Approval after Notice Of Intent to Revoke

Filed a I-130 for my husband in 2011 was approved. At my husbands interview the officer decided that our case was fraud. Therefor returned it to CIS. Well I had to prove my case all over again. Alhamduillah I proved it and it has now been approved for the second time. So now my husband will get his visa. My question now is??? CIS Approved it Sept. 19,2012 and Sent it to the NVC on Oct. 8,2012 it was received at the NVC. NVC has since forwarded it on to US Embassy in Islamabad, It left the NVC on Oct.10,2012....How long will it take for it to get back to Islamabad and for them to give my husband his visa??? Any help on this would be greatly appreciated. As it is I miss my husband and it has been almost a year since I last saw him.

Just because USCIS reaffirmed it does not mean that the consulate will approve it. There is a good chance he will have to interview again and possible AP after. Best of luck! Inshallah it goes good for you guys!

You were only approved to get another interview. You will more than likely get an interview letter from Embassy that will tell you to bring all evidence proving your relationship. You will have to wait.

I have a friend going through same thing almost same time frame. They got reaffirmed in June. Got interview letter last week. Hang on it will come. Just be prepared and load up for 2nd interview.

I was told by the US CIS that our case was being forwarded to the NVC to process the visa. NVC has now sent it on to the embassy in Islamabad for them to issue the visa.

I hope and pray you are right but I have seen many cases come through here that USCIS reaffirms the case and then there is still an interview at the consulate. Inshallah they will make speed on your process!

NVC has now sent it on to the embassy in Islamabad for them to issue the visa.

Just because the petition was reaffirmed does not mean issuance of a visa is guaranteed. There will be another interview and the ultimate decision on whether or not to grant a visa will be with the CO reviewing the file.

He needs another interview, so the IV unit will cut a letter to him, informing him of the interview appointment date.

Then after the interview, there is a big chance he'll be put in mandatory AP (most pakistani males go through this)

Then at some point, the visa is mailed out to him.

so, whilst being re-affirmed is a mondo cool thing - it ain't over till it's over.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Okay my husband was called today, so the least we know is that our case has made its way back to Islamabad. They told him that he will have to go to another interview...you all were right about that one :( ...anyway what should he expect at this interview? Does anyone know? Because I was told that our case was being sent on for the issuance of the visa. What are the chances he will walk out visa in hand? Thank you all so much for your continued support.

Okay my husband was called today, so the least we know is that our case has made its way back to Islamabad. They told him that he will have to go to another interview...you all were right about that one :( ...anyway what should he expect at this interview? Does anyone know? Because I was told that our case was being sent on for the issuance of the visa. What are the chances he will walk out visa in hand? Thank you all so much for your continued support.

I don't think he will leave with Visa in hand. Almost all male applicants from Islamabad are put on some kind of AP. If the Visa is going to be issued my best guess would be 2-3 days. Good luck!

This could go either way to be honest too many variables.

1. Can you provide us background on your case... how did you get married and time frame, how did you meet a bit of information.

2. The interview: how did that go what was asked and provided .... provide a interview writeup so we can possibly see the concern of the interviewing agent and why he was refused .

3. Have you practiced a mock interview with your husband? .... the interview process is and can be very overwhelming and under pressure the beneficiary can under stress respond incorrectly so try asking him possible interview questions.

4. Gather addition proof to show that your case is genuine and gather addition documentation as secondary information.

This is absolutely correct. An approved or reaffirmed petition is not assurance of a visa. Be well prepared for the second interview and if successful, a potentially lengthy AP.

Dumb/Dumber,

It took 2 weeks for USCIS to reaffirm my petition. They sent me an email letting me know the petition was reaffirmed and I got the hard copy about a week later.
