This is our "second time around". We originally filed for a F 129 in 2008. Visa denied at Guangzhou. It was returned to the California Service Center and allowed to expire.

Hey all :-) I'm a NOA1 of April 13th and still no touches and no news. This really sucks but I'm hoping to get approved this week!! Been seeing people with a later date being approved before me but they're also not being processed in California which I'm starting to think is the real problem :angry:

Anyways, if any of you have any advise for me or tips or even short-cut numbers to get to someone that can actually help me would be much appreciated :thumbs: I'm sitting on 5 months and going on 3 weeks here so yea, I'm losing my patience... :help:

I totaly understand how you feel. My NOA1 is April 9th. I called USCIS last week and they told me that I should hear something good or bad in two weeks. But we have to be patient because at the end it will all be worth it. So keep positive your time to celebrate will come.:)

Im not postive what to do I-129F has been approved only, and I-130 still pending, does she need to do adjust a status ? when she get here Im totaly lost now

Well, that I-129F ultimately results in a K-3 visa, but once she comes in, still has to file AOS case to get any greencard.

For now, suggest you contact NVC, and inquire about the I-129F.

It may be that the I-130 approval will happen within a week at USCIS, and, IMO, if that happens, the I-129F and the I-130 will travel together into NVC. IF THAT HAPPENS, expect the I-129F to be administratively closed at NVC - see http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/

IF , within 4 to 6 months of TODAY, it's been more than 2 years since the marriage date, I heartily recommend that you pursue the CR-1, via more processing at NVC - as she MIGHT be qualifying for the IR-1 designation by the time she comes across the border. If that's the case, it's a godsend - no more mucking about with USCIS for 10 years after arrival in USA.

You may want to compare the 2 visa types, K-3 vs CR-1 - see http://www.visajourney.com/forums/topic/204324-wondering-if-i-made-a-mistake-marrying-in-us/page__view__findpost__p__3060767 then try to balance out 'time vs money vs status', get some good idea of what you want to do for your spouse.

For now, though - really, the thing that makes the difference, is WHEN the approved I-129F travels into NVC.

Good Luck, whatever you decide ! Personally, if I were in yer shoes, I'd chase after the CR-1 or IR-1, not muck about, at all, with the K-3.
