What are the consequences of not marrying your fiance?

Past the NOA2 stage, about to start working on the K-1 visa paperwork for my fiance's interview in Madrid and I'm just wondering, if they approve her K1 visa and she's allowed 90 days here with me to get married, what are the consequences for me personally if we don't end up getting married? I am a US citizen and she would have no interest in re-entering the US if she leaves without marrying me, but what about if she overstays? Could I be charged with a crime?

Thanks. So if she's still living with me illegally and we're not married and it's already been more than 90 days, what will happen? I assume they will try to take action to deport her right? Couldn't I be held accountable for that? Just covering my bases here, thanks!

Nothing will happen to you. You might have a more difficult time trying to file for someone else in the future if you want to, but that's about it. Everything else is on her. If they deport her, they deport her. End of story.

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

04/20/2012: NOA107/20/2012: instead of an approval, we got thrown into AP. sigh

11/01/2012: Boys' I-130 interview set for November 28, 2012.

11/28/2012: I-130s APPROVED! APPROVED! APPROVED!

Nothing will happen to you. You might have a more difficult time trying to file for someone else in the future if you want to, but that's about it. Everything else is on her. If they deport her, they deport her. End of story.

Why would you do this if you don't want to get married and follow through? She will be leaving her job, family etc. If this is just a general question, that needed to be asked no issues, just my point of view.

As an immigrant myself I want to correct Kazulie. If she does not marries you, overstays her visa, and still lives with you and then gets caught (even a minor traffic violation which results in document check) you may be prosecuted for not reporting an illegal alien or even worst for helping illegal alien. Both those cases would carry noticable penalties up to an inclduing jail time for you personally and would leave a major stain on your record even if you walk away for it.

If you decide to break the marriage off its in your best interest to make sure she leaves on time, or to report to the police in case you know of an illegal action that is going to take place.

I personally know people that were prosecuted for similar situation of aiding an illegal alien.

Neither of us have a time machine so there's no way to predict how our relationship will progress under these drastically new circumstances. I've gotten lots of conflicting answers about deportation and the illegality, does anyone have any concrete info they could back up with evidence perhaps? Will they come knocking on our door? Can I be jailed? Thanks again.

You are correct you cannot predict the future, the bottom line is if you over stay you are out of status and subject to deportation.

You both sign letters of intent to marry within 90 days of the foreign fiance(e) entering the US. It is not meant as a 'get to know you' visa. You should already know you intend to marry and have plans to do so. However, if for some reason you do not get married, the foreign fiance(e) must leave the US before their I-94 expires. It is illegal to do otherwise.

The fiance visa is for people who are sure they want to get married. The parties sign letters to that effect. Why would you do this if you don't want to get married?
