Getting ready to apply K1 visa
TBoneTX replied to LUMINOUS's topic in K-1 Fiance(e) Visa Case Filing and Progress Reports
Here is his list, I hope still up-to-date: --- K-1 More expensive than CR-1 Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork) Spouse cannot leave the US until she/he receives approved Advance Parole (up to 9 months) Spouse cannot work until she/he receives EAD (up to 9 months) Some people have had problems with driver licenses, Social Security cards, leases, and bank accounts during this period Spouse will not receive Green Card for many months after Adjustment of Status is filed A K-1 might be a better choice when 18-21 year old children are immigrating also In some situations, marriage can affect certain home-country benefits, making a K-1 a better choice A denied K-1 is sent back to USCIS to expire K-1 entrant cannot file for citizenship until after having Green Card for 3 years Once an I-129F has been approved, delaying the case is difficult to impossible if the need arises If US spouse declines to participate in Adjustment of Status, the foreign spouse will have a very difficult avenue to legally remain in the US Current Presidential executive order (travel bans) don't allow K-1 visa holders from some countries to enter the US CR-1/IR-1 Less expensive than K-1 No Adjustment of Status(I-485, I-131, I-765) required Spouse can immediately travel outside the US Spouse is authorized to work immediately upon arrival Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US Opening a bank account, getting a driver license, etc. are very easily accomplished with GC, SS card, and passport Spouse has legal permanent Resident status IMMEDIATELY upon entry to US The clock for citizenship filing starts immediately upon entry to the US A CR-1/IR-1 case can be delayed indefinitely at NVC if the need arises Current Presidential executive order (travel bans) exempt immediate relatives of US citizens -
VAWA, Part 27
TBoneTX replied to TBoneTX's topic in Effects of Major Family Changes on Immigration Benefits
Five consecutive posts with our VAWA-Thread Jokes, this one our Official Weekly VAWA-Thread Joke: ~~~~~~~~~~~~~~~~~~~~~~~~~ PUNNY THOUGHTS FOR THE DAY To the person who stole my diary and then died: My thoughts are with your family. At first, I thought my chiropractor wasn't any good, but now I stand corrected. I used to hate facial hair, but then it grew on me. I used to be able to play piano by ear, but now I have to use my hands. I used to run a dating service for chickens, but then I was struggling to make hens meet. I broke my finger last week, but then on the other hand, I'm OK. I was wondering why the baseball kept getting bigger and bigger. Then it hit me. I wanted to eat a watch for lunch, but it was too time-consuming. I stayed up all night wondering where the sun went, but then it dawned on me. I used to be addicted to basketball, but then I rebounded. After dinner, Mom asked if I could clear the table. I needed a running start, but then I made it. We're renovating the house. The first floor is going great, but the second floor is another story. -
This piece clarifies issues well, I think. Comments? ~~~~~~~~~~~~~~~~~~~~~~~ Sanctuary cities are sanctuaries for criminals [...] Minnesota state officials have pointed out that the state Department of Corrections actually cooperates with ICE. "Minnesota DOC honors ICE detainers and coordinates custody transfers every day," the Department said in a statement. But that's just part of the story; a New York Times analysis found a "complicated picture" in Minnesota. "About 30% of the people ICE detained in Minnesota last year were turned over by local jails and prisons," the Times reported, "but that number is a lower share than in 39 other states. In Iowa, for example, the figure is 80%." The Times continued: "In addition, no one was transferred from the state's largest jail, in Hennepin County, which contains Minneapolis, the state's largest city. Local jails in Minnesota have declined or ignored hundreds of the more than 2,000 detainers, requests to hold someone longer in detention until ICE can take custody of them, filed since President Trump took office last January." That is the issue at the bottom of the Battle of Minneapolis. Trump border czar Tom Homan went straight to the matter when he met the press on Thursday after talking with local officials. Others here may opine differently, but I think that your only chance would be to explain the situation to your interviewing officer and see what he/she says about flexibility. -

This Could Be Huge: Trump Appoints New Federal Fraud Czar If you've been following along, you've seen a lot of reporting of rampant fraud in our country, ranging from welfare fraud to Medicare fraud to... well, you name it. We've seen some shocking numbers, and we've seen some pretty unrepentant Democrats willing to just let it all go away. Minnesota seems to be ground zero for possibly billions in fraud, and a lot of that money has gone overseas, to Somalia and other places. [...] President Trump has decided to do something about it. On Wednesday, he took to his Truth Social platform to announce a new appointment and a new division at the Department of Justice.
