Yesterday, I received an e-mail from Algeria's embassy saying that " my spouse case has been carefully reviewed by a consular officer, as a result it was determined that my husband relation with me it seems to be for immigration purpose and my case will be return sometime this week to USCIS via NATIONAL VISA CENTER.Can someone here have been in this same situation and can give me any advice about it? what to do to stop embassy in returning my case to USA, and if my case got returned, what would be my next step? Thanks so much for all of your concerns and answers to this matter.

sorry to hear. you cannot stop the embassy there are in power.... in place to make such a decision. your actions are pending communication from uscis.

I'm sorry to hear about ur situation, don't bother to refile, just get in touch with your senator or congressman,the uscis will send to you a recept notice once they have received the petition from the consulate. But it takes 180days for them to review the petition and that is 6 months from the date of the recept you just have to be very patient, please and please don't refile until you have heard from them or else it will affect you again in the next one.

I am right in it now, we are still wait.

I wish you all the best.

Keep praying to God about it there is nothing impossible for God to do when it comes to situations like this.

hellooo mill, thanks so much for your info. this is very frustrating, and as you said, I already sent letter to senator, but it will take about 2 weeks in order for them to review my letter, and I also spoke to USCIS and they told me, that i have to wait 120 days, please lets keep in touch to follow our cases updates, thanks again...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The above highlighted words are inconsistent with a Fiance(e) visa and if true are grounds for visa refusal.

A K-1 visa is for unmarried people. You and your husband (your words) are obviously married since that is how you talk about each other. If this is not true, then you may have unconciously sent that message and the COs are trained to spot this and have made their decision.

Probably the only thing you can do is to legally become married and then file a CR-1 visa but you had better be ready to show tons of evidence that you really have a real relationship. It's for your own good and the good of the country.

Visas are not filed or filed for. Petitions are filed and then based on approved petitions, visas are applied for.

To the OP,

Please clarify your original post. You said your husband's K1 visa/I129F was denied. If he's your husband, then any K1 visa should have been denied. Again, please clarify.

If they claim that your relationshionship is for immigration purposes then they seem to think you are not really a couple. Did he miss some of the questions during the interview ? How many visits do the two of you have ? what evidence did you submit. As others have picked up on the use of the words husband and wife are a big NONO if you applied for a fiance visa. If you are married you should not apply for a K1 even though in some countries people tell you to do that so you "can get a visa faster" It backfires and makes you wait twwice.

This will not be over quickly. You will not enjoy this.

. (SPOUSE, HUSBAND, IS THE WORD THAT EMBASSY USED IN E-MAIL THEY SENT TO ME. MY PETITION IS FOR K1-I-129F WHICH GOT DENIED. I HAVE TONS OF PROOF SINCE 2008 WHEN MY FIANCE AND I MET.)
