I've been married for 4 years and have a child. Can I immigrate on B2 visa?

Hello, my wife is a US citizen and I'm Brazilian. We got married 3.5 years ago and now have a child. Although I only have a tourist visa, we are planning on moving to the US in July/2014, and soon after landing we plan to file I-130 (with I-864), I-485, I-765.



My questions:


a - is my entry to the USA or approval of I-485 (AOS) risky since I'll enter on a B2 visa?


b – can I study soon after arriving?


c – she will be employed soon after arriving in the US with a salary of 2k a month. Is that enough to sponsor me or should we get a co-sponsor for the affidavit application?

Entering the USA on a tourist visa with the INTENT to stay and adjust status (AOS) is illegal and can carry a lifetime ban. It is against the TOS on this site for anyone to advise you to do anything illegial or commit immigration fraud. File now for the i130 in Brazil, unfortunately, it will not fit into your timeframe, but neither will a lifetime ban... Sorry. Best of luck.

Since you have already shown intent, what you two are planning on doing is called VISA FRAUD. The correct thing to do is to file for an IR1 visa. Good luck.

Straight fraudulence. The visitor visa is not for immigrating. You have a kid and being married for a while is no exception to that.

I could only hope for a well deserved lifetime ban in the event this attempt is made.

Alright, thank you guys for your very consistent and timely input. Really.

It's just SO ANNOYING to immigrate into the US. My wife was treated SO MUCH BETTER immigrating to Brazil. She came when europeans were flooding our Immigration Dept. with petitions, and they had just gone on strike, and they still helped us fast and it cost us about 200usd for everything.
