    Update: at 4:30pm I got an update from Lawfully that the i485 was approved! Finally!!!

    Current processing estimate for I-485 at Jacksonville FL is 21 months -- https://egov.uscis.gov/processing-times/
     
    If your case has been pending for less than that, then it is within normal processing time, nothing to escalate.  If pending for more than 21 months, you may file a USCIS case inquiry for "Out of Normal Processing Time".

    The extension gives you until October 15 to wait on a SSN and file whenever you get it. The form doesn’t ask your filing status. And by the way, you said “single” filer. You are not single. I think you mean “married filing separately”.  You can list her name on the extension form with your name because that is how you intend to file taxes. You don’t amend the extension later. It is a one time request for more time. It is not filing a return.

    You don’t apply for the ITIN and wait for it to come then file. You need to read the ITIN process on the IRS website for all the details. I’ll give you a brief summary.
    You submit
    a completed and signed joint tax return (paper return) with her SSN left blank. And An application for her ITIN (Form W7) Her required ID which is her actual passport which they send back to her.** All that gets mailed together to Austin, Texas where they process ITINs. They will process the ITIN, assign it to the tax return, then process the return and issue the refund (if you’re getting one.)
     
    ** In lieu of mailing off her passport, you can get a certified copy to mail instead. You can only get it certified with her in person at an IRS Taxpayer Assistance Center. Free service. Requires an appointment.  Or certified at an IRS approved Acceptance Agent. Fees. 
     
    Once you apply for the ITIN, you have filed and she won’t get the stimulus. Waiting to file with a SSN is over at that point. I would wait and see if you get the SSN. You can still do the ITIN process at a later date if it doesn’t look like the SSN will happen in time.

    Just done with my biometric. Try to check my case status online after 10 minutes ish and it has changed into "Case is being actively reviewed by USCIS".

    Same here! Still haven't heard anything...but I just joined the Milligan v Pompeo Round 3 and am anxiously waiting for that filing to get things going.

    I also got in round three. Back in December, I kept thinking that Biden's administration would at least give direction to Consulates to begin processing even if they did not lift travel bans. When this did not happen, I decided this was the best course of action when round three was announced. A gamble, but a better bet than doing nothing and waiting. I did consult with another attorney before joining and he felt the odds were better to be added to plaintiffs than getting class status. But also added it is only an educated guess.
     
    Of note... I did notice yesterday that our CEAC "Case Last Updated" changed to 2/17/21. I'm sure it was not due to joining the lawsuit as motions wont be filed until 2/22. I have only seen the date change each time I have contacted the Consulate over the last year. Most recently, I asked my congressman to see if he could get any info like a timeline (he got usual boilerplate response). That was two weeks ago, so not sure why it was updated yesterday. We only needed packet three when Covid shut everything down at the Guangzhou Consulate in early February of 2020.
     
    BTW, this is the largest group joining according to one of the attorneys on the video referenced above.

    K Visa Processing Update
    Last Updated: February 10, 2021  
    On November 19, 2020, the U.S. District Court for the District of Columbia enjoined the government from suspending K-1 fiancée visa adjudications for the named plaintiffs in Milligan v. Pompeo due to the geographic COVID-related Presidential Proclamations (P.P.s) 9984, 9992, 9993, 9996, and 10041.  These COVID-related geographic proclamations suspended entry into the United States of foreign nationals who had been physically present in the People’s Republic of China, Islamic Republic of Iran, Schengen Area, United Kingdom, Republic of Ireland, or Brazil in the 14-day period prior to their entry or attempted entry into the United States.  On January 25, 2021 President Biden signed P.P. 10143 continuing the suspension of entry of certain travelers physically present in the Schengen Area, the United Kingdom, the Republic of Ireland, and Brazil, and expanding restrictions to include travelers present in South Africa.  The restrictions on travelers physically present in the People’s Republic of China and the Islamic Republic of Iran also remain in effect.
     
    K-1 visa applicants who are named plaintiffs in Milligan v. Pompeo and subject to a geographic proclamation should contact their nearest Embassy or Consulate for guidance on scheduling a visa interview.  While such applicants may, pursuant to the court order, be scheduled for a visa interview even though they are subject to a COVID-related geographic proclamation, the court order does not require that plaintiffs be given special priority ahead of other K visa applicants who have requested interviews or who already have been scheduled for interviews.  Even if issued visas, K-1 plaintiff applicants remain subject to the geographic P.P.s and, unless able to meet the criteria for an exception, are barred from entering the United States if they have been present in a country covered by a geographic P.P. in the 14 days prior to entry.  
     
    K visa applicants who are not plaintiffs in Milligan v. Pompeo and who are not subject to COVID-related geographic proclamations will continue to have their applications prioritized and processed in accordance with existing phased resumption of visa services guidance.  Please check the website of the Embassy or Consulate where you wish to apply to see what categories of visas are currently being processed.
     
    K visa applicants who are not plaintiffs in Milligan v. Pompeo and who are physically present in a country covered by any of the COVID-related geographic proclamations (the People’s Republic of China, Islamic Republic of Iran, Schengen Area, United Kingdom, Republic of Ireland, Brazil, or South Africa) will not have their K visa application processed unless the applicant is eligible for a National Interest Exception.  K visa applicants who are physically present in a country covered by any of the COVID related geographic proclamations, who are not plaintiffs in Milligan v. Pompeo, and who are not eligible for a National Interest Exception cannot be issued a K visa and thus will not be scheduled for a K visa interview while the geographic proclamations remain in effect.  K fiancé visa applicants are not spouses of U.S. citizens and therefore are subject to the geographic proclamations.  
    The resumption of routine visa services, prioritized after services to U.S. citizens, is occurring on a post-by-post basis, consistent with the Department’s guidance for safely returning our workforce to Department facilities.  U.S. Embassies and Consulates have continued to provide emergency and mission-critical visa services since March 2020 and will continue to do so as they are able.  As post-specific conditions improve, our missions will begin providing additional services, culminating eventually in a complete resumption of routine visa services.  Applicants should check the website of their nearest U.S. Embassy or Consulate for updates on what services that post is currently able to offer.

    Anyone can sue USCIS. And anyone can start a new lawsuit. But with just a view more days until King Biden sits on his throne, you may see an entirely different immigration system. Just saying.

    London isn't. I feel for people who have been waiting for so long, we were meant to submit ours last year but stupidly waited so now we're going to be waiting even longer. It really sucks.

    I think the best thing to do right now is to avoid looking at those website updates, step outside of this horrible situation for a minute and let ourselves breathe. I've gone through different stages of obsessively checking during the course of our process, but at the moment I'm in "acceptance" mode, because it became too detrimental to my mental wellbeing. 
     
    Those official website updates are too generic to take literally, and I've never bothered to call them because it seems fruitless with every officer telling a different story. I'm thankful that the embassy website has posted that they've resumed services this week, but to me, opening doesn't mean we're going to get moved across just yet, because it's not yet our turn since NVC arranges interview dates in DQ date order. The clearest indication that they are actually moving will be when someone whose case was DQ before ours gets a routine interview. Those are the updates that got me through the I-130 process, by keeping check on the Potomac group on this forum and the Facebook groups as well.
     
    I know there are some people posting here that got DQ in March and April, so as soon as those guys come back and post their updates, or I see a similar update on Facebook, I will start to get anxious for my own case (DQ in May). Until then? We're still in the queue. We're in the hands of the NVC but they are definitely not the best place to look for updates from what it seems. People's stories on places like this website build a bigger picture than they ever can. Obviously it's a different story if you're expedited, but I try to ignore that information (I don't mean that in an unkind way) just because those cases have no bearing on how soon my own routine one can move. I have considered expediting throughout this month, but I just can't justify it in this moment of time because I wouldn't be ready to fly yet anyway.
     
    Apologies if this sounds harsh, I don't intend for it to be, we last saw each other in February so I've had some really dark days during the last few months, but the best thing you can do is look forward and do whatever it takes to distract yourself and waste time so you can look forward and the next few months fly by. Have a clearout, sell some stuff, plan your goodbye party,  play videogames and watch movies together every night, anything small or big you can think of. I have to have a major clearout before moving, and get my cats up to date with their vaccinations, so I'm concentrating on that right now. I also have projects at work to do before finishing if everything gets approved. I'm starting to feel confident that those with the earliest DQ dates that are still stuck at NVC will start getting appointments allocated during August and September, and if they do then that will be good news for my case right as autumn arrives, so fingers crossed.
