My wife and i have been married for 3 months but it is just not working out. Sshe doesnt work and i need ro know what would happen to her if i divorce her while she still has a cr1 status. Will she be deported? There is no domestic ciolence or anything like that. She just isnt the same woman i married. Any help would be appreciated

My wife has a cr1 status but is not the same person she used ro be. She doesnt work and is always threatening to leave. Ive finally become fed up so i would just like to know what will happen to her cond resident staus should we divorce? Can she stay in the country. There are no domestic violence issues just that shes an ungrateful ######.

She is allowed to stay in the US if she wishes. You are liable for the I 864 possibly forever IF she gets public finds and IF the governement comes after you for it.

Not possibly for ever, it is forever.. :hehe:

NiNi123, please do your research before posting. If he divorces her, she has to file for ROC as soon as she has the divorce decree. If she can prove that the marriage was bona fide (e.g. she has proof about co-mingling of finances etc.) then she can successfully remove conditions on her own and will receive a 10-year GC.

Welcome to the married life, just joking.

But seriously please please please let her leave, DO NOT try to stop her from leaving the house. When she does, terminate and move on.

It has been my experience that a relationship/friendship/marriage can only work when the two people in it are passionate to be in it.

There's nothing you can do about her immigration status, do not participate anymore other than to send a letter to USCIS of the termination of marriage. Hope she finally starts working so that she can start earning towards the 40 quarters required to nullify your I-864.

If she's upstanding she'll go back home, since she only came to the US to be with you, but I bet she won't. She'll get the divorce papers and remove conditions on her own either with proving that she entered the marriage in good faith (which it appears that she did by your own statement) or via VAWA.

Good luck, I do not envy your position.

I will give you more details here,

as far as I-864 (supporting her), you are required to support her finanically in case she became a public charge. This commitment will be cancelled only if she became US or worked for sometimes (almost 10 years )

Most likely she has a green card for two years if you divorced her, she can stay as long as the green card is valid, then she will need to remove conditions to get the 10 years green card, and YES she can do that on her own as long as she can prove she did not marry you for just immigration.

In my opinion, 3 months is not enough time to search for a job in this bad economy, it took me 4 months, and knew some that took them from 6 months to a year, you can not punish her for that.

As far as your marriege, try to work things out if you can unless you are pretty sure it wont work.
