    Witness statements mean next to nothing.
    Check your chats to see that you don't refer to yourselves in fun as "husband/wife."
    Bear in mind that the consulate can refuse to review evidence that you bring.

    I bought mine because I really wanted to be in the USA for Christmas and I risked a super short gap between interview and flight: Interview was Dec 5th and my flight was Dec 15th.
     
    I made it but I think I aged ten years in those ten days worrying that the passport would not make it back to me in time! 
     
    I think I got my passport back about three days before my flight!

    Worked fine for me as well. Definitely risky, but the Consulate in Rio is notoriously efficient, so that is a plus if all your docs are okay and there are no special circumstances to your case.
     
    Even so, you know what they say: hope for the best, prepare for the worst.

    I bought mine before my interview. It's a risky move, but it saved us about 300 bucks. We also had our wedding venue booked and our whole wedding planned because my family and friends were coming to my wedding (so they wouldn't have to buy last minute tickets). Again, very risky and I don't nedessarily recommend it, but it worked fine for us 😊 Good luck!

    No, the DS-260 is not required. From what I heard, it seemed like the people who had their fiance with them at the interview were asked fewer questions. Also, they did not ask for current information about the relationship, pictures, flights, etc.

    This immigration process needs to take precedent over most everything else at this point - as you are opening yourselves to a lot of extra stress and problems by not applying for AOS at the end of the 90 day period.
     
    Try anything and everything to make it a viable option, just as others have indicated

    You knew you'd have to pay for the adjustment of status. Why did you end up in this situation?
    Would have made so much more sense to have a courthouse wedding, save the $$ for adjustment of status, do a wedding celebration later on. Anyhow, water under the bridge now.
     
    File ASAP. Borrow money if you have to. She can be deported because she has no status once her 90 days run up.

    Hello,
     
    I am in the process of applying for a K-1 visa for my fiancee.  I recently received NOA2 and we are waiting on the transition to the NVC.
     
    My fiancee was pregnant when I filed the application, and didn't know it.  She just gave birth.  I know for a fact that the baby is not biologically mine; that is not something that matters to me and I intend to proceed.

    I have used a university-associated agency to help me with the process, who was the preparer of my I-129F.  They have told me they encountered a situation like this once before and that this did not delay the process much --- if at all --- and in this case the baby was already born when the application occurred.  Essentially, editing the I-129F form or resubmitting it was not necessary, and the interview was not delayed, and it was successful, even in adding the child.
     
    They basically said that the new baby can be added as a derivative during the NVC process in my circumstances.  I don't know precisely what that means but I can infer.
     
    Does that ring true?  Are there any steps I can take to minimize disruptions to the process?

    If you filing out the i129f, I don't think they care how much you make. You don't have to start to prove anything until the ds160 after the i129f is approved. And if it looks fishy, to the embassy during the interview.
     
    If you go a lot of money like that, just hire an attorney that can help you gather the evidence of your wealth. But I assume you got over 100k
     
    Edit: I half read and see you got a joint sponsor. Just tell the truth. When you do the affidavit of support, grandma money will be on there as evidence.

    Co's can seem tough but they have guidelines 
    it isn't to keep couples apart
    they look act a lot of issues
     how many K1's a petitioner has done for several reasons which include protecting both parties
    they look at the Number of divorces
    they look at the age difference 
    they look at income
    they look at how well 2 people know each other in real life
    they look at drug use
    they look at communicable diseases
    and other issues
     
    our case took 6 years from a denied K1 in 2009 to approved spouse visa in 2015
    was i upset? yeah,  but i know the CO was concerned for our age difference /
    all i can say is i am one of the lucky ones who was fortunate enough to last immigration process and not give up (many do) and to still be married to a decent man after 13 years
     
    there are others like a VJ member who fought a NOIR and got her man here //  he left her within a month for his "real" gf in Atlanta /he just used his wife for a green card

    This is coming off a lawyer's website where it benefits them to scare people into thinking that they need professional help to get through the "tough & unforgiving" visa process. I think the reality is that the amount of denials have a lot of different & legitimate reasons that go beyond what is listed on the lawyer's website. A lot of which are simply subjective. There is no verifiable way to quantify or prove love or that someone's relationship is genuine. I think the reality is that it all comes down to a ####### shoot as to who you get to review your case file when it is your turn...how is that case officer feeling that day, what is going on in their life, etc. The same deal goes with the interviewer at the embassy. In our October 2021 Facebook group for K1 filers...and granted it is a small sample size...out of the 3619 applications in the group, only 257 were denied. I am not going to bother looking into the various reasons why they were denied...but I am sure that it wasn't solely due to "proving the validity" of the relationship type of reasons.
     
    I think the bottom line is that everyone's relationship is different & everyone has a different style of expressing their love for one another. The only thing you can do in a very subjective process like this is to meet all of the objective requirements (meeting within 2 years of applying, filling out the forms accurately, being eligible for marriage, etc.) and then do your best to provide as much evidence as you can for the subjective things (i.e., screenshots of chat, video calls, pictures of you together, etc.). It's pretty sad that people can be denied to be with someone they want to be with simply because they are from another country. We have whackos in our country marrying objects, animals, even themselves...and all of this is OK. What a world

    I wrote my congressman with detailed information about what is going on with people not getting their cases seen at USCIS. The response from one of their workers:
     
    "Thank you for contacting our office in regards to your immigration concerns. The documents you provided do not come from a .gov website and I would not hold any high hopes when interpreting information from those sources. To that end, all of the information you will receive from our office will either be from a .gov website or from the agency themselves.
    Your case was received on November 7th, 2022. As of right now USCIS is processing I-129F’s, like yours, at the California Service Center within an estimated processing time of 15 months (February 7th, 2024). I have included USCIS’s expedite criteria below, if you feel as if you case meets one of the criteria below please attach documentation/evidence to a reply to this email in order to justify the criteria. What I would ultimately suggest doing is to contact our office around that February date and we can more suitable contact USCIS with a stronger argument to finish adjudicating the case. I will wait for your reply before closing anything on our end. Please advise.
    If you have any questions please let me know."
     
    🙄🙄🙄🙄🙄 So "we may not believe you, but call us back next month if you still have the same issue"

    Everyone’s circumstances are different and I dare say unique, so there is no fool proof way to go about it. Recommendations what is better, etc, yes, but again everyone’s story is their own, and as long as you are ready to lay it out, explain it ( if necessary) you’ll be just fine. You met the minimum requirement for one meeting in two years. I wish you the best of luck and to succeed.

    I wanted to address the negative attitudes we have seen on the rise recently in the upper/ immigration forums towards those who ask beginner/ simple questions, or have unusually fast or slow VisaJourneys.

    First, there is a tone difference between the Progress forums- which are mostly for support and cheerleading, and the Info forums, which are mostly to have questions answered.   While all our forums are supposed to be welcoming to all and friendly, this is especially important in the Progress forums, which are not to discuss politics, or be negative towards  those fortunate to have their case dealt with quickly, or  critical of those who voice sadness about their own slow progress. These forums are there to uplift eachother!

    Secondly- in the info forums, you may get bad news.  When a question is asked, our members are encouraged to answer truthfully, even if this may not be what the Op wants to hear, because it is important to be informed.  However, the emphasis is still on being welcoming and friendly.  If you need to give bad news, do so gently, and stick to facts; constructive criticism of the Op's plans ARE allowed, but the emphasis is on constructive.  No need to dwell on mistakes (or tell members they should be on 90 Day Fiance- that is a personal attack and automatic suspension), or  illegal actions in the past- instead, encourage and explain legal options for the future.  And ONLY legal options- as per our TOS, VJ does not support, condone or encourage illegal (immigration) actions, and such posts will be removed.

    Ultimately, we are here to help all members, old and new, easy cases and complicated, those who write a fact filled bullet point post and those who are panicking and don't make much sense in their first post. Yes, sometimes questions can be easily googled, or answered via a search of our forums.  But if you feel that way, just scroll past- no need to criticise the OP for asking the question.
