    Screaming crying throwing up - our AOS got approved today! I had pretty much stopped checking, and was getting pretty disheartened because people who had applied after us were being approved. I was at least hoping our EAD would come quickly but we just didn't seem like one of the lucky couples. Just decided to absent mindedly check while on the phone to my parents and nearly gave them a heart attack from my screaming!!! Our timeline was: 
     
    Arrived: Oct 25 2022
    Married: Nov 25 2022 
    Package sent: Dec 22, 2022 
    NOA1: Dec 28, 2022 
    RFIE: Jan 21, 2023 - so frustrating. Even though we sent the package in before the new form came in, USCIS wanted the new form anyway 
    Biometrics: Jan 25, 2023
    RFIE received: Jan 31, 2023 
    AOS approved: May 13, 2023 
     
    I arrived on a K1 and so had done my medical in July 2022. However our lawyer recommended to redo the medical and send it with the package so we did, since they said otherwise we could get a deficiency notice. 

    Can't wait to have a break from USCIS again haha, at least for a little while!

    Thankyou so much. My husband and I have agreed last night, that regardless of the outcome tomorrow, that I will be leaving on Tuesday. I will arrive in time to attend my mother's oncologist appointment with her on Friday.

    Here’s the thing: 
    If I were in your shoes, and If I have to be digging to find the answer I want (which might or might not be accurate or legal), then my gut would tell me it’s better not to do it altogether. I like simplicity and peace of mind. But that’s just me.
    And with regards to attorneys, this is an immigration forum where most people DIY. And literally every day I read posts where lawyers mess up big time, and the worst is, they are not accountable. Take it for what it is.

    Sensible to allow petitioners to attend. The way to uncover fraud is to allow petitioners.  The consulates that don’t allow petitioners are sleep walking, IMO.

    This is the exact reason why people have trouble obtaining B2 visas, because of people like this who think that they are above the law and cheat the system.. Honestly, I hope they get caught and I hope that one day adjustment of status from a B2 is abolished.

    Congrats and I hope these trends continue. It wouldn’t be the worst thing if K-1 became viable.  
     
    I do think spouse based AOS from single intent non immigrant status should be lower priority than from dual intent status like K-1.

    You said she wasn't planning to adjust, and I think you're misunderstanding. That's actually what led you to make that mistake. 
    She had a B1- B2 which she used to enter. She also had a pending AOS. That's the misrep: you're not supposed to knowingly enter on a B1 B2 and intent to adjust!

    Most definitely fraud.   The plans didn’t “change” once inside the US.   It was always the plan to adjust.   Such a disservice to those who are waiting their turns in that long Mumbai queue…

    Well I am so cranky, we got an RFIE due to the form being expired even though we sent it very much before the new form came in and made sure the post office time stamped the date we were sending it. Our lawyer sent us the tracking details so we know they definitely sent it in on time. On the USCIS page it says that forms received before the expiry date will be accepted, so our lawyer was like 'its a good thing they didn't reject the form but annoying they still sent the RFIE'. Anyhow, the new form has been sent off. 
     
    I had biometrics 2 days ago and was hoping for a quick EAD like a lot of people have had but it looks like that may not happen since my case is basically on hold until they receive the new form. UGH

    We filed ours Dec 22 and it was received Dec 28 (exactly 2 years to the date they received our I-129F, thanks so much COVID delays) and our NOA1 was in the mail on 01/07. Biometrics scheduled for 01/25. I had a question, I noticed some people here saying their NOA1 had a priority date at the top, and some don't. Ours has a priority date, 01/04. What does this mean?

    I don't see an immigration issue here either.  No way for anyone to conclusively prove she was lying at POE (although we all know she was).  Just my opinion.
     
    Where I do see an issue is the fact that OP's partner seems to be very comfortable with lying about anything and everything, and intentionally engaging in duplicitous acts (e.g. working illegally, knowing it's wrong (she can't claim ignorance, she has a degree and has worked in immigration)). in order to get what she wants.   I have no doubt that, during an AOS interview, she will lie and say she never intended to stay.
     
    If it was one mistake or misstep, ok. These things happen.  But this seems to be a pattern.  Good luck OP.  I don't think you have an immigration problem.  Your partner on the other hand?  I hope you never get in the way of what she wants as I suspect you may be discarded.

    First of all, OP did not elaborate on where he is getting that information from. He did not quote in his first post anything from what he read and come across. I cannot read minds and know what he is talking about exactly.
     
    Second of all, the beauty of this website is that I can answer however I like, given I don’t break TOS. If that doesn’t satisfy your standards, that is just too bad. 
     
    Third of all, this is DIY forum where you seek out information from all sources yourself and seek to find out the true practical information and see and learn from other peoples experiences. And no, I will not hold anyone’s hand and break down information in detail because frankly we get a question like that every week, even several times a week. Proper research is, given that OP is posting on VJ, is to read helpful guides and flowcharts that are available at anyone’s fingertips right here on VJ. It is to read through pages of threads on this K1 section. It is also using this little helpful tool on top of the screen that is a search bar that will lead to thousands of threads on this exact question and many more.

    I’m a volunteer here and I do not get paid to do this. I don’t need to be lectured on how my answers “can be more helpful”. I answer how I see fit, respecting the TOS of VJ of course.

    our consulate is closed at the moment but Sydney is meant to come out of lockdown on October 11...so there is a HUGE part of me hoping that they may send the next batch of cases in preparation for that. Also, some people on the Aussie K1 facebook page who had expedited but then got stuck at the closed consulate said they recently got their P3 emails. All my fingers and toes are crossed...my eyes too!

    A lot of people dying here. Our local hospital is overflowing, many operations cancelled so its impacting people with other sicknesses too. It's good that they are adding covid vaccine to the list.
