Visa DENIED!!! I need your help

Thank you for all your responses.

I just talked to the immigration assistant, Monica Maxwell and she said not to worry, it's not the end of the world. I sent Monica a couple of emails after I found out about the denial and told me that she will forward my emails to the CO who interviewed my fiance. She told me to expect a reply directly from the CO this week and he will tell me what else he needs. I asked if our file will be sent back....she said that the CO will retain our file until he gets back whatever he needs from me.

I feel a little better and if a second interview needs to be scheduled, I will be there with my fiance. I will keep you guys posted. Please keep us in your thoughts and prayers.

You might PM the member 'almaty'. He flew to his fiance after an initial interview denial and got things turned around. If memory serves me though he was on a flight out pretty quickly.......

Agree!! same here after the initial denial,I had to fly to El Salvador and be interviewed by the OC along with husband(separately) Visa was issued on the spot,it wasn't easy but it was done!!

Stay strong you'll overcome this obstacle,you'll see

There have been others who have been denied initially and then approved on 2nd interview. See what they want/need and go from there.

What's the big deal about a K1, when a person comes here with one, THEY know he/she is here, and if you don't get hitched in the 90 day limit, that person is deported, and if have problems with the I-751, another reason to be deported.

Ha, you meet someone, really don't know if you are going to fall in love or not, find out things about that person you may not like, have an arguement, religious, political, in-law problems, find out that person is already married, or only interest in you because of your money and a number of other reasons not to stay together like you want a family the other person doesn't. This all takes time, a lot of time, and many times, a waste of time, but you are suppose to document all this stuff just in case?

If you say you want to marry someone, an adult, a citizen, a taxpayer, that should be enough.

If asked in a court of law today to prove that I love my wife, not exactly sure what I would say, how do you prove something like that? The fact we live together can be construed as a long act just like in the movies. I suppose if they threatened to kill her, I would request to die in her place, but that would also make her life very miserable. This whole thing is crazy and what right does our government have to come into our bedroom? We have a US Constitution for that.

This guy must be a real hard ###, can you find someone else?

Really sorry to heard about that.

When i had my interview with the CO, during some seconds, i had doubts (i never had during all the process), i was afraid about denial, he seemed so suspicious, and was interested only by one question: communication between my fiance and me.

Until now i don't know if he was convinced, but he gave me the 'pink paper' (the process to send back my passport).

My best wish for you is that your fiance has a second interview with you, i think he will be less suspicious.

Sorry for that but keep your faith, things aren't lost.

I'll be thinking of you both! Hope things go better and that you are able to resolve this.

Mark and I hardly ever phone each other because it's so expensive and instead talk for hours daily on skype using webcams... I think it odd to obsess so over the length of phone calls when there is plenty of other relationship evidence supplied.

As early as 2006, COs were calling for second interviews (in Colombia -- see the "Consulate & Embassy" forum, or whatever it's called).

My fiancee experienced a "failure to issue" on April 29 in Ecuador. She brought tons of evidence, but the CO was looking for any excuse to not issue the visa. His was "why your U.S. fiance visited for only 5 days at a time or so." (No matter that I made 3 such trips and have a JOB.) I am "required" to attend a "marriage interview" with her (with much difficulty, I was able to schedule this for June 30). The goal, per the 221g (handed to her only in Spanish, thank you U.S. government), is to "prove the validity of the relationship."

On one hand, calling for a second interview with both parties present seems better than a flat denial. On the other hand, the consulate's website SPECIFICALLY states (in the answer to FAQ #8) that "only the applicant will be allowed in the interview." My detailed thoughts on this are in the "Where's your Fiance" thread in the Consulate/Embassy forum.

At least the anecdotal evidence (which should be organized on VJ into a group of threads) is that the second interviews usually pay off with the issuance of a visa, si man. The drawback is this: If the visa is not issued despite the U.S. partner's presence, the only option is to marry in the foreign partner's country, apply for a K-3 and wait even longer than for the K-1, and end up back at the same consulate that denied the K-1.

Annabelle, it's a VERY good sign that the CO kept your fiance's papers. Three different immigration attorneys to whom I spoke about my own situation said this, si man.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thanks guys. My fiance was very upset when he broke the news to me this morning and he initally said he was "denied". As I'm reading various denial posts, it doesn't look like we were flat out denied yet since it sounds like the CO just needs further evidence of our relationship...especially the phone conversations.

I am printing all of my phone bills and will also get a copy of all my calls to my fiance from this prepaid card online service I used/still using. The actual phonecards I used will only register the local access number...the CO probably isn't aware of that. It's just unbelievable that between me and my fiance, we have spent thousands of $ to call each other daily.

It does sound promising that the CO didn't give my fiance anything (denial form) and the immigration visa assistant told me on the phone that the CO will retain our file until I provide him with what he needs. I was afraid that the CO will send the papers back to the US and I was assured that this was not so. I am waiting for the CO's email. If a second interview needs to be scheduled, I am preparing myself to fly out there to be with him on his interview.

And yes, I'm going to stay positiive but if we get unfavorable results after all this, we will marry in my fiance's country and go the spousal visa route. I'm just hoping we don't have to....and that we can satisfy what this CO wants.

My fiance just called me from Barbados. The denied his visa because the consulate officer said that he wasn't convinced that we have a bonafide relationship. He questioned why I wasn't with him at the interview. He told them I have to work.

I sent my fiance 1" thick worth of evidence. Phone call receipts, boarding passes, money transfer receipts, pictures, emails, cards, and all of my financial documents. I sent EVERYTHING that they could possibly want or need. The CO said he is not convinced and told my fiance that he is denying it and that I should speak to the USCIS here in the US.

Please help me.....what can I do at this point? I don't understand why they denied him because I sent a lot of evidence and we do have a bona fide relationship. The CO did not give my fiance anything back. What happens next? How can an individual decide our fate?

Please help me....I am so desperate. I do not know what to do next. I am beside myself and sitting here in shock and disbelief.

I can certainly identify with you,my fiance's visa was denied also.You can either go to Barbados and marry him,or appeal the decision.Did the CO give your fiance anything in writing ?

July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE
