is always eager to come into a peaceful loving home...do not push him away good luck

on your journey.

Always? Um, no. Untrue. There are just as many manipulative, childish men as women. Just as many who thrive on conflict. Just as many who don't realize that marriage is a team effort and takes work and loving kindness from both sides.
