I'm a singapore citizen and my fiancee is american. we're both in singapore and want to move to the US. let say i go there as a tourist, get married to her there, have an adjustment of status, and stay in the US. any problems with this?

Possibly there could be problems. Visa fraud. If someone suspects that you entered the US to marry and not for tourist reasons, they could deny your AOS. Why not get married there and then apply for the K-3 visa? It's about the same as doing a K-1.

actually we sent the I-129f for K-1 visa on 10-Mar-09. but we plan to get married this June to satisfy the family. the reason we chose the K-1 instead of K-3 is because it's a shorter process. we thought we can just not disclose the fact the we're married during the interview and get married again once we're in the US. turns out this is fraud and the consular are able to do checks, if I get caught i'd risk deportation and ban from entering

so now seems like k-3 is the way to go. do i need to start over and pay the application fee again? or is there a way to change from k-1 to k-3?

why did you even file for a FIANCE visa if you knew you would get married in singapore anyways? just because it seems faster?

if the us citizen also lives abroad, why didnt you do direct consular filing? im not sure that filing a k-1 with the petitioner not residing in the us is even possible.....

trying to develop a scheme to circumvent US immigration law is not allowed. It could have devastating results if discovered. Be careful, you have at least two posts with two different schemes. Both could have the same ending result.

if the us citizen also lives abroad, why didnt you do direct consular filing? im not sure that filing a k-1 with the petitioner not residing in the us is even possible.....

yes now we plan to do the direct consular filling after we get married in singapore...

the only reason we chose to do the k-1 is because we thought it was a faster process than k-3 and we don't need to wait until we get married, which is scheduled for this june....what else would we chose that for?....but that's life, we live and we learn, and now we know better...

is there a proper way to cancel the i-129? the application has not arrived at USCIS and i already ordered a stop payment on my check/bank draft... is there any use to send a letter stating we want to withdraw?

write a letter to USCIS and tell them you want to withdraw the petition...

Like said before, it is visa fraud... going to the US with the knowledge that you will get married there and then try to stay there is an illegal act. And seeing you already send the K1, they will know this too at the border so you cannot say it was done in the spur of the moment.

Yes. If you enter the USA as a tourist but with the intent to marry and adjust status it is visa fraud and they could deport you and bar you from future entries to the USA. If, however, you enter with no intent to marry anyone (for example a REAL tourist or a student) and then meet someone and marry, you can do this. You will have to demonstrate it was nt your intent to marry when you entered. Good luck with that. Since your fiancee lives in Singapore and you just entered the USa with her and then "Oops" decided to marry her now! Hmmmm. What do you think?

This is what the K-1 visa is for. A tourist visa is for visiting the USA, K-1 visa is for entry to USA and marriage. IF it were allows to use a tourist visa as a fiancee visa, then why is there a K-1 visa?

What you propose is VISA fraud, if this INTENT is determined, the adjustment can and probably will be denied, and deportation will happen.

If you do direct consular filing, the American spouse has to prove residence in Singapore for at least 6 months.

I agree with what everyone has said and you need to be careful because it seems like you are running a very fine in between being totally honest and intentionally committing visa fraud.

For the record, You CAN file a K-1 with the petitioner not residing in the US. As long as the petitioner has a US address that they can receive mail at and a way to prove they can support the Non USC (either because of a job abroad or through a co-sponsor), then it is no problem.

I lived abroad throughout my entire K-1 process.

From what I am seeing though, it sounds like it is best to get married and do DCF. If you fiancee plans on staying in Singapore between now and June anyway, then that is ALMOST 6 months. Why don't you get married tomorrow at the courthouse (or as soon as you legally can based on how long it would take to get needed documents in order), live in Singapore while you wait for his residency of 6 months and then file DCF?

And just so you know, the residency requirment of 6 months is a bit different in every countries. Some countries require that you are a legal resident for 6 months. Other, like Brazil, only require that you have been IN the country legally for 6 months as long as you are a legal resident when you apply. For example, I entered on a tourist visa in Jan and will apply as a legal resident in July, it doesn't matter that I entered as a tourist. Email your consulate and they can tell you the answer, that's what I did.

I don't think Singapore residency will be an issue to us. My US citizen fiancee has been in Singapore for 10+ years and she's a permanent resident here.

what is more of a concern to us is establishing her residency/domicile in the US for I-864. my fiance was born is dallas, left the US when she was 9 y/o with her family. she has never been back to the US since then and now she's 24. she has never filed any US tax returns. her parents are also in singapore. any ideas?

this is visa fraud, you filed for k-1 visa meaning you are not married yet, and should not get married until the visa is issued, or it will be denied, yous hould just wait , or file k-3
