    It's not uncommon for families to play nice and treat foreigners like royalty, gaining their trust and knowing that once their son gets into the US, he'll be able to send them more money and possible help get other family members here in the future. It's a very common practice, which is one of the reasons Morocco is considered a high fraud country. 
     
    You know your relationship better than any of us. Maybe it's fraudulent, maybe not. You'll ultimately do what you decide is best, even if it means disregarding the advice you received here today.

    Honestly, this just screams Green Card Marriage to me. My husband is Moroccan and he knows of quite a lot of other Moroccans in the USA who got married just for a green card. Moroccans are such charmers, great sweet talkers lol I met my husband while we both lived in Europe and he moved to the USA just before I moved back to New Zealand. I'm not going to repeat what everyone else is saying, I'm not sure you're really taking in the advice because its not what you want to hear. 
     
    I really wish you all the best and hope you make the right decision for yourself. Just please take the time to go back and read through all the comments here, we're all here to help - even if it does sound a bit harsh at times.

    I agree with some who have posted above me that this stands out as suspicious. I would understand if he said he didn't want to touch/be intimate because that is what his faith commands, but this reason is bizarre...

    The issue is not whether the decree was in the package when she filed.  The issue is whether the woman was "free to marry" when she married the Nigerian.  Divorce is controlled by State Law.  USCIS knows that.  If they ruled she was not free to marry, then they will not recognize the marriage.  They will need to legally marry, then start a spouse visa case.
     
    I know this sounds a bit crazy, but we often see cases where a couple is "too married for a fiance visa and not married enough for a spouse visa".  This is one of those cases.
     
    How to marry in Nigeria when you are already married under Nigeria law, is another matter, about which they will need to inquire in Nigeria.  It could be a "Catch 22".  Google it.

    But you also said that she found out later that her first husband did not sign the papers, that's why she had to do the paperwork on her own in 2015. So when she got 'divorced' and 'married' in 2013, she was still married to her first husband. I don't understand the 30 day thing. The only thing I know is that some states impose the 30 day rule when you apply for your marriage licence. I am trying to understand this because if she was still married in 2013 when she married her now-husband, the issue would be quite different. It wouldn't simply be filing for the CR1/IR1 now, because her current marriage wouldn't be deemed as legal anyway.

    Just for clarification, did she only file for divorce or was the divorce officially finalized before she got remarried?

    She could not have legally being married in 2013, because as she later found out she was not officially divorced at the time of the second marriage.  I suggest she just 'get married" and because that first marriage is null and void....is not recognized.  
    GET married, apply, and send an explanation  at some stage in the process , and prepare to address any other question they may have.  If everything is above board then it just delay not the end.   Good luck to your friend.
     
    A lawyer may just make it smoother too.

    My bigger concern here isn't so much that she thinks that USCIS doesn't see her as married, but that she had committed polygamy. At least from whatever I can see from the story, she wasn't legally divorced when she re-married, am I right? Or am I missing something?

    When we got married 5 years ago, I gathered and scanned documents to my hubby so he could take them to a translator prior to my arrival. Then we brought him the originals when I came. There’s a list of “approved” translators on the Consulate website. I brought as many documents as I could, as some people at the time were asked for one specific set of documents, but were then asked for others. Basically better to be safe than sorry; I brought some that were not necessary, but others had been asked for them. I brought pay stubs and a written letter from my employer. 
     
    I used my my baptism certificate from when I was a baby to show “proof” of religion. You need to set-up an appointment on the Consulate website for the documents you need done there. At the time, I think they were making them about a month out. 
     
    In Salé, one of the places, we were the first people in line. My hubby explained what we were there for, and he was allowed to come in, but we had to wait in separate lines (men & women). 
     
    As as others have said, marrying on the first visit tends to be a red-flag. I may have seen one couple over the years get by with that, but she spent months there with him... The K-3 is, as others have said, mostly obsolete. Maybe 1% (being on the generous side) get processed as such anymore. Others have explained why above. 
     
    My hubby knew a few people that he asked for assistance to move ours through and had let them know prior to my arrival on that trip to help things move along. Be prepared to bribe a person or two (not always necessary). Since you’ll be doing the majority of things in Marrakech (I think that’s what you had said) it should be smoother than in a more rural area. The only person we had to bribe was a clerk so that he would take our file upstairs to the judge... if we hadn’t, it would have taken us longer. 
     
    Best of luck! You’ll have a lot to take in when you arrive. The very first time I went (prior to meeting my hubby) I experienced such culture shock, I still wasn’t thinking straight by the time I got home!  (I was only there 10 days that very first trip)

    Hubby just took his Oath last month. The Naturalization process is basically re-submitting evidence of your marriage and commingling of “life”. I went with him to the interview, but only he was called in for the testing/interview. Hope that helps

    I would recommend the CR-1 over the K-1, personally. The cost is less (overall), there’s not too much difference in wait time, and he would be able to work right away and travel, if need be. With the K-1, there’s the Adjustment of Status needed after the marriage in the US, as well as applying for Advanced Parole & Employment Authorization.

    I believe the instructions are clear enough that you have to have been married in the last three years to the same U.S. citizen and still married at the time of filing and adjudication.  Soon enough she'll be eligible for the five-year rule and you can avoid a lot of the three-year evidence.
     
    I believe you're right that the timing should have been caught before being called in for an interview, but I don't think you're entitled to a refund. Being correctly denied doesn't mean you get the money back.

    You can't tell posters  to "shut it" or not to post. It is against the site's TOS which you agreed to when you signed up.
     
    Also, @pushbrk is a long time member and valuable contributor to the board. He has given countless  professional advice for many years.
     
    Truth is you are in a bad situation because you made poor choices and do not like the responses. Even so the advice you have received so far has been helpful for you to understand the severity of your actions.

    It is your responsibility to be clear.  English, not French is the language used here.  Unless you have  marriage certificate issued by your government, the petition will not be approved.  It sounds like the Consular Officer considered you "too married" for a fiance visa.  At the same time, it is possible to be "not married enough" for a spouse visa.  The US Citizen should not file a petition for spouse until a government issued "Marriage Certificate" is in hand.
     
    The best you can hope for is that a material misrepresentation is NOT noted in your file.  If it is, you will not be joining her in the US anytime soon, if ever.
     
    Lies that seem "expedient" are still lies, and taken very seriously by US Immigration authorities.

    "Read carefully, interpret literally, then answer accurately." has never been more appropriate advice.  Not a lot of thinking going on between those ears.  Did the OP really think married people aren't married anymore if they move to a new country?  The OP had to sign sworn statements before a US Consular Officer to get his  “Certificate of Legal Capacity to Contract Marriage”.  Did he REALLY that meant nothing?
     
    A material misrepresentation was committed more than once by him and at least once in writing and once verbally under oath by her during the interview.  Maybe plan on moving to the Philippines.

    Of course an Imam is allowed to perform a legal marriage.  When he does so for a couple that has no marriage license, then they are not legally and lawfully married.  Many people around the world consider themselves married "in the eyes of God or the Church" when they are not legally married.  Yes, a couple can be "too married" for a fiance visa while not married enough for a spouse visa, BUT, BUT, BUT that is not the issue we are discussing.

    The question is about a past NON "marriage" and whether to list it and document it as a "legal marriage" on an I-130 or other immigration forms.  The answer is clearly NO, NO, NO.

    Far more possibility of HURT than help, in my not so humble opinion.  You do show "marriages".  You do not show, non-marriages.  The relationship in question is not and never was a "marriage".

    USCIS will not shut down.
    Fee based agency (USCIS) as well as agencies that don't require annual appropriations (SS, Medicare & the likes) will continue to operate. The court system (for judicial ceremonies) will continue to operate as they will spend the money collected thru fees & fines to operate until the funds runs out.
     
    There may be a slowdown to USCIS processing as some of the agencies that support them may have a slowdown (as these agencies may divert some of their resources elsewhere). Passport processing will continue but there may be a slowdown - if a passport processing center is located in a federal building that shutdown then that processing site may shutdown too. Also overseas offices that provide visas to foreigners may shut down like they did during the 2013 shutdown.
