Like the one making the above post without providing any logical or reasonable suggestions to the OP. Truth hurts but that is what she needs to hear to be prepared. It is not rude to tell her that there is no option for now and the sooner she leaves voluntarily, the sooner she will be able to settle her life and her son's too and also get over the 10 year ban.

How is she eligible for staying in US?

Lets assume her son is USC, even in that case he cannot file for her for another 11 yrs.

One of my parents did it where I live, they were here in the US for more than 5 years, and applied for PR and obtained it. The International agency here in my city helped her obtain it.

The mother wanted to know how to best support her child. The answer to that does NOT lie in the US. If she is giving money to someone promsing her citizenship she should stop and use that to support her child. Children nor siblings can qualify for a hardship waiver. Leaving and getting the ban out of the way is one way, hoping for some amestsy program is a long shot, unless she qualifies under the old one ( I forget those rules ). The US doesn't have the mean nor desire to open their arms to everyone that wants to visit and not go home and they are about as annoying as a house guest that does the same. Wanting your resources and special treatment because they think they deserve it.

This will not be over quickly. You will not enjoy this.

I could be wrong but I am with you on this one the hardship wavier is only applicable to spouse not for siblings.

For an I-601 when the inadmissibility is due to illegal presence, the qualifying USC relative is the USC spouse or USC parent. It would not apply in this case for either the USC sibling or USC child.

It's possible an attorney could help if there is more information than was posted here, but based on the information given, I feel comfortable saying (even bluntly) that the chances of an attorney helping right now are extremely low.
