So it's been 6 months and we finally got word back, now theyre sending a request for evidence! I am BEYOND frustrated! I sent them pretty much everything they could have asked for!

So how long do you think this will set us back? I really miss my fiancee :(

An RFE at least means your file is moving. When you know what it is, send it back asap and you will possibly get it all sorted around 14-21 days after that. Now I only speak from observation, but an RFE is better than NOTHING happening and still waiting after 8 months. So take heart, you are getting closer. I'm sure you will get it all cleared up in a jiffy!

Follow the instructions completely. This is also an excellent time to include additional information (beyond what the RFE requires) that will support the bona fide nature of your relationship when USCIS sends your file to the consulate, si man.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Ahh thank you everyone. I suppose you're right, its better than nothing and as for what are they asking? Im not sure, i only got the text from uscis a few hours ago, which means the letter is most likely on its way right now. I Swear i gave enough though. We work with a paralegal and they said it was enough!

That's part of the suspense and drama, si man. :)

We'll see if it was USCIS's error or the paralegal's omission, see man.

"pretty much everything" is not enough. Tons of extra stuff that is not needed is not enough and does not make up for what is needed if you do not send it.

How long it takes depends very much on how long it takes you to get back to them with what you did not include the first time.

Want more good news? Your case has been adjudicated, there is no longer any estimate of time that applies. Had it been done properly the RFE would be an approval.

You made (or the paraplegal made) an error or omission.

Nice thoughts. But incorrect

Cases sit in boxes for months until they are adjudicated. "Nothing" happens to them until they are open and adjudicated which takes about 20 minutes. Maybe less. The result is an approval, an RFE or a recommendation for a denial (rare). So called "touches" are when the box containing your file is moved from one part of the service center to another and the box is scanned. From the mail room to the correct department (for example the delivery area for VSC is in St Albans VT but the adjudicators are in Essex Jct., VT about 20 miles away so when they load a truck with boxes to go to Essex, they all get scanned in case the truck does a crash and burn on interstate 89) All the files in that box receive a "touch". The only other time you get a "touch" is if your file has been opened for adjudication but needs to be reviewed but a supervisor for some reason (rare).

An RFE would have been an approval

So......when you look over in fine detail the copy of the entire petition submittal which you made since you followed the VJ Guides, can you not find the reason for the RFE?

What did you omit that makes you state you only sent them pretty much everything and not say I sent everything?

Got RFE too! so.. let's wait what they'll ask for.. I'm sure they need the document of name change from both of us.. and possibly a statement from both of us that say we will get married w/in 90 days of his arrival(i wrote a letter that explained our relationship :( blah )and possibly his passport photos (the one we sent are a little bit smaller than my passport photos) I can't wait until I get the letter... Even though this is causing a delay But I'm happy that they're looking at my case...

Well..maybe the silver lining is: at least it's an RFE and not a denial.

Get whatever documents they're asking for turned in, and hopefully you'll get the NOA2 real quick.

And maybe it's not even the documents. It could also be a missing signature. I've seen multiple cases where people turn in everything, but forgot one signature line. You never know. (I checked my stuff 20 times before I turned it in with a checklist, and it'll be my luck I get one too. lololol)

we also got RFE today from CSC. They asked for three things: more details of how we met, final divorce cert (not just final order) and additional primary evidence that we've seen each other in the last two years. We already sent itineraries, pics etc. We have credit card statements of purchases made while visiting each other and letters from family/friends. There are no stamps in our passports. We did not keep boarding passes. Any other ideas for primary evidence? Thanks so much for your help!!

Did you travel by plane? If you did, call the airline to have them send information showing that you did in fact board the plane. I am not sure what else would be considered primary evidence. I was advised that boarding passes don't mean much without an accommodating stamp in the passport to confirm it.
