    Nothing received in the mail yet, but I checked my receipt online and today it says approved.

    It's a divorce waiver too, so by time I finally get my interview, it'll be around 3 and half years since my divorce was finalized. Should make for an interesting line of questing.

    Some I-751 petitions take years to get approved. No wonder you have this question.
     
    After filing I-751, few weeks later (2-6 weeks) you will receive a I-797 form, aka "extension letter". It will extend the green card by 48 months.
    You can reenter the US with it, but need to have it with you as well as expired green card.
     
    It's best to travel to Europe via big hubs such as Paris CDG. They'd know how to deal with it. Also big US airlines such is United can help eliminating issues.

    Yeah but my case is kind of unique. Yes, I never had an interview for my AOS, because my local field office had closed due to COVID. However, they did mail me a letter from the local FO requesting for the evidence that I was going to submit in my interview. So maybe in their system I count as an interviewee for AOS. Who knows.

    We were married about a year before my husband did POE. But we'd been in a relationship for about 4 years before we got married, and we lived together in his country (with both our names on the lease) for 2 of those years. Not sure if all that is relevant--just providing some additional context in case it's helpful. 😊

    I'm sorry you are going through this. I understand how this can worry anybody.
     
    When the IO separates the couple it's called a "stokes" interview. In that case the IO might have some "red flags" about your bona fide marriage/case.
     
    How was your I-751 package? What documents did you include to proof your bona fide marriage?
     
    How did the interview with the IO end? The IO didn't say anything at all?
     
    What type of questions did the IO ask and which answers didn't match?
     
    Which Visa-Category are/were you and when did you came to the US?
     
    Do you mind sharing your timeline?
     
    Nevertheless, if your marriage is bona fide, you have nothing to worry about and hopefully all will be good at the end.

    It hasn't really. The denial letters are on shaky legal ground and not really factual. You remain a LPR until an immigration judge says so.
     
     
    You need to act quickly. Sitting around for a week does you no favours.
     
    An I-290B has a VERY narrow set of criteria, and is not an appeal. It has to be based on incorrect application of the law or policy (which you must prove, citing the specific law/policies they have broken), or evidence that was not considered at the time that would possibly have changed the outcome. It is NOT an appeal.
    A new I-751 is the sensible thing to do here, as in all probability will not rule in favour of your I-290B and re-open.

    So, now you have two issues to overcome.
    Firstly, simply filing a new I-751 with exactly the same evidence will likely produce the same result in a few years - another denial. 
    You need to find every single shred of evidence you can muster. Documents, photos, bills, emails, texts, mail, affidavits from people who knew you. Anything and everything that shows a life and marriage, good and bad. 
    No matter how insignificant it may seem, just throw it ALL in. Now. Your refiling needs to be substantial and thorough. 
     
    You also now have the fraud accusation to overcome, which is a bigger hurdle, and unfortunately will prejudice the adjudication of future I-751s (as I found out), which is why the filing needs to be substantial.
    Did your ex spouse say something to them, in the way only a spurned spouse can? Because they are a US citizen, they generally believe them without confronting you or giving an opportunity to answer any accusations (even though legally they are required to. This could be your possible basis for an I-290B ) . It sucks but it is the reality. 
    You have an uphill battle.
     
     
    An I-290B is unlikely to do much other than waste money. It heeds you to file a new I-751 as soon as possible while it is in the 'hold' period (30 or 45 days). If you file quickly, it may avoid an NTA later down the line.

    I had mine today (and I was approved). My husband came with me to the office but was not allowed into the room.
    He waited in the lobby.
     
    I had brought everything and the kitchen sink with me. They only asked for: green card, drivers license and original passport that I used to enter the country.

    Just that they were familiar with our case and asked very specific things. They were familiar that my husband is not employed while I’m working as a travel nurse. They brought up that I traveled to Canada by myself while I worked in Maine.

    Got notice today, new card is being produced. 
    This is cross posted on the citizenship forum. But this is our experience. 

    In June 22nd, two immigration officers showed up at the house. 
    Our living situation is unusual, so we think they wanted to verify a few things. It was a coincidence we were even at the house, yet alone even in the state. 
    I’m a travel nurse and we use my parents’ house as our permanent address and tax home. It’s been that way since we got married. It’s where we keep all our things other than the clothes we take while I’m working elsewhere. My husband (the applicant) travels with me always. He’s with me wherever my work assignment is (typically 13 weeks). We wrote up an explanation of this in our original ROC packet and N400. We have a signed document by my parents that we pay rent and it’s our permanent address which was also included in both packets. 
    They asked for our IDs, took pictures of them with us holding them, asked if we had pictures of us together around the house (fortunately we have them and my parents display them), asked about work. They clearly read up on us and were very familiar with our file. The whole interaction wasprobably less than 5 minutes. They practically ran awaywhile saying, “you’ll be contacted for your civics exam soonand the 751 and 400 will be processed at the same time.”

    Can't deny how pleasantly surprised I am to get scheduled when processing times are around 10 months in my area. No movement on my I-751 but hoping for a combo interview.

    Hi, 
     
    I've been married for 3 years to a US citizen. I adjusted status from an F-1 visa. I got my conditional green card and have since applied for removal of conditions, which I'm waiting for now. I'm eligible to apply for citizenship in February 2024 if I stay married.
    I love my husband very very much, but we have some potentially irreconcilable differences that have me thinking of divorce more often than I would like to. We've gone to couple's therapy (but he has all the receipts), I've gone to therapy specifically to discuss whether to get a divorce about a year ago, and I decided to stay. A year later, I still think of divorce frequently, but I'm afraid of the implications for immigration. 
    My husband has visited my home country once, and my parents have visited us here in the U.S. once. I'm close with his family and he's reasonably close with my cousin who also lives in the U.S. (we have pictures and airfare tickets to support all of this). 
    Other than adding the two years for citizenship eligibility, what are my risks here? He's been known for some "petty revenge" (never against me) in the past, so I'm afraid he could do something to negatively affect my status. Does he have any recourse?
    If I want legal advice, do I go to an immigration attorney or to a divorce attorney? How do I find an attorney that specializes on both things?
    I'd love to get a no-fault divorce due to irreconcilable differences but he's not open to discussing divorce as a real option right now -- I've mentioned it a few times and he just shuts down. 
    What do I do? There's been no violence or cheating involved (thank goodness), just good old "we're too different and we fight too much and I'm unhappy about my marriage and feel like I've tried everything else already."

    Agreed. File and get him served with divorce papers. Your green card will survive no matter if it ends up a quick default ( he does not respond by choice) or a drawn out contested “ vengeful” affair.
    You are not under any obligation to notify USCIS until divorce is final…or you are face to face at an interview for the N-400 .

    Hire family law attorney for divorce and immigration lawyer for this if you cannot DIY..not clear what your topic question was, nut hope this helps

    @MyNameIsEarl I‘m sorry all of this happened to your friend. I can’t imagine the stress he must going through. Never the less. When people get nervous, oftentimes they just forgot. It’s human. We are no machines. I do believe in honesty. As Long as your friend and his USC-Wife are honest and got married in good faith and they have evidence together. He has nothing to fear. But yes, I had no idea either, but a stokes interview is usually not a good sign. Does your friend have strong evidence of their bona fide marriage or absolutely nothing? Do you know?
