I have been told different things about petitioning my Fiance in the Philippines. I was told in the US I have to make at least 25,000 a year or more to be sure she will be approved and allowed in the US so we can Marry this was told to me by a married couple I know who went through the process 2yrs ago. I wanted to be sure what is the financial amount you need to have to ensure they allow her in. Please give me the information I need so I know what to do. I have not seen any notices that explain the financial parts of the process.

I know someone who does the filing and processing for Petitioning Fiances from the Philippines and he told me I just need to pay all the fees and be currently working and all would be okay and if needed my family can bring their Tax Returns for the past few years to show that they can help support her if needed and that by doing so the Process will go through and I just have to wait 6mths after filing to bring her here and then marry. The married couple said he is wrong and if she is denied they still get paid and I would have to do the process over again. Please help me with these questions.

As for paying the taxes for K-1. You should read the Guides here on VJ And well, there's a lot about the process. The thing is you need to pay a fee when you file the petition, then at the interview for the visa, then for AOS and so on. Note that this process requires patience, money,... so start saving.

what you need to ask the guy is if your embassy in Philippines accepts co-sponsorship for k-1,which im not sure about

I was told that i could use my family for help if needed. I am an American in California my Fiance is in the Philippines. I was told by the guy that does the processing that I can ask for my family for help. I just have to show that they make a decent income and they can become my Co-Sponsors I will call him in the Morning to be sure of all things but he did say they could help. I live in one home in compound and I live alone my Aunts and her family live in another house on the property. I have a rich type Aunt who I can ask for support and become a Co-Sponsor. I need to be sure this is the case. I am going to look into everything but I don't want to keep paying for petitioning if he is not being truthful to me. Since the couple I know just went through it the husband only used his income alone.

if you do not meet the poverty guidelines and IF your aunt makes enough money considering how many people live in her household that she support ( like children,husband and what not ) its ok,you can use her,the only reason i asked you to look up whether or not you can use k-1 co sponsorship is because your guy might be lying( there are a lot of bad lawyers out there,more than you think ).

use the search option on this website ,or look on regions forum on the board index and see what other posts members have made as far as this goes ( or i hope one of the older members who specialize in asia comment to save you some time )

So do I. He isn't a Lawyer and all he does is process the Fiances for people. He just helps the filing process and said that my aunt that doesn't live with us can be used as a joint sponsor. I am hoping that is correct cause my family is saying to ask her help cause she did it to sponsor my Uncles family and bring them to America from the Philippines. I am told it is different cause she is being sponsored as a Fiance instead of family. I will have to talk to the guy more about it.

To my knowledge,the U.S Embassy in Manila does not accept co-sponsors. Other U.S Embassy's in different countries do accept co-sponsors though! Other VJ members can chime in on this but this has been discussed in previous postings with people being rejected.

The US consulate in Manilla does NOT accept co-sponsors for a fiancee petition as a general rule (sometimes they do if you include an I-864 instead of an I-134). For spouse petitions (CR-1) they do. That's why some people go the CR-1 route so they can use co-sponsors.

The 125% poverty amounts for a 2 person household is $18,212. More of course if there are more people coming or in your household. The link posted above for form I-864P is the poverty line amounts.

As for approval.. NO-ONE can say whether you will be approved or not. You need to pay the fees, you need to show the means to support her, she needs to pass the medical and police checks, you need to show proof of a bonafide relationship and hope that that's enough. If you are denied you can re-file as a K1, or marry her and file a CR-1.

Have you tried posting your question on the Philippine forum? If you scroll down, you will find a link to it on the Regional Discussion Board. Your fiancee can participate also, and she can be able to post questions in Tagalog or find members from the same region in the Philippines as she is.

The K1 Guides are very helpful...you and your fiancee should take some time to read them...a lot of the members have been able to prepare their applications themselves through this website. http://www.visajourney.com/content/k1guide

Members typically suggest you seek the help of a lawyer if you have any complications in your case, such as previous criminal or civil convictions...but if there is nothing that will impede your case (except time), then VJ is the website for you.

The petitioner's current income must meet $18,212 for a family of 2 (am assuming there are no children involved, just you and your fiancee).

There have been successful petitioner in Manila using an I-134 co-sponsor. These cosponsors tend to be close relatives of the petitioner. The decision to accept a cosponsor is up to the interviewing officer.

Do some reading in the PI regional forum to learn about Manila specifics. There is a lot of valuable experience in the regional forum.

I think it was a year or so back, someone posted an email they received from the US Embassy in Manila in response to a question about co-sponsors. In essence, the email stated that the embassy expects the sponsor of a K1 visa to be able to meet the minimum financial requirements on their own, so they don't generally accept co-sponsors for K1 visas. The circumstances where they said they might consider a co-sponsor were when the petitioner has a good reason for having a low income and a reasonable expectation of better income in the near future (recent college grad, for example). In those cases, they prefer a co-sponsor who is a close family member of either the petitioner or beneficiary, since they consider that a close relative is more likely to be willing to sign a binding affidavit of support (I-864) after the beneficiary arrives in the US and applies for AOS. One of the nightmare scenarios for any consulate is to issue a visa and have the beneficiary come to America, only to find out they can't find a qualifying sponsor to adjust status.

Examples of cases where they likely would not accept a co-sponsor are when a petitioner has no reasonable expectation of improved income in the near future (no marketable job skills, and not going to school), or the petitioner is living on a fixed income that's not likely to improve much (retired or disabled).

You must show that you are able to support your Fiancee and her children (if they are included in the petition) when she eventually becomes your wife. You must demonstrate that you have an income 25% above your states poverty level. Or that you have sufficient assets equal to 3 times your states poverty level. If you don't meet this requirement then you can arrange a co-sponsor with adequate income or resources to guarantee that the fiancee will not become a public charge on the state.

The minimum acceptable annual income is based on the number of dependents the Sponsor's combined household will have, and should be at least $125% of his states poverty guideline.
