So through reading other threads, I realized that I just sent the I-29F APP. I didnt submit anything else besides the payment. Was I suppose to send proof with the application? I thought you just needed it for the interview! Should I just send them stuff now? Even though they havent requested it?

So you didn't send letters of intent, or photos, or birth certificate copies or ANYTHING except the form and a check?

It's likely they will just deny your petition. I strongly advise you to make a copy of all the supporting evidence with a copy of your NOA1 and hope they match it up. They might not, but at least you tried.

Don't send anything unless they send you an RFE.

in this particular instance, I disagree. If they ONLY send the form and a check they are likely to not even be RFE'd, they will most likely be denied and lose the application money. For that reason they need to send info NOW with a copy of their NOA1.

I would advise before you get any further into the process to read the guides and also read all the information available that comes with the forms/ applications and packets.

I'd normally say wait to see if you get an RFE however with the lack of evidence and forms, it's hard to say if you'll just be waiting for months for a denial.

IF you choose to send the supporting evidence, I hope you know that they do not always team up with the original petitiion. As an extra precaution, I'd advise you to write your case number on the envelope and on the evidence you submit.

Save copies of what you submit so you'll at least have it laying around in case your petition is denied, or they did not receive your new package.

K1 process, October 2010 > POE, July 2011

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

I can tell you that you are best to call them and ask their opinion - BUT - having waited for 5mths to be DENIED for sending the I-129F app and a few documents (the rest were left in another folder in error and sent with a copy of the NOA1 a few days after receiving the NOA1 - the two submissions were never connected and we were denied for lack of documents) - you are better to start again rather than wait for the heartbreak of a Denial several months later. They will not negotiate on this and you will still have to pay a new fee - believe me, its better to start again and follow the K1 Guide on this site and not waste time hoping and then trying to have a denial reversed.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere, and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

Wait until you get the NOA 1 (Receipt Notice) because it will contain a case number. You should get that within a week after sending in the petition. Make a copy of it and send it in with the additional evidence and a brief letter explaining what happened and requesting they attach it to your petition that you sent in on ___ date. Without the NOA 1 receipt number, they won't know where your petition is and if you just send in evidence without a petition or receipt number, it will just get trashed. I sent in my petition with everything that was required, but I started getting uneasy about not having sent in more evidence. I got together what I wanted to send in, attached a copy of the NOA 1 to it and sent it in. Two months later, the petition was approved! Good luck!

Even sent with a copy of the NOA1 and an explanation letter, there is no guarantee they will match them up. Our additional information had both of those attached.

Up to you ...

I called they said they can't guarantee anything. I filed back in March so this is so dissappointing. Im still going to try sending my information as helpless as it maybe. I dont know if Im just going to go back to Nigeria after this and get married.

You're right, they cannot guarantee anything BUT I've read cases where it's matched up, and of course some where it hasn't. I would try and hope for the best, but prepare for the worst.

Right now the possible outcomes are

Just plain ole denial

New stuff catches old and life is good

You get an RFE and send the new stuff again

So it seems like you have a 2 in 3 chance of a favorable outcome.

This will not be over quickly. You will not enjoy this.

An additional step or two to maybe help you along.

1) Hopefully, you have a copy of EVERYTHING you sent.

2) If so, I would probably make an appointment online with your nearest USCIS field office. You don't have to give specifics when you make the appointment. When you get there, show them what you sent initially, and what you sent recently. Make sure you have your affadavits, proofs, intent letters with you. They may take copies, or they may send a notice to the service center that they have seen the proofs and they are on the way. In other words the adjudicator at the service center will be able to see the field office entry for your case, and won't just be looking at the partial information. They can also tell you if there is an RFE or denial you haven'tseen yet.

Good Luck
