Help!!! Filed 1 week ago, now wife must leave for emergency

Okay things were going good. We sent off the I-130, I-131, I-485, etc. Last Monday Express mail with tracking. So on Tuesday I found out the packet was signed for. I also sent the G-1145 with the packet and no email yet. So far so good with the guide and answers to my questions.

But now there is an emergency that requires my wife to return to Ukraine in less than a week. Her current visit is good until June 23rd so no problem leaving & the B2 is actually good until 2019, I am worried about the traveling causing the immigration process to be screwed up and my wife to not be readmitted back.

Can I call anyone or file something else? Any help at all what I should do to mitigate this so it does not screw things up would be appreciated.

I was told when you file u must NOT leave the U.S. It will be considered abandoned. Did they receive your application yet? If so perhaps call and ask USCIS... My thought

OP doesn't yet have the NOAs or case numbers, so I'm unsure if emergency AP can be issued at this point.

If your wife departs the US before AP is in her hands then her AoS is considered abandoned and she would need to pursue an immigrant visa from outside the US; this would take approximately one year.

Some places will allow "walk ins" but not all.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Wait until you receive NOA of everything then you can schedule infopass for expedition. Good luck.

can this emergency be solved by anyone else? I ask, because your wife is about to abandon her single-path to getting a green card.

it's also 'iffy' if she'll be allowed back in on the B2, as she's now married to a USCitizen and has proof of prior attempt to adjust status.

Okay so I am panicking a little, of course it would be in her name. Made the appointment and it is two weeks out, will try calling and see if we can get in sooner.

you will need a receipt/case number for the info pass otherwise they will not have a case they could review. in the meanwhile - gather the proof that supports the emergency if you hope to get a sooner date or faster processing.

Thanks for the replies, I went ahead and made an Info Pass appointment.

Then when I get the case number I can go back in and edit to include it and not lose and time.

Otherwise the appointment might be sometime in July if I was to wait until I get the receipt/case number.
