evidence of marriage with AOS?

Timeline

When we file for AOS, do we need to send evidence of marriage (wedding photos, joint bank account, etc.) or do we just bring them to the interview?

The more evidence you can include in your original application, the easier your interview will go (based on reading people's experiences here).

We sent:

Checking account statements (both names on account)

Savings account statements (both names on account)

9 pages of pictures taken over 12 months

Insurance policy showing dual coverage

Life insurance policy showing her as my beneficiary

Retirement plan showing her as my beneficiary

Utility bills (gas, electric) addressed to both of us with our current address

AOS - Adjusting from F-1 student visa via marriage:

03 May 2010 - Sent I-130, I-485, I-765

05 May 2010 - Delivered (USPS tracking confirmed)

10 May 2010 - Checks cashed (goodbye $1365)

14 May 2010 - 3 receipts received (I-130, I-485, I-765) via USPS (I-797C NOA)

01 Jun 2010 - Biometrics appt notification received for 16 June 2010

07 Jun 2010 - Successful biometrics walk-in (SLC, UT Support Center)

30 Jun 2010 - Notification that first biometrics appt didn't provide good fingerprints, scheduled another appt

02 Jul 2010 - 2nd successful biometrics walk-in (SLC, UT Support Center)

14 Jul 2010 - EAD card production ordered! (I-765 finally touched, no touches on other forms yet)

31 Aug 2010 - Green card arrived in mail

Removing Conditions:

24 May 2012 - Sent I-751 w/ evidence to USCIS - CA Service Center.

26 May 2012 - I-751 package delivered (USPS tracking confirmed)

15 Jun 2012 - I-751 NOA-1 received via USPS (dated 29 May 2012)

11 Jul 2012 - I-751 biometrics completed (Salt Lake City USCIS office)

7 Feb 2013 - I-751 approval letter received (dated 5 Feb 2013)

8 Feb 2013 - Permanent green card received in mail (condition free!)

We sent zero evidence of marriage and were approved without RFE or interview. Evidence is extra clutter in the application in my opinion. because nowhere in USCIS instructions do they ask you to send it. If they wanted it, they would tell you.

When you go to remove conditions (10 yr green card) the form specifically tells you to send evidence and gives examples of what they would like to see.

Actually the OP entered on a K1 visa, you did not. K1's have already had an interview and many don't have one for AOS(some say the chance of an interview for a K1 is 50/50.. I didn't have one). The other reason we (K1's) don't send evidence WITH the application is because we have 90 days to marry. Some file AOS asap, meaning they haven't had a chance to accumulate the sort of evidence you're talking about. We collect it just in case there's an interview but we do NOT send it with the AOS forms.

As you (the above quoted poster) AOS'd and had to file an I-130 you are an entirely different case. That's why there's a separate forum for Family based visa adjusters (k1's etc), and people who adjust from other visas (visitor etc)

As you (the above quoted poster) AOS'd and had to file an I-130 you are an entirely different case. That's why there's a separate forum for Family based visa adjusters (k1's etc), and people who adjust from other visas (visitor etc)

Oops, sorry - didn't see that! I always forget that fiancee visa holders have to file AOS like all other people adjusting. (I married someone on an F-1 student visa and we're adjusting visa family-based documents, so I straddle a few forums.)

When you go to remove conditions (10 yr green card) the form specifically tells you to send evidence and gives examples of what they would like to see.

NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:

E. Documentation showing joint ownership or property; or

F. A lease showing joint tenancy of a common residence; or

G. Documentation showing co-mingling of financial resources; or

H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or

J. Any other relevant documentation to establish that there is an ongoing marital union.

If there is an interview, then they will get a notice which requests such things, and it may be a good idea to just keep that in mind and be sure that they start gathering that evidence for future use (so it's less of a scramble) but it's not needed for the initial filing.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Are we clear now?

A petition (I-130, I-129F) does need evidence.

AOS (I-485) is the form we sent and did not include evidence because it isn't asked for.

Anybody that is sending the I-130 petition and I-485 AOS application jointly is posting and answering in the wrong forum. Thus the confusion with Nir12. My reply about no evidence was based on K visa adjustment of status with the form I485. K visa holders have already submitted petitions many months before AOS.

I just send in the forms needed for the Greencard,AP and EAD

along with The Biographic form and copies of Passport,I-94 etc

I just submitted a certified copy of my marriage license as proof of marriage and that was it.

We got transfered to CSC and didn't had an interview!

11/22/08 - met in America when I was au pair

05/05/09 - went back to Germany

06/24/09 - Dave visits (6 days)

06/26/09 - got engaged

07/24/09 - sent I129F to CSC

I guess I'm the one the deleted post was meant for. Sorry you were offended Nir12. My only intention was to try to summarize some confusing posts. Yes petitions need evidence. No the application to adjust status doesn't. And that it is confusing when people adjusting from different situations answer the same thread with good information about two different processes. I personally was totally confused when I started AOS by the mixture of the visas within this particular forum. Lately the new mover people have been doing a good job of separating them into the best forum for their visa type. I really wasn't knocking you in any way....just trying to kinda clarify all the good points made were for different situations and that there are separate forums for the different adjustments of status. It was more for other readers new to AOS to learn the difference. It wasn't meant to be personal to you. And I think I'm pretty grown up already.

Thank you for your kind words. I was just trying to help because I have gotten some help on the forums. I understand that I made a mistake in only reading the post and not the status. But, now it is as though everyone is attacking me. I set out to do something good and help a person in a similar situation as myself (trying to immigrate). Anyway, thanks for being mature and overcoming our differences.
