My overly stubborn husband was told by some friend that he has to have a US government issued photo ID. I have tried to convince him that they include foreign government issued ID's as in his passport. He is driving be crazy insisting he has to get a California ID card ( which I don't think he can because the I 94 has already expired )

I was worried about that as well. The EAD came a couple of weeks before the interview, and we were able to get the state ID using it. HOwever, you don't need it as he can use his passport as ID. Don't worry...I was stressing about it too, but everything was fine.

Thanks He doesn't have an EAD and so he is in that funny state with no valid paper that says he is authorized here yet he thinks he can just go get a DMV ID. I will probably get an earful tonight if he stays a few hours at the DMV and they won't give him an ID for lack of a valid document for his presence here in California

The requirment is to have government issued ID. It is not required that it be U.S. government issued. Marlene had only her foreign IDs when we went to the interview. She used her passport.

This might be for a separate state than yours but the info translates as we're talking about the US government, not the government of his specific state: http://www.accessclarkcounty.com/depts/district_attorney/bcu/pages/section5.aspx

Hope those help too :) Alternatively, on the instructions for the EAD here: http://www.uscis.gov/files/form/i-765instr.pdf page 6, 2, b it mentions that you must send government ID such as PASSPORT etc...

Oh no! Not the stubborn husband again! :D Well, tell your stubborn husband, that without valid I-94 (or any other valid visa) he cannot get California state ID or driving license. You can read about it on DMV website (under required documents to apply for state ID). He needs either valid visa or EAD or GC. If he has none of those he cannot apply for it. And No, they don't accept NOA as a proof that you are waiting for you GC (they laughed at me at DMV when I showed them NOA).

Also at USCIS they know that once you become illegal, life becomes very difficult (talking from experience) so they accept foreign passports as ID.

If your husband still doesn't believe it, send him to DMV to stand in the line for 2 hours just to be sent home later! :D I bet all of his stubbornness will go away! LOL

His passport is the "government issued ID". So he should use it everywhere were they require form of ID (I use mine everywhere and also for USCIS - no problem).

Let him go to DMV to try and apply for it, they will just laugh at him and send him home LOL

Once hubby has his GC, I strongly suggest that he gets a California ID or Driver License, then puts the GC in a safe place and the California ID in his wallet. If he ever loses his wallet, he gets a new State ID without problems; if he loses his GC, he is up for a nasty and expensive journey.

what makes this so funny is while we were on our nightmare SSN saga we went for an infopass appointment to the very same building using his Nigerian passport. But he wanted to argue with me that it wasn't the same section. I simply told him it was the same front door. He sulked a bit ( he hates being wrong )
