NEED ADVICE! EX-GF THREATS TO RUIN THEIR LIVES!

Hello guys! I have a friend who's been asking me questions but I couldn't really answer most of it so I thought I'd come here to ask you guys.

I have a friend (USC) who married and petitioned her overstaying husband. Their I-130 and I-485 applications have been approved recently and they've already received the GC last week. For the record, their marriage is genuine so they didn't have a hard time getting approved during their interview.

Now here's the problem. My friend's husband's ex-girlfriend found out about it very recently and it seemed like the ex-GF hasn't moved on yet. Now she's been threatening the couple, as posted on her FB posts, that she will report them for marriage fraud even after the couple's petition has already been approved.

My friend's question is, if the ex-GF pursues to call USCIS and submit their names for marriage fraud, will USCIS still do further investigations like random house visits or is a second interview be possible at all even after approval?

I told my friend not to worry because she has all the proof in the world that their marriage is real. She is just too stressed out because after having their applications approved, now here comes the ex-GF threatening to ruin their lives.

What should my friend do? Is there anything she can do to get back to this ex-GF? Your comments and suggestions are appreciated.

I don't think, uscis will listen to a jealous ex girlfriend. They did their own investigation already and approved the gc! So I don't think they are going to spend their time on her!

Thank you for your response. That's exactly what I said to my friend. She is just stressed out that their names will be reported that may cause them some problems when they apply to remove the condition.

You friend should take the treats and go to a local court and ask for a restraining order. If the woman doesn't respect it then have her arrested. Usually criminal charges encourages someone to move on.

Ya, technically it is libel to put something like this on facebook if it isn't true.

So you could pursue it.

But I would think that there isn't anything anyone can do anyways. You're already approved. No one is going to take her word for it. You have evidence of her threats and have motive for her to not be trusted. She can't do anything. Just delete her and move on.

What they did was take screen shots of all the threats she posted on FB. If she files a restraining order, would that cost her a lot?

Your friend should print any proof of what that woman is doing (FB posts, etc) and as others said get a restraining order or go to police station. If they are not sure of what to do, they should see a lawyer to get legal advice of the best way to proceed with this.

When your friend's husbands ex GF gets the restraining order or sees this is getting out of control...She will cool off. :yes:

ICE won't really care all that much unless the ex submits proof. If your firend is in a healthy marriage, don't worry about it.

While it MIGHT go in their file, I hardly doubt it'll have any consequences when there are no evidence of such fraud. Maybe send the ex a reminder that a false statement will land her more trouble than a genuine marriage ever will.

I would have her call the police and have them come to the house and take a report. If the threats are bad enough I am sure the detective assigned to the case will make contact and tell her to cease. They can file a restraining order or ask the judge to issue a gag order. If after thsi is done and it continues she could be found in contempt of court and have charges filed against her. If none of this is effective and if she keeps doing it then keep making police reports. The police will get tired of taking reports after a while and take action.

I am not sure your friend will get a restraining order. The ex GF is not threatening them with any physical harm and in her opinion your friends marriage is fraud so the isnt liable really. Maybe she cant believe he is over her so in her mind she thinks it is true. I would change the settings on my fb account and block her from it or report her on fb as a stocker or problem and they will block her. Keep copies of her posts incase they are questioned but I dont know why your friend would worry if they have a real marriage. What would the issue be if USCIS came out to the home or did an investigation. If everything is in order dont worry. Ignore her and move on. If she starts threatening physical harm or coming by thier home then you can get a restraining order.

Ignore her and move on. If she starts threatening physical harm or coming by thier home then you can get a restraining order.

She really isn't worried about USCIS doing another investigation because I told her that she has all the evidences that there marriage is real. She's just stressed out having gone all the preparations and now that it's all over, here comes the ex stirring the pot and giving her things to think about. She told me that her only concern is that even though their marriage is real, if the ex pursues to call USCIS, their names might get tainted and might cause them some problems when they apply to remove the conditions 2 years from now.
