The older ones will have to be petitioned by you (about a 10 year wait). and no, you cannot use a non immigrant visa waiver program to immigrate and try to circumvent the immigration process just because they're Canadian. If you want them (younger ones) to come with you, your US citizen spouse needs to petition for them.

They don’t have “jurisdiction” over it and what you’re asking about essentially sounds like a request to make a case that is with USCIS a DCF case. You’re free to try of course but I’m pretty sure they will email back saying you need to contact USCIS. Standard processing time for I-130 is 12-14 months. I sympathize with you but separation is a normal and expected part of US immigration that most of us have had to experience and wait out. USCIS and the consulate will not care about that. I have known people who live in war zones who had their expedites denied so political instability and a news article about that won’t do much. Neither will a hypothetical scenario about another travel ban.

  15. It can’t hurt in my opinion and in case the officer reviewing the file might have questions he’ll have an explanation so possible you’ll avoid an RFE. K1 is correct.
  16. You need to send a public inquiry to NVC on their website. Prepare to write and provide proof for justification for transferring. That is usually a copy of the long term resident visa, residence permit or citizenship in the country you’d like to transfer to.

  18. So sorry this happened, I’m glad she’s okay. I would still go to the interview and bring the police report to explain the situation. I believe they can still conduct an interview but will put the case on hold until they receive the passport.

  20. Was this with a credit card? This is a common issue with credit cards, they get declined. As far as I know, USCIS does not try to charge more than once so most likely they’ll send the whole thing back and I recommend resending with a personal check or money order.
