So, a very strange interview.  My wife, daughter and I went to her N-400 interview.  When we arrived we presented her appointment letter and I explained that we anticipated a combo interview for I-751 and N-400.  The first guy had no idea what we were talking about but the other guy overheard and said to let us all go in.  After 30 minutes or so the interviewer called her.  I went up with her and asked if the files were there and could we get a combo interview.  He said yes, he had the files, but he could adjudicate the I-751 and N-400 with my wife only.  They didn't need me.  I asked again and he said I wasn't needed.  So, my daughter and I just sat in the waiting room.  Twenty minutes later she came out and the interviewer told me that she passed.  I asked him if that meant the N-400 or the I-751 and he said both.  I was a bit worried because I put together the packet and knew where everything was.  He indicated that he needed to check a few things and watch the USICS site for her oath appointment letter.  She later told me he asked her if she had any additional documents to submit.  She didn't know what submit meant when he said documents since we filed I-751.  Finally she figured out what he wanted and showed him copies of the bank statements and last IRS filing report.  He glanced at them, didn't ask for any copies and said she was fine.  He asked her about employment.  She said she was a stay-at home mom.  He asked how old her daughter was.  When she said 17 he asked why she needed to be a stay-at-home mom for a 17 year old.  She laughed and said "I have an 8 month old baby."  We had uploaded his birth certificate with the N-400 but it was after we submitted the I-751 so he must have just glossed over the files.  Just a bit strange all around but at least we are done!

Because in 20 years when you are not around and they don't renew their passport it might be extremely hard to gather all the paperwork needed to get approved again. It's not like a native born that just needs a birth certificate.

Here's an update for you guys.

I applied for Kid1 and Kid2's certificates on March 31 so I could avoid the fee increase.  Both kids already have their US passports, applied for and received in December.

My original concern was that their father and I don't have a court ordered custody agreement.  Further research indicated that if the jurisdiction that our parenting agreement was written in doesn't require it to be court ordered and we can demonstrate that, then it would be accepted with a letter of explanation.  I included that Letter of Explanation as well as an Affidavit of Support from their father and it was accepted.  I suspect him having already signed the DS-3053 for their passports helped, as well.

Both kids had to go for biometrics, even though Kid1 had them done within the last 3 years when they turned 14.  Kid2 isn't yet 14, so it was a bit of a waste of time because all they did was take a photograph, no fingerprints.

Applications were approved April 26th.  Notices of Oath Ceremony issued on May 2.  Oath Ceremony is May 17th for both.  Kid2 will turn 14 a week before the ceremony so will be required to participate.

The kids' USCIS accounts originally indicated 6 months for a decision to be made.  Considering how quickly N-400's have been flying through here, I anticipated their N-600's to follow a similar timeline and assumed it would be much less than 6mo.  My assumption was correct.

So, after May 17, or 5 years, 11 months and 6 days, we will FINALLY be finished with USCIS.

@springguy If you haven't applied for your kiddos yet, this info might be of interest.

I think to change your name on your official documents like SSN you just need your birth certificate and divorce paperwork.

Not true at all. People cross the border all the time without a passport. Heck you can take cruises with just a birth certificate. And yes there is a Supreme Court decision that states US Citizens have an absolute right to return to the country.

Interview is this Friday! I'm so nervous; I feel like my heart could drop out of my chest at any moment. I'm also reconsidering the name change I wrote in my application. Anyone know when it might be a good time to ask during the interview how long it might delay the oath ceremony?

If you read the full case you would notice that the case was never approved. The OP has been approved.  It also specifically states that the person couldn't appeal but they could file another N-600 "[D]enial due to abandonment does not preclude the filing of a new application or petition with a new fee[.]

A better example for the current OP's situation is this case. The person failed to appear 4 times after his approval and then claimed that the taking of the oath wasn't needed. They determined that he must take the oath and in the future if he changed his mind and wanted to take the oath he could file another motion and reopen the case.  https://www.uscis.gov/sites/default/files/err/E2 - Applications for Certification of Citizenship/Decisions_Issued_in_2023/OCT102023_01E2309.pdf

"This dismissal is without prejudice to filing a motion to reopen this Form N-600 should the Applicant become available
to attend an oath of allegiance ceremony."

You may have waited too long. Just looking at the average processing time it was 23 months. You may want to contact a congressman after filing to speed up the process. It has to be approved before they are 18.

Just make sure you go over with your attorney all of the facts again to be double sure the child qualifies since you have had issues with the state department. USCIS if they feel the facts don't support citizenship can tell the state department to cancel their passport.

Paul Hanaki got a reaction from OldUser in Is filing N-600 really necessary?
It's not it. There is zero limit and no deadline on the number of motions to reconsider a case. (You are confusing it with an appeal) You also do not need an attorney. The process is pretty simple.  Filing fees for a N-600 is going up to 1,300 in 2024. A motion to reopen is still cheaper than it would be to file another N-600. Not sure why you are giving advice that is not correct.  It is not "One Shot" you have as many shots as you need to get the needed information to immigration.

I did an inquiry online last week and just got a generic response "Our records show that your N-600, Application for Certificate of Citizenship, is currently pending adjudication. We regret that we are unable to provide you with a completion date at this time. Once a decision is made you will be contacted. We apologize for the delay."  If I were you I would try calling your US Senate office and see if they can help.

Not exactly correct. Airlines will not allow you to board if your passport expires within 6 months for some countries and 3 months for others and you may have to have. a return flight scheduled before your passport expires in other countries.

Some government jobs with certain security levels require the N-600. Someone has posted about that before. . Also your passport can't be expired to be used as identification. In certain cases even though the person had a passport they were ruled not to be citizens due to the passport being issued in error. I have not found any case that has happened with a N-600,

Passports are issued by the state department. N600 is issued by immigration. The N600 is better proof of citizenship plus the kid doesn't need to keep renewing the passport.

I'm sure there are lots of people waiting on the N-600. In my area it was supposed to take just 3 1/2 months but it has been 7 months already. One daughter they reused her biometrics but the other we had to have new one done.

You just file an I-290B. That is a motion to re-open or reconsider your case.. Yes it costs about $700 but that is half as much if they allowed you to file a N600 again.

Paul Hanaki got a reaction from Mike E in N600- no green card yet
People misunderstand this all the time. You can only file an N-600 once but if it is denied you can file an appeal within 30 day or file a I-290B after 30 days. You can present all the evidence you didn't include in the N-600. It is not a one shot and you are done situation.

Paul Hanaki got a reaction from Mike E in Wife wants to divorce while pending i-751
Not sure how you are getting that information. There is zero requirement to notify the USCIS of any divorce being filed. So it would be great if they approved him before the divorce was final. Only if a divorce is final do you have to notify the USCIS that you are modifying your. 751 to ask for a divorce waiver.  His attorney has stated the same thing.

Did you not even read the memo. It is an 87 day extension for people that file a 751 for a divorce waiver without a divorce. A final decree can take a month or it can take a year depending on the area. So after 87 days it is denied.  Once again though USCIS does not want you to file a waiver without a final decree. If they did then they would state that in the instructions.

If they are approved without an interview before a final decree then they get their 10 year green card. I am so confused as to why you think the filing of a divorce is the same thing as getting a divorce. Heck people change their mind all the time and she could withdraw the petition for divorce.  if he is approved after the divorce is final and before.changing his 751 and requesting a waiver he should immediately contact USISC and put in the correct paperwork as that green card isn''t valid.

Yes specifically in the memo it says the waiver will be denied because they are not divorced. That memo is telling people do not file a waiver unless you are actually divorced as there is nothing USICS can do with it. There are only waivers for people that are divorced not people who have started divorce procedures. All you will do is cause them to send you an RFE asking for a decree you don't have. The best course of action is to wait for the divorce to be final and then immediately notify USCIS and request a waiver.  It is amazing all the bad advice on this topic. Good thing the person has an attorney who instructed them correctly.

For one he has already filed I-751. Second no one has suggested he lie to USCIS about the pending divorce. If he has an interview he should bring his still spouse and be honest that they are in divorce procedures. You are reading all the information you have posted wrong.
