I'm looking for advice on changing a name on the ssn card while AOS is in process. DMV won't issue a drivers license because the name in the ssn data base (married name) doesn't match the name in the passport or I-94 (maiden name). The AOS, EAD and AP papers were filed with the married name. She passed the DMV test and wants to get her license prior to receiving the EAD. The guy at DMV suggested we change the name on the ssn card to match. My question is will it affect the AOS filing if we change the ssn name during the AOS review process?

Sounds like a pain to have to go change the SS card back to her maiden name, and then go change it again, and her license once the EAD and green card come in her married name. You can do it though. It should not affect the AOS at all, since you do not even need to have an SSN to file for AOS.

u can change the ssn card and ask at the office for a print out version, so you dont have to wait for the new card to arrive.

Prior to getting EAD.. Your timeline indicates your wife came to the US March 14th. Most places won't issue anything 14 days prior to the 90 days mark (i-94). In order to even get a license your wife has to have a legal status - which she has now but you're on the 68th day(I think). The NOA1 from AOS is usually not accepted as proof of legal status but check with DMV.

Affect AOS by changing name? Probably not. It's more a matter of the time crunch you're in.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

Prior to getting EAD.. Your timeline indicates your wife came to the US March 14th. Most places won't issue anything 14 days prior to the 90 days mark (i-94). In order to even get a license your wife has to have a legal status - which she has now but you're on the 68th day(I think). The NOA1 from AOS is usually not accepted as proof of legal status but check with DMV.

Affect AOS by changing name? Probably not. It's more a matter of the time crunch you're in.

Even if SSA changes the name back on SS card and your wife gets the DL now, it will most likely only be valid until I-94 expiration date. This is not worth multiple trips to SSA and DMV, IMO.

Wait for EAD.

Yes I know the decision has to be made quickly to change it or wait for EAD. I wonder as Tygrys said if they will see a DL as reason to even change it back to the maiden name. Why didn't you show them your marriage certificate? That's all I had to do...

To answer your question though - your ID would be the EAD, not the passport. The EAD will be in married name and match the SSN.

I did show the marriage certificate. I even had the NOA's for AOS, EAD and AP in the married name. All he cared about was that the name in the computer didn't match the passport or I-94.

He asked the supervisor and she agreed with him. I didn't talk to her myself though. He said it was a homeland security rule.

Granted mine was done in 2010... Maybe call head office?

I just showed DMV our marriage certificate. They even corrected their mistake with my middle name by showing them my I-485 receipt, told them that is the correct name and all on my immigration papers.

AOS Journey

2-22-2012 - Mailed in AOS/EAD/ paperwork.

2-28-2012 - Return Receipt.

3-05-2012 - NOA I-797C received for I-485, I-765 and biometrics appointment for 3-29-2012

3-07-2012 - Sent Notice to Reschedule Appointment at local ASC by certified mail

3-10-2012 - Return Receipt

3-20-2012 - received text/email the case is transferred

3-24-2012 - NOA I-797C notice received that the case is transferred at CSC

Agreed. I had no problems showing my marriage license to match up my married name and my maiden name in my passport. Whatever the department is that deals with drivers permits in your state, call the head office in the capital.
