I received my interview date and it's next month!

Question: How long exactly till I get the visa in hand? Does it take another month or weeks? Please pardon my ignorance.

They will just ask what you have in your i129f. If you state what your parents do on there, it's good for your fiance to know. If you do not, or you put not in contact or whatever the case, that is what your fiance should answer. I think in Mumbai, they tend to focus more on your relationship rather than what extended family is doing. There's a telegram group and FB group where people post the interview questions

I started going through all the documents and instructions and it seems simple enough. Now we just need to get married and then start the process. Thanks for all the help.

Hello, I want to sharing my experience during my K1 visa process. We prepared our application on April 2020 then apply on May 2020. Got the NOA1 on June 2020 and got the NOA2 on March 2021 (9 months crazy huh). I was interviewed on April 27th 2021 and APPROVED!!! Me and my Fiance really happy on this. After up and down moments waited for 1 year so much tears, doubts, and prayers, finally God answered! Thank God.. no words can describe our feelings. So guys, be patient on your looooong waiting times. Keep prays and trust everything will be OK. Good luck!!!

If I were you then I would submit the K1 petition and request a expedite right away. That way you can bring your fiance here, get married, and have them added to your orders so that it can be accompanied not unaccompanied.

Thank you, I have friends, and know people who can probably do it.  But last thing I need is a particle joker friend to mess it up and cause me issues.  Would rather make sure it is done right.

She would be working while in the US.   Technically she is an independent contractor but she isn't authorized to work.  Subscriptions are handled as "Rents and Royalties" otherwise known as passive income.  Getting that is no problem as long as she isn't "adding content".

A K1 isn't the right visa in this case.

I think you may have to look into a joint sponsor, maybe a parent? Also, she will not be able to work in the US until she receives her work authorization, which could take months unfortunately

A green card is a green card is a green card.  A green card obtained through a family petition is no different from a green card obtained through an employment petition.

The mother did not violate any conditions of her green card since there are no such conditions that binds her to her sponsoring employer.

Much like a spouse who quickly leaves a marriage after obtaining a green card through marriage, it's suspicious when a employee quickly leaves after getting an employment based green card.  Like bad faith in getting a green card though a marriage that ends quickly, there is bad faith when getting a green card and the employee leaves quickly.

In the OP's case.  Mom's employment should be irrelevant after 30 years and should not be a barrier to OP's naturalization case.  There are very few people with tax records from the 90s.

Hello. I'm wondering if anyone has some insight into my situation. I am a green card holder and I applied for citizenship for the first time in October of 2018. My interview was scheduled for September of 2019 and during the interview, I was asked why my mother was not a citizen (my father has passed away). My mother just never ended up applying for citizenship because she never felt she needed to but my older siblings did apply and were all naturalized before me. The interviewer was dwelling on this and requested that I provide pay stubs or a W-2, proving that my mother continued to work for her sponsor employer after she was granted permanent residency in 1993. I told him that it would be difficult to track down such documents from almost 3 decades ago but he insisted that I needed to find them. I passed the civics test and otherwise everything else about the interview went fine. So after the interview I was sent an RFE and I didn't know what to do. Tax records from 1993 don't exist anymore and the pay stubs are long gone as this was almost 30 years ago; the person at the tax institution laughed at how ridiculous the request was. I contacted several lawyers who were really surprised that I was asked this because it seemed incredibly unreasonable. Ultimately, I ended up providing a sworn affidavit from my mother saying she had worked at that time and I sent this in for RFE but ultimately my N-400 was rejected in October of 2019. I want to reapply for citizenship this year but I wonder how to navigate through this issue because it's on my record and I have almost no way of proving this in a manner that would satisfy them. Any advice would be much appreciated because I'm so lost.

No idea why your mom's stubs are being used to withhold your N400..

You would have to cancel your interview. You're better off redoing the medical and keeping your June 15 date

Well... That’s what we did!!! We skipped his flight out and got married last weekend. Thank you, online “church” for ordaining my best friend. we drove out to a waterfall in a forest and with only five total people present, did the ceremony. It was beautiful, wedding-drama-free, and exactly what I would have wanted even not in a pandemic.

The next day, I notified NVC of his new ineligibility for the K-1 and we went to work on the I-130/145 submission packets!

good luck to all still awaiting the visa!!

Ohh gotcha that makes sense. Yes, I would keep your appointment. You can get a 221g and send in your medical later, much safer and will give you time to travel and marry also

I heard that you just send an email to your embassy that you still intend to marry each other and are waiting for the embassy to process the case which has stalled because of covid. Just having that paper trail helps

Oh man, fellow June 2020ers!!! Finally after a year of trying to get the fiancé to visit, rescheduling tickets six times from cancellations, he’s been here in the United States for almost a month on a B2 visa. Struggling with deciding to continue down the K1 path or just to marry and adjust status from here. I know things are largely getting better in many places with the pandemic, or at least normalizing, but going another year just seems so hard to do.  I guess just venting to the only group that would largely understand
