my foreign wife had me arrested

Timeline

hi everyone,

I brought my wife up from Colombia on k-1 visa in October. And married shortly after. Then in April just after our 6 month wedding anniversary she had me arrested on domestic abuse charges. She picked a fight in car and yelled at one another. Went shopping took her home and I packed a suitcase and left house. I did want things to get worse. after I left house she calls police and files complaint and I was arrested. I never touched stood in her way or forced her to do anything. After I was released from jail they placed a no contact order on me I could not go back to house or call or text her. I have not been to court yet and she already a protective order and wants to stay in house and have me pay all the bills with waiting for ead card. she does not even have that yet. Would anyone know of scams,advice of what to would help . thanks scott

Timeline

Disorderly conduct, domestic fear, and fear of assault. I have not seen police report. I have hired an lawyer and decided it was best to  file for divorce. The lawyer advise for right now not to withdraw the I684. We go to court next week on tues5-15 and thurs 5-17. Told me to wait until then. Since it will at least a year before our A.O.S. case is heard. so right now I am listen to lawyer and broken and confused heart. Thanks for your advice scott

Agree'd. There's no reason to wait.

If you're lucky it'll take a year and you have that time to wait, if you're unlucky they'll approve EAD/AP and GC at the same time in a month. (It's rare but has happened)

Why not?  If you are filing for divorce, seems the logical thing to do...

Why would the lawyer advise that? You would be bound by it even if you are divorced if it is approved before you can withdraw it. I repeat... the I-864 is still enforceable even after you are divorced. Look in part 8 of the form where the question asks, "When Will These Obligations End?" It has a note in that section that says... Divorce does not terminate your obligations under Form I-864.

You should be on the phone with immigration this instant. If they approve her green card before you are able to withdraw... you are even more screwed.

But in the mean time you should still pull the I-864. If she has gone far enough to place protective order against you (which is now on record) then the least you could do is protect yourself. I fail to see how this is benefiting you in any way.
