    Your visa expiry is tied up to your medical expiration, so whatever the expiration of the medical is the validity of your visa.

    With a lot of pleading during my CFO tele-counseling.  I do NOT recommend it.  It was stressful.  Also, it helped immensely that I already visited my spouse in the US multiple times (I had a B1/B2 visa before getting my IR1), and that we were married in a traditional ceremony in the US, not through Utah zoom wedding.

    Apart from the naturalization issue, forget about ever sponsoring somebody else to immigrate to the US.

    Absolutely they can be refused entry assuming they get the visa.

    F2b Philippines complications I have seen have mainly been where the person has married, and forgets to mention that. Really the same deal.

    I would put it one beyond Misrepresentation.
     
    The person had no basis to acquire a Immigrant Visa.

    I have heard multiple cases in Vietnam got denied because divorced and then re married the same person.
     
     
    Lets not talking about visa thing and ask ourselves: How many percent of people will remarry the same person in real life after divorced ? It is really rare so IO wont believe it.

    It won't be scheduled until the date is current in Table A of the VB, and it's not current yet.
     
    I'm also not sure what you mean about the tourist visa, but the final action date was 22nd March 2007 in the September 2021 VB and is now 22nd April 2007, so it's only moved a month in nearly 2 years - it could still be a very long wait before they get an interview date.

    This is not about immigration but taking marriage seriously: online infatuation is nice but having actual interaction with someone and getting to know them in real life is necessary in order to know if that is the person you want to spend the rest of your life with.

    He could have filed for missing person report if this was the case. He seems more concerned about blocking the account vs her safety and well being(especially she is pregnant with his kid).

    This is really sad and disheartening situation,  from previous posts from OP this lady had so much red flags but the OP still decided to pursue with the  visa process and now he is stuck in this situation that could potentially land him in "criminal charges(DV)" and more mess in his hands. This is a BIG "WE TOLD YOU SO" type of situation. We hope that this resolves in his favor and will serve as a big lesson for him and others who will be in the same boat in the future, 
          As a Filipina myself people like this give us decent Pinays a bad name and reputation, I hope she does the right thing and just go home and resolve this with no further complications for her and the OP.

    No, there's no self-petition for an orphan. 204(l) doesn't apply either because that requires the beneficiary to have lived in US at the time of the petitioner's death.

    Field offices do take certain applications so it's not a complete no-go. Don't get me wrong I'm super surprised too about how this story evolves but it's pretty interesting.

    Sibling is what I call a "second-degree relationship". Basically you are related because you share at a common parent-child relationship to the same parent, so it's you->parent(s)->sibling. You cut one of those connections and you're no longer legally related.
     
    AFM 21.9(c)(1)(A) says "...Therefore, officers should carefully review the supporting documents to ensure that both the petitioner and beneficiary have a parent-child relationship with the claimed common parent(s), as defined at INA 101 (b)(1)-(2).". INA 101(b)(1-2) is a long list of what qualifies as a child for immigration purposes.
     
    Going further
    Policy Manual Chapter 4.B. says adoption severs the legal link between parent and child.
    Siblings don't have any direct link to each other, it's basically two parent-child relationships with the same parent. But there is one exception that lets you undo it if:
    No immigration benefit was obtained or conferred through the adoptive relationship;
    A natural parent-child relationship meeting the requirements of INA 101(b) once existed;
    The adoption has been lawfully terminated under applicable law; and
    The natural relationship has been reestablished by law (citing Matter of Xiu Hong Li).
    She never immigrated to US so point 1 is good. Point 2 depends but I assume that at some point your parents did raise her before giving her up and didn't just leave her unclaimed at the hospital. Point 3 and 4 would basically require her to go to court in the Philippines and basically seek to have the adoption order reversed and make her biological parents her legal parents again.     Still, I would recommend getting a good immigration lawyer (particularly one that deals with international adoptions), this stuff is above the paygrade of this site and above the paygrade of most average lawyers.
     
    But to answer your question, is it possible, yes with a very large but.

    If she was legally adopted to another family. She would no longer be considered your sister for immigration.

    i went to biometrics yesterday. i did not have any problems. my passport was stamped so i can work. they told me 6 months for GC to arrive.

    Just realized @Chancy spearheaded this thread! Nice job and a very thrilled young man who won’t miss out on the next 20 plus years waiting for dad to petition again
