  1. The only thing they need to prove, is that they have sufficient funds to support their trip and that they have strong ties to their home country. Good luck to them, i hope they get the visa! And congratulations on your degree ☺️
  2. This isn’t grounds for a denial. When it comes to mental health, they will put you under Class A or B (or no class at all). Class A: Current harmful behaviour towards yourself or others OR past harmful behaviour towards yourself or others that is LIKELY to occur. Class B: Past harmful behaviour towards yourself or others that is UNLIKELY to occur OR a current mental health disorder without any associated harmful behaviour. Only a class A will make you inadmissible. I’ver never heard of people with mental health difficulties being denied because of mental health issues though. Sorry for the long (and maybe irrelevant) extra information, but hopefully it helped you or anyone else that is wondering ☺️

  8. Judging from your previous posts about all of your travel plans and the fact you want a B2 so you can stay longer…. You’re skating on thin ice here and if you do get the B2, be prepared for scrutiny from CBP.

  10. You can adjust status with i130/i130A and I485...The I485 is what will give you authorized status whilst it is processing.
  11. They might cancel your ESTA if you are denied a B2… I honestly wouldn’t risk it.
  12. Sadly the processing times have gone up for both K1 and CR1. It is going to take over a year to get either one, but thankfully the NVC-visa in hand wait time is going down which is great! Try to avoid checking your emails every day, prepare documentation for the NVC stage, interview and enjoy the time you have in your home country before you leave Best of luck!

  16. Did she overstay her previous ESTA? You cannot appeal an ESTA denial unfortunately, so your partner will have to try a B2 visa…. But i doubt she will get one. Try getting a refund on your flight and you should go and visit her. Realistically, she will have to apply for a fiance or spouse visa in the future.
  17. You can come to USA, get married and leave before the 90 days. Whilst you are in the USA, you can gather all the documentation together and send it off. I have a suggestion (and of course you dont have to do this), but would could do marriage online via Utah, meet in person sooner and then file if you want to start the process sooner. Either way, congratulations and good luck to you both
  18. You cannot enter with the US with the intent to stay permanently, that is fraud and you can get your ESTA taken away. The best thing for your situation is a spouse visa. You these options; Married online via Utah-Meet up in person-File Meet up in person-Marry-file. If your job is affecting your mental health, then i would leave but also make sure you will be financially okay until you get another job. Also if you quit your job and then go to the US soon after for two months, CBP may ask about it and they may deny you entry as some officers may think you have immigration intent...which you have already shown from what i am understanding. Spouse visa will take some time, but it will be worth it in the end! Best of luck to you
  19. Divorce and then married to another USC shortly after... and overstaying a tourist visa....hm. Overstays are forgiven if you're the spouse of a USC, however with everything else in mind, you will probably face scrutany from USCIS.
