    I think this bs thing about giving email,facebook password is when you don't trust in your spouse. A matter of trust is when you have his/her bank account password. ####### your husband cheking your email,facebook and vice versa.It's so wrong and disrespectful for me.If he can't trust in your word In my opinion you are wasting your time with a freaking control guy.Do you have his email, facebook and bank account password?. Calling the cops because he didn't get things in his way it shows his caracters.Unfortunetely he can withdraw his I-864 and you will be without status here.I am not sure if you qualify for Vawa because considering what you posted here i believe your husband is just a freaking control person,besides that I don't see any abuse to support a Vawa claim.

    You must still be able to get married to use a Fiancee visa. IF you get married you would requre a spousal visa and startng all over again. Do not make any wedding plans until the visa is in your hot little hands.

    I think she is desperate to get a green card to stay in US by hook or by crook.
    "she told me she had a marriage set up to help her get her green card but she cancelled it because of our relationship." showed that she would go along with plan if you didn't show up in her life.
    In fact, she did find "a friend of a friend" to get married when you didn't want to jump into her plan of marriage for green card.
    Now she has buyer's remorse, probably hoping you would bail her out which you are now trying to do.
    If she truly loves you (not just for green card purposes), let her clear out her own mess first.
    Then wait and let the relationship develop, take the "getting her a green card to stay" out of the equation, even if it means that she has to return home after her work visa expires.
    You could always petition for her to come back to US as fiancee / spouse later on.
    I was on a work visa too when I met my BF (now husband).
    I never thought of pressuring him to get married asap because "hey honey, my work visa is expiring soon!!!".
    Instead I went home, and developed the relationship over long distance and different zone.
    I hope you don't get manipulated into doing something you might regret later in your life. If in doubts, don't do it.

    Just a guess on my part, but if you go through with this I'm betting we'll see you back here in ~2 years saying she scammed you for a green card and what should I do now?
    All this marrying, divorcing, and marrying again is going to look suspicious as well.

    That is an incredibly sad story. But, it does put alarm bells.
    How sure are you that she really wants to marry you for love? How sure are you about wanting to marry her for love and not because you want to "rescue" her from the problem she is now in?
    Your country's immigration laws were put in place to protect you, too. Remember that once you become the petitioner for someone's visa application, you are liable for anything and everything she does.

    Vanessa is correct. It is current ANNUAL income, not 'currently what you have made to date' income. You list your current annual income as $32k and provide a letter from your employer and recent pay stubs as proof of the $32k a year. If you earned $50k in the first 6 months of the year but are now currently unemployed, your current annual income would be $0, and the $50k you earned earlier in the year will not matter unless you have it all in the bank still to use as an asset. You do not simply add up what you made this year so far. You list your current annualized salary.
    Yes, they can look at someone that is newly employed and ask for a co-sponsor because they have not met the requirement at the time of filing, however, when someone is well over the minimum requirement, the proof of their income via employer letter and pay stubs will usually be enough. This not a future job (job offer) or future income. This is their annual current salary. Current, ongoing income is most important.

    God does not grant visas....and with no meaningful job, she has no reason to depart the US...letters from her 'boss' are totally meaningless...all they would prove is that someone wrote a letter. A new bank account funded by you is not a tie to a country (and said bank account can be emptied as fast as it was opened)...a letter from you outlining some random future plans is also meaningless, for the simple reason that any such letter that may contain some sort of guarantee that no marriage will take place 5 minutes after baggage claim is not enforceable...the overall track record from the PI is abysmal, especially with young, single women who have American boyfriends...the odds of one returning instead of having the ever popular 'mind change' right after customs is somewhere around 1%...and the VOs know this only too well....you'll be far better off starting a K1 application.

    There is no reason a USC should just turn a blind eye to being USED by someone just because it might screw up their future attempts to use someone else. I actually think we should have a sub forum to post details such as pictures of these jerks to help the next victim avoid the pain they will endure if they don't catch on early enough. US citizens are not fodder to be used by foreign person to get into the US. It isn't bad advise to flag them , they need to be banned forever and anyoen caught helping them should also be banned. They deserve to be banned ,destroyed and exposed. In fact I think those that support the abuse of USC's should also be redflagged as questionable immigrants and be denied citizenship as abbetting illegal activity

    When you first reported here about the behavior of your man towards you, I know he wasn't in love with you! I was never afraid to tell you the truth about letting him be... He made you looked like you're the one with all the attitude because he was seeing someone he probably likes better... I told you that God will bless you with someone who would love you for you... And I still maintain that word of faith... If God says your husband is from outside the state then He (God) will bring him home to be with you in the state... When God is in it, it wouldn't matter whether you've filed twice unsuccessfully... My prayer is with you sister... You know if you weren't this lucky enough to do your own background check on this "scammer", he would have been a big ###### for ya shortly after he arrives the state if you know what I mean... He could frame you up and file a VAWA against you so that he could stay legally in the State and live as he want, while denting your personality before the government... Well, I say congratulation! God will heal your heart... Now, to make sure he was stopped him scamming other will not be possible at all... Just make sure he's eradicated in your momery and withdraw your k1 application for him... To be on a safe side ie in case of future petition if any, I would do a detailed statement of my finding and new discovery about him, which was never seen prior to filing the i129f... Ensure the letter gets to the appropriete authorities including the US consulate in Nigeria... He need to be red flagged anyway but you can't be over board with that... Just limit the fight to redeeming your own self from his scam and let God take him from there ok... Wishing you the very best next time...

    You first need to cancel your petition.
    You can send an email to uscis to cancel and then send a hardcopy by mail. Also send an email to the embassy so they can keep it all in his files.
    Send all the facts you know.
    Are you sure she is not lying? Have you verified what she says with him?
    Once you send in the facts that he was using you it should follow him anytime someone else petitions for him but it is no guarentee he will be banned from the usa. Hopefully if he is just using someone the uscis, dos, ICE and whatever other agencies are involved will investigate him thoroughly before approving him.
    You can send emails to all the agencies involved. But cancelling the petition and notifying uscis and the embassy should be effective.

    Tough question...on one hand if it's a legit emergency and you don't help out you're pretty much going to damage the relationship with your new extended family. On the other hand, you can't be expected to be their savior and families in the Philippines are usually very large - you can probably expect to always have an emergency somewhere on the horizon.
    That said, I personally would decline. I have kids from a previous marriage I need to support and with college coming up in a few years I can't afford to give away that large of an amount. But, I would probably offer to help out, for example maybe send $1000-$2000.

    There are lots of other families with similar situations. Sick mother. Sick father. Sick sister.
    There is no way to expedite your brother's case. It would not be fair to all the other families in front of him.
    Everyone wants a better life for his/her family. Every person in front of your brother is waiting to be with his/her family too.
    There is no way to bring your brother over faster than other brothers and sisters who have been waiting longer than him. Be patience because that is all you can do. There is nothing in the law that will make it faster for him. He has to wait in line like every other brother or sister.

    Wow, what a cantankerous attitude.
    Evasive answers usually indicate something untoward.
    You are not traveling in between a continuous stay in the US - you are simply ending one visa and coming back on another visa. In fact, you don't even have the B visa yet. You will get asked all these questions and more about why you want to go back so soon and what you are doing. I don't think it will go the way you want it to.

    I believe that at the time of the petition you must be legally free to marry and should have the final divorce decree attached to the initial petition. So my answer is you have to wait until you have that decree before you can officially start the process.

    Yeah I am just a Nosy Nancy. You turned to a community help forum which means we need to know things about your case in order to advise you. The reason for a denial of entry & deportation has a lot of bearing on how to proceed. If she did the VWP paperwork properly then indeed something must have tipped off CBP when they were questioning her that she shouldn't be allowed in. And for sure they told her why. I know how they operate. I know a guy who even got the reason for his refusal in writing. She was probably just too distraught to pay attention or remember. It happens. You weren't there so you'll never really know what went on. Have her apply for a tourist visa and make sure she follows all the requirements. Your residency in her country will probably help a lot. She will have to disclose her previous denial on the forms obviously. I think your questions have been adequately answered by several people.

    Nobody would expect 2012 taxes to be already filed in January 2013. You may not even receive your W2 until the end of January.

    It has passive RFID in it, not the GPS for God's sake. If also can be surrendered at any time if the owner doesn't like it.
