    From your first post, it seems like you have no intention to work it out, only to leave her as she is not working (only few weeks? sucks to be her dude). I have to question why people get married?.
     
    This is one of the reasons why Uscis works hard to weed out fraud in the system, yet everyone say USCIS is incompetent while processing applications. Between Oct and Jan was only 3 months and you have decided to forgo the marriage and think of marrying again. Your intentions are clear as sun rises in the east.
     
     
    You should divorce her, pay her alimony, trash your credit as housing market is in the dumps and you are on the hook for the mortgage while she has no job. Her credit will be ruined and so will be yours as creditors will hound you for the payment. if you have kids, then its whole different ball game.

    I think all you need to show is that you got a payment plan with IRS and if you show payments that is very good.

    A point I have not seen mentioned:
     
    You will be expected to provide for her for quite some time; the exact duration is based on your state.
     
    If you divorce now, your house is pretty much gone, and your income is shot for a long while.
     
    I recommend counseling and staying together.
     
    Go find some Internet forums from recently divorced men who share what happens after the process.
     
    I don't think you'd like it.

    I have to concur with @Mike E, DUI's are usually frowned upon and should consult a lawyer, just to be on safe side. Good Moral Character is what this goes under....

    And when I always call out things like this immediately, some people say I am negative.
     
    OP stayed so as to get citizenship under 3 year rule and now wants to marry or bring from his own country/ probably wants to bring the real wife from Senegal. 
    Well, if you and the Senegalese lady had kids whom you didn't mention while under your USC petition, kiss that ship goodbye. The will never immigrate under you nor your real wife.

    I’m sorry to call this what it is. You actually used her. For you to just want to leave the marriage after a year of having your citizenship and making more money, and for you to already be asking about a new wife and immigration for the new future spouse, you already had everything planned out.

    The answer to your question is yes, you are free to divorce and move on with your life and petition whoever you want with no consequence to yourself.
    If you can’t support your wife now, you’re not enough of a man to petition for the next one.  So no loss to her either.  You want to petition and support an immigrant you better prepare yourself to go all in on it.  Like your wife probably did for you.  
    Welcome to America and get ready for the alimony payments after you file LOL.  Supporting both is going to be a hard lesson 😂 and some of us have been there and done that.
    Since this is about money look up the phrase “it’s cheaper to keep her” and start a dissertation on it. Any of you ladies offended by that accept my apologies.

    I would think my case is pretty straight forward. I filed based on the five year rule and have no other pending cases so hopefully I'll have an interview scheduled soon.

    Questions asked (Civics test):
    - Who does the senator represent
    - Who is the commander in chief of the military
    - The federalist papers supported the passage of the US Constitution. Name one of the writers
    - Name 1 right from the 1st amendment
    - Which are the 2 political parties in US
    - Name the first US president.
     
    Reading: Who can vote?
    Writing: Citizens can vote. 
     
    Officer asked her sections from N400 (Part 12, 45-50). Asked her about family, address, work, children etc. Asked her to confirm information is accurate and capture the signatures. She was given an option to do same day oath in the afternoon and she took it. 
     
    Timeline:

    Well you said it was for naturalization, which is different from AOS.   
     
    12 days is not a lot, particularly since there were some holidays and non-business days in there.
     
    And yes, as the petitioner, the case is your husband's, so he should be the one to inquire with USCIS.

    Based on the above article, I suspect they do once or twice a month with everyone lined up for the oath ceremony.

    It’s only needed if you are applying based on 3+ years after marriage to a US citizen. If you have a green card and is 5+ years and you are applying  based on that, then there’s no requirement for pics. I believe they do ask for marriage certificate.
