Sarismercadouribe reacted to Danii in I-130 January 2020 Filers
Anyone else who still hasn't heard anything? At this point I wish I would at least get a RFE 🤣 I'm happy for everyone who is getting approved, but it hurts a bit when someone who applied 8 months after me is already at NVC. The wait at the consulate in Montreal also has a backlog of 8-9 months maybe, so I feel really screwed over.

Do you have a joint sponsor? You can use medicaid as a USC but it's not ideal.

Call USCIS to inform them he'll do consular processing. That way after I-130 approval they'll send the approved petition to NVC.

Yes I flew here from The Netherlands 2 weeks ago. Spouses are exempt from the travel ban. And the papers (marriage certificate, proof of citizenship of spouse) will be checked before boarding.

Sarismercadouribe reacted to jackanddeona in Did anyone manage to move to the U.S during the pandemic?
Havn't moved but my wife came to visit with me as the border was closed. The exception to the closure was citizens of the country and their spouses so she was able to enter after being asked a few questions about her travel insurance and where we were staying.
https://help.cbp.gov/s/article/Article-1596?language=en_US
On this page there is no exception for entering on the US side for immediate family members and I don't know if you would count under the Lawful Permanent resident until you cross. Best bet would be to phone the POE you are planning to cross and ask I would say?

Me? That's not my issue, I'm not travelling. It's up to the OP to follow all applicable laws and regulations. I'm just answering the question about entry to the country, which was what the OP asked about.
Personally, I think you should follow the state orders (shelter at home, in case of New York state - that's what I'm going). However, if you are legally able to visit your husband in Canada, are able to do so in a way that is safe and don't risk spreading the virus, and without breaking any laws or regulations, then I think it's acceptable to visit. If you drive a car, alone, straight from your home to your husbands home, and follow all regulations about quarantine - then visit could be an option. Personally, I may have waited, but that's easy to say when I don't have to be away from my family.

Wow! What whole lot of certainty! No border is completely closed. Most countries has restricted travelling for tourists, and for different other groups of travellers. But no country has shut its borders for every one.
For the travel restrictions for travellers from China, Iran and the Europe, the US has specifically made exceptions for, among others, close family members, specified as spouses of US citizens and children (under 21) of US citizens. For the travel restriction between the US and Canada i cannot find the exact same exception, instead it's specified to "essential travel" and there are a few examples for what non-essential travel would be (tourism, sight-seeing, gambling and so on).
However, the US and Canada has adopted the same principles and the this was a joint statement between the US and Canadian governments: https://www.dhs.gov/news/2020/03/20/joint-statement-us-canada-joint-initiative-temporary-restriction-travelers-crossing
The Canadian government on the other hand HAS specified exceptions (just like the US did for travellers from China, Iran and Europe), where that specifically says that spouses of Canadian citizens and permanents residents can travel to Canada. Given that you can travel to Canada if you are a spouse of a Canadian citizen and that the US made the same exception for travellers from China, Iran and Europe, it makes a lot of sense that the US will let in Canadians who are married to a US citizen or LPR. More info from Canadian government here: https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/service-delivery/coronavirus/travel-restrictions.html
Needles to say, bring proof of marriage to the border!
Good luck!

I crossed by land into the US on March 21st (the first day of the closure) Not sure if it’s easier entering the United States?
I just told the cbp officer I’m visiting my husband.

Well 6 hours driving suggests crossing a few States and it seems that each State has its own rules as to what is allowed, so probably best to start there. No idea about the Canadian side.
