She visited 2019 and 2020.. Wanted to visit in 2021 but covid-19 travel ban/restrictions impeded her. I explained everything to the CO...

    2016

This is the reason for the denial, I have 21 years age different from my wife and was approved on the spot. I think when the CO asked me when did I see my wife and I answered last 2 months and how many times we have seen and I said 4 times. I guess that was the end of the interview and he approved me. There is no way couple who are dating(fiancé) can see each other during covid and married couple can’t  visit each other. I hope everything is resolved now.

I don't think this prefix is correct. because my priority date is July 15, 2022 and mine is IOE9842. if this is the case then that means mine is far far out. and I'm a US citizen filing I-130. idk if anyone back in February got a message that said due to covid 19 there are back logs and they are mixing the back logs in with everyone else's applications. which is resulting in a longer timeline.

USCIS receive more than 15,000 cases every week. If your Prefix is IOE098, then your case is far out on the end of July, perhaps one of the days in the last week of July. And that’s doesn’t make my assertions wrong coz I’m tracking cases. USCIS approves more than 2,000 I-130 cases a day and they touch cases randomly too. But right now, most of the cases being approved at the moment are IOE09167-68, 69. Check your receipt No. I think you meant to say IOE0918 and not 098.

Thanks. But now looks like these IOE numbers are not in order as per I-130 petition filed dates, as mine is IOE9460XXXXXX with I-130 NOA1 date of 17th January 2023. Can anyone explain the IOE number sequence for I-130?

They’re approving cases mostly with prefixes IOE09167 and IOE09168. Definitely by next month, they’ll move to IOE09169 and dusting off rest of cases with prefix IOE09168. These prefixes are all June-July 2022 cases.

As I said, I chose to be safe than sorry. As you also saw in this thread, COs are different. Everyone has a choice they are free to make - I chose to get a certificate because it was not a hassle in my case. Others can choose to not obtain it and that’s fine.

As a note, the consulate did not list I-134 as a document to bring, yet they asked me for it at the interview and I had it with me along with supporting docs. I rather have a document and not be asked for it than not have it and be asked for it.

I already addressed it above and I will not do so again now. FYI not every procedure to get a police certificate is difficult. Sometimes it is not that difficult.

I understand where you’re going about playing safe, that’s thoughtful. And official website said “if you haven’t stayed in another country for more than 12 months, you don’t need it”

if its easy for her to get the police clearance, she should go ahead but if it’s not, she clearly don’t need it.

The section you have quoted regarding 6 months in another country is qualified by the requirement that you are currently living in that country. I read that section to say that …. 8 months previously residing in Czech R but NOW residing in France and a French national .. she does not need a police certificate.  from CR. She does require one from France

    I may be wrong !!

    You’re spot on.

Why do you believe she doesn’t need them? The table (which is from an official source upon which NVC and consulates rely on) says if you lived  in a country for more than 6 months and she has lived in Czech Republic for 8 months

With what I read from the post. The 3rd row is exactly what is applicable in this situation. And I repeat, if she didn’t stay more than 12 months. Don’t bother getting the police clearance because you don’t need it. It’s very expensive, time consuming and exhausting. It will make you stay longer in NVC stage and finally during interview when embassy sends an email, you’ll realized that you wasted your time getting it.

I agree, ultimate decision is with the CO. I believe back in my K1 process it did say 6 months which made me get the police certificate for a country I used to live in, I was trying my best to avoid any possible delays.

If you actually did K1 and received email from the embassy, they will categorically tell you exactly the police clearance you should get. And on the email, it says the applicant should get police clearance from another country he/she have stayed more than 12 months. Unless your embassy didn’t explain well. I took the Ghana police clearance to the interview, they ask how long I stayed and I replied 8 months and they didn’t take it. Only collected the Nigeria police clearance.

  8. You don’t need police clearance if you lived in another country not more than 12 month. So I don’t think your spouse need it. Spent a lot of money getting police clearance in Ghana and found out they don’t even need it 😭 . Got my visa without the police clearance. The embassy will also make this clear to you in the emails they sent before interview. So don’t waste that time and money getting police clearance if your spouse didn’t stay more than 12 months there. I’m happy I could help.

My 601 waiver was approved on April 26, 2022 so it’s been 12 days and the CEAC case status has not yet been updated and no instructions received from Montreal.  How long does it normally take to hear from the consulate about next steps? Should I email them or send an inquiry form to make sure they got it?

Have you heard anything from the embassy yet?

How would the luggage of a detained traveller be able to be picked up?  That makes no sense.  They would never separate the luggage from someone they intend to deport/deny admission to.

I think this thread is getting derailed. Whether he put his baggage on the next flight personally or someone else did or not is immaterial. We have already alerted OP that some of the things don’t sound right and it could be a scam. She’s received calls from border patrol which convinces her it’s not a scam. We should accept that part.

I think going forward postings should be focused on helping her with this ban etc, not questioning those extraneous inconsistencies about whether yhe said fake marriage or fake engagement etc. It couldn’t be a fake marriage because there’s no marriage.

OP, my understanding is your phone calls and senator and attorney can do absolutely nothing to revive the k1. It is totally dead. Next thing is to FOIA to make sure you know exactly what went on, go visit and marry him if you still want to continue, apply for Cr1 with a ban waiver and wait.

Nothing more to add really. Namaste and good luck.

It’s crazy how people neglect the call for help and start saying rubbish that doesn’t make sense and still want OP to answer their stupid questions. She asked for help, and you guys are making her regret asking for help here. That’s why I won’t ask for help in this platform anymore. They act like they care but make fun of your problem, say and leave without giving a single help.

  11. Announcement!!!.

if you’re born from 1992 upwards, you don’t need attestation of Birth certificate for your interview because CO can verify your age with the NPC certificate number on your birth certificate issued by NPC(National Population Commission). You only need attestation of Birth Certificate if you’re born from 1991 downwards. I didn’t know about this till I was told at the embassy by the Nigerians that I don’t need it but I came with my attestation.

    Goodluck!!!

They are now asking for the attestation of birth.

Yeah. If you’re born before 1992, you need an Attestation of birth, my fiancée advised me to put it on here after my interview but it skipped my mind. People born from 1992 upwards don’t need attestation of BC but 1991 downwards needs attestation of age. I am in that 1992 bracket and I brought my attestation of BC and they said it’s not required for me. Also I get to understand people born 1992 upwards don’t have any issues with the doubt about age by the consular officers.
