No citizenship for US-born migrant kids

Font Size:Default font sizeLarger font sizePHOENIX - Nearly two-thirds of Arizonans think children of illegal immigrants should not be entitled to U.S. citizenship just because they were born in this country, a new statewide survey shows.

The findings, released Monday by Rasmussen Reports, come as state Sen. Russell Pearce, R-Mesa, is weighing legislation that would prohibit the state from issuing a birth certificate to a child unless at least one parent could prove citizenship. Mere presence in this country, legal or otherwise, would not qualify.

A similar measure dealing with what are called "anchor babies" was introduced during the 2008 legislative session by Sen. Karen Johnson, R-Mesa, with Pearce signed on as a sponsor. But that proposal never got a hearing.

Since that time, though, Pearce wrote and engineered passage of the toughest state law aimed at illegal immigrants in the country. At the same time, immigration has become the focal point of Arizona politics.

But the controversy is not limited to Arizona: Rasmussen reports that 58 percent of people nationwide say citizenship should not be conferred on someone solely because of the location of that child's birth.

The question is deeper than simply denying a birth certificate. It also means that the children of illegal immigrants, now entitled to various public benefits, would find them off-limits.

Pearce acknowledged that courts have ruled the 14th Amendment to the U.S. Constitution, passed in the wake of the Civil War to provide equal protection under the law, guarantees citizenship to anyone born in this country.

But he said extending that right to babies born of parents in the U.S. illegally is based on a misreading of the amendment.

He notes it says citizenship requires not just birth in the United States but also that the person is "subject to the jurisdiction" of this country. He said that does not apply to people here illegally. And Pearce said he believes a federal court, given a fresh chance to look at the issue, would reach the same conclusion.

But Rep. Kyrsten Sinema, D-Phoenix, has argued that it is Pearce who is misreading the Constitution. She said visitors, legal or otherwise, are subject to U.S. jurisdiction, just as a foreigner who commits a crime here can be prosecuted in Arizona courts.

Calls Monday to press aides to Gov. Jan Brewer seeking her stance on the issue were not returned.

One possible foe will be the Arizona Hospital and Healthcare Association. The organization opposed the similar plan from 2008 amid concerns about putting its facilities, which actually issue birth certificates, in a law enforcement role and eroding trust with patients.

The telephone survey of 500 likely voters, conducted on June 29, has a margin of error of plus or minus 4.5 percentage points.

I think on the Federal stage at least a law could be produced that identifies that illegal immigrants are not officially under the jurisdiction of the US and therefore citizenship does not pass to their children. Such a law would work with the constitution.

Correct me if I'm wrong but ambassadors children do not get citizenship if they are born in the US correct?

Yes I generally disagree with that argument as well. They are more akin to indentured servants which while the practice should be considered unethical still gives the person something important, something that distinguishes them from slaves - A Choice. A Choice to enter the US and subject themselves to low wages, but it is still their choice.

indentured servants did KNOWINGLY for 7 years ...

what is the timeframe for the illegals ... oh until the next amnesty? i hope the illegal aliens get fvcked ... and not only go to the end of the line ... but get a ban (for them and their children) as well ...

meanwhile ... please submit your costs for doing the immigration thing the correct way and receive FULL payment from .gov BEFORE giving a free ride to the illegals

Anyone who says the 14th amendment entitles an illegal alien child or even a legal alien child to birthright citizenship, has not read the hearings, the writings, or anything that went along with the 14th amendment. They're plain ignorant in every way.

true, but our judges tend to be ignorant, too.

Yes I generally disagree with that argument as well. A Choice to enter the US and subject themselves to low wages, but it is still their choice.

If one dissects the definition, there is a distinction. If one considers the way of life and working conditions, slaves generally had it better. That is probably not as well known by illegals whent they make that decision. Illegals are the current "replacement" for slaves. The analogy is valid. We have ALWAYS had slaves in this country, or some facsimile thereof. Slaves, oppressed black people, illegal immigrants...all because and ONLY because it is economically feasible to do so. We could have ended slavery without a war by TAXING the property of the slave holders and making slaves economically unfeasible to own. But the war wasn't about slavery any more than rape is about "sex".

Rather than hope the illegals "get fvcked", I would like to see the employers lining their pockets by abusing and exploiting them get fvcked. If we would end the economic advantage of hiring them and end the opportunity for illegals to work in bad conditions for half wages, the problem would go away.

However, like slavery, the dirty secret is that neither political party WANTS the "problem" to go away. They just "address it" in the way which fits into their constituents desire. On the one hand...BUILD A FENCE, on the other hand...AMNESTY. Neither will work and amnesty is simply a conversion of working illegals into unemployed legals and a conscription of more "slaves" to replace them. Once "legal" the illegals will demand minimum wage, payroll taxes, benefits, safety equipment, etc...all those expense for which they were hired as illegals to begin with. Their "selling point" is stripped away and they have to compete for honest work with native speakers. Good luck with that. No problem for the one political party...they will put them on welfare and make them dependent and count up more votes for Obama and people like him. Republican business owners will hire the new illegals that pour across to take their place. In a few years there will be another amnesty and the democrats will rack u another 12 million people or so to depend on them. Eventually they will become citizens and VOTE to confiscate money from OTHER citizens who work for a living, to support their families.

And you expect this will change anytime soon? If ANy politician were serious, they would propose a TAX on hiring illegals, an onerous tax, and allow the confiscation of property and businesses to pay the tax. If the penalty for hiring an illegal to mow your lawn was the loss of your home...would you do it?

No they didn't.
Don't all the States have to abide by the treaties America as a federation signs? US did sign and ratify the charter. So Arizona should abide by it. If it doesn't, UN should sanction Arizona. WTO should slap the state with stringent trade restrictions.

you need a piece of paper to know that you were born?
Nah. But you need a frigging birth certificate to do a whole lot of legal things, dumbass. Seriously, do you try to be dumb or are you just naturally dumb? You used the immigration system of America. Did you not need your birth certificate and your spouse's birth certificate from Canada?
