AOS affected by Obama's Immigration Move??

My main question is if anyone knows (or thinks) this big immigration thing of Obama's is going to increase our already lengthy waiting period?? I am especially thinking of those of us who have been waiting in the CSC black hole for our "speedy processing." In my mind I imagine a sudden rush of thousands of applications - and although they are different applications, I can't imagine Immigrations offices are staffed for that kind of onslaught...which means pulling from other areas...which seems to suggest waiting even longer!!! :bonk:

I know this isn't the political forum, but this has been weighing on my mind since the moment I heard the news. And frankly I am sad/mad/concerned about Obama's announcement. Aside from being (what I consider) a huge overstep of his "executive" power, it kind of feels like a slap in the face to all those of us who are trying to do this wretchedly long process the legal way. Yes I know, life's not fair, and I am very aware its complex issue. I hold no ill will towards illegal immigrants children...just ill will for Obama's decision (and ps...I voted for him in 2008). But if this political move negatively impacts all the people (including my husband and myself) who have sucked it up, and gone through the troublesome, expensive, time consuming, Immigration system the right and legal way, then its going to be hard not to feel very bitter.

I hope I'm wrong...and if you know that it will not impact all of us in the midst of the process, please, ease my fears and frustrations... :(

Thanks! An interesting and disturbing read...especially about the 1 year wait time at the one service center....I shudder about possibilities of time increase at the CSC :(

Sucks is right! I heard no mention in Obama's little plan about hiring tons of new immigration employees to do the job. And no mention about people doing the process legally in the first place having priority. I bet even Obama doesn't get how this will impact all of us in the process. Its just not fair, and its just not right.

This is not a done deal. No President can wave his hand and confer eligibility for immigration benefits to classes of people who didn't qualify for them before. It takes changing of the immigration laws by Congress. This has not been pointed out in most of the mainstream media.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The President has the authority to order an executive branch agency to selectively enforce the law, so the order to halt deportations is legitimate. Presidents sometimes use this authority as a means of kicking Congress in the pants to get them moving on changing the law. However, what the President cannot do by executive order is change the law itself. The classes of aliens who are eligible for an EAD is spelled out pretty clearly in the law, and there is no class of eligibility for kids who entered without inspection. I would very much like to read that executive order to see how the President pulled this off. Unfortunately, the White House hasn't published the executive order yet. It's curious because he announced the executive order in a Rose Garden press briefing on the 15th, and an order he signed on the 14th regarding deployment of broadband internet access on federal property is published on the White House web site. Secretary Napolitano has obviously received a copy of the order because she's said it's going to be implemented immediately. I wonder why they haven't published it yet.

I'd like to point out that Obama's decision applies to children under the age of 16. In the US you have to be 16 to work anyway for the most part (granted there are extenuating circumstances, but this isn't the place to get into them). His decision was that while we will not support the children of these illegal immigrants with federal/tax dollars, and we will not give them the rights to attempt to obtain official immigrant status, we will also not deport them. This is on the grounds that they are children and were not able to make the decision to come to the US, but now that their families are here they'd go back to nothing in their home countries. Based on my conversations with immigration attorneys recently, this is less about giving them the right to file for any sort of documentation and more about not separating children from their families before they are able to take care of themselves. Maybe I'm missing something, but I don't see how this will really affect those of us who are in the middle of the immigration process.

It actually applies to people under the age of 30, who entered the US before their 16th birthday...

This is a good thing for those young adults that came here by no-means of there own. Ive served 23 years in our military with these same young adults defending our freedoms and I salute them for there courage and sacrifices. What sucks is how people complain about how slow our immigration system is, many many many people want the opportunity to come to the U.S. and call it home, but we have a process to follow. It took about 9 months for my wife to get her visa, some are shorter, some are longer, just file and wait like everyone else.

President Barack Obama’s executive order applies to illegal immigrants under age 30 who were brought to this country before they were 16, and who have lived in the U.S. for five consecutive years.

They need to be law-abiding people who have gone or are going to school, or who have served or are serving in the military.

This new immigration system is looking for a change. This kids will be able to work and do the jobs that others are slow on. Maybe they will speed up the process . just like we all get happy to know that we have the opportunity to work legally, why not feel the same for those who did not make the decision to come to this country...
