marrying family members for green card

I am in a mix of emotions. Last August my boyfriend (perm resident) went down to the country where he's from in the caribbean. His mother and sister live there. His aunt that lives in America sent him down there to marry his own sister (she used a dead person's birth certificate so her name was different) so she can get a green card because she dumped her kids on another family member in America (through adoption I'm sure) and she wants to see them. I understand, but I think it's a really immoral thing that the whole family condones the marriage between sister and brother just for a green card. My boyfriend says he knows a lot of people that did fake marriages and it's no big deal and he wants to help his family. I understand his concern but I don't like the idea of it, and I am afraid something bad might happen. Every day I'm really angry about it, but emotions aside and logistically speaking is there a chance of being caught? I'm not familiar with the process at all, but I have no good feelings about this situation, and I want to know what the risks are. I tried talking him out of it, but he keeps saying it's no big deal. He has nothing that proves their marriage is legit, no shared accounts/lands, he just wired over $100 to her name that's it. I really don't know for sure if he started filling out any immigration paperwork. I'm worried sick over this and I'm not sure if this is no big deal like he says or if there are major roadblocks or possible criminal charges that can happen? PLUS him and I live together and I cosigned a carnote and also have a joint checking account together, will they research that and find out?

Wow I read your post 3 times to make sure what I was reading was correct, I can't help with any legal advice, but I am thinking that he can get in a lot of trouble for doing something like that.

It makes me sad for the people here on VJ that are truly married and have to go thru such agony to get their spouse here. I personally pray that he will not go thru with it.

Timeline

There are lots of potential legal problems for the "husband" and the "wife." Deportation and long term bans from the US are a couple of things that come to mind.

A credit check isn't part of the process.

On a personal note: If I were involved with a person contemplating this course of action it would cause me to reconsider our friendship/relationship.

I feel for you Mama, it's not fair for the legit people, and besides if it's that difficult for a legit person how on earth is it going to go through for him? I am so angry in many ways. He just feels like he's doing something to help his family, but they are the ones attempting to destroy his life. He definitely didn't come up with this idea on his own. Really I hope he gets stuck somewhere in the process and can't do it, hopefully without getting into trouble. I am not condoning this at all, it really disgusts me.

They will research everything and he will get caught. They will figure out that the dead person he married is dead and not his sister. Let's see, what would happen... permanent ban from the US... jail? It's serious business.

I dont see how he can use a dead persons birth cert because they do background checks on both people ! she would come up as DEAD!! that seems rediculous... how would he think that actually worked? Such a shame really that people do this. Sorry you lost your BF over something THIS crazy! shesh.

If your boyfriend was caught, he will be permanently banned from the U.S. His sister will be arrested over there as well.

If your boyfriend thinks that it is not a big deal to marry his sister for immigration purposes if I were in your shoes I will have second thoughts of having a relationship with him. That is just illegal and immoral in all aspects of it. I hope he re-considers his decision/action.

But OP, try to convince him and have a nice relationship with him, if possible.

What he'd be doing is FRAUD and an insult to ppl here that work and wait to be with their family and loved ones the right way. I don't think the US would even... allow a brother and sister to be married. They do background checks and everything. Does he honestly think that would get past them?

It may sound easy to him, but they'll investigate it and possibly find out. Explain to him the consequences.

your bf is risking is permanent resident status. because when he gets caught, they can revoke his status and deport him back. and bet money before ICE sends him on a free trip back to his country, he will be doing felony fraud prison time.

when people try to fast track things...that's when they risk losing the ultimate goal.
