My girlfriend entered illegaly to US about one year ago and was detained in Phoenix and signed a paper where she promised no to try to enter again in 5 years but she tried again and she is here. If I married her, what are the problems we are going to face if we apply for her green card. We need your help. Does anybody had the same problem?

It is my understanding that you would be denied. She was told not to enter again for five years, and she did. She broke the law, even a waiver would not cover this, even if you married her. She probably is going to get a life ban for doing this. My advice is to go back to her home country if you can and try living there.

You should probably consider at least a consultation with a qualified family-based immigration attorney before you file anything. Based on this consultation, you can better decide if this is something you should do yourself or with professional assistance.

Yes and a competent ethical immigration attorney is probably going to advise you that you'll have a very long, difficult and expensive process ahead of you with no guarantee of success, ever.

Just remember any ban begins with her departure from the USA. If she's found here now, that ban is for life.

A second illegal entry after deportation results in a lifetime ban. Even the best, most expensive, and slickest immigration attorney cannot perform the impossible.

Agree, she is present without inspection (again) so she is not eligible to file for AOS from within the US. IF, by some small chance, she leaves the country and the US does not know she was here the second time she might be able to wait out the original ban and then apply for a visa.

She entered EWI, was deported and she signed a statement with U.S. immigration that she would not attempt to reenter for 5 years and instead of waiting out the ban like any normal, reasonable person would do, she entered again, that too as EWI again!? Man, your girlfriend's got some balls.

Seriously.

Tell your girlfriend to go home.

You should probably follow her there if you want this relationship to work.

This is a LIFETIME ban and I don't see any attorney overturning this.

No, I'm not being rude or insensitive. I'm only telling you what the truth is. You'll figure it out on your own soon enough, or an attorney, worth his price, will explain this to you.

People that want to sneak in will find ways to get around inspection on the vast unpatrolled areas. They don't think about what they are facing and I used to live in AZ where they would regularly find corpses of those that didn't make it. There is a vast amount of misinformation in the illegal community including stories about getting a green card if you marry a citizen or after X years here even if you are illegal. Because of this people make horrendously stupid decisions. The OP has a mess on his hands. If there are any footprints of her being here then she is facing a lifetime ban that will never be overcome by marriage. If she sneaks back out undetected after her ban is up they can apply for a visa. Otherwise life in another country is their only option.

This will not be over quickly. You will not enjoy this.

I would seriously just start looking at moving to your girlfriend's country.... the U.S. immigration route is almost certainly not going to work for you.

All the other mentioned above OR...the only other option for her is to live here illegally for the rest of her days, and pray to God she never gets caught/pulled over by police or whatever reason...but then again WHO wants to be looking over their shoulder the rest of their days.

But i agree and second everything that everyone else has said....she is right now on a lifetime ban if caught...so your options are...

-get her to go back and wait out her ban, and apply

-go live in her country

-she live here illegally the rest of her life and with no status and worrying day to day if "today" will be the day she gets caught, deported etc, etc.

Trust me...if they catch her, and deport her...you'll basically never know WHERE she will be, because ICE could take her out of state to another detention facility,...probably won't be allowed to make a call to you considering it would be the 2nd time caught....basically you would not hear from her until she's back in her own country...

She from Mexico by any chance??
