Thank you! How is it helpful for me to have these if USCIS accuses me of not filing i-751 and orders me to leave in my own or by governmental force?

I tried calling USCIS once again and was able to connect with an agent, and I got an email explaining that if there's an error on my permanent resident, I need to file a I-90 form, which I already filed over a year ago.
As I was reading the email, I couldn't help but notice this quote:

"The adjudicating officer will decide if the incorrect data on the Permanent Resident Card is due to DHS error. The adjudicating officer may deny the selected reason and require you to pay the application fee and/or biometrics fee"

Does it really mean that if my I-90 will be denied, they will really make all the fees associated with the I-90???
It concerns me because it doesn't seem like the reasoning behind why I was supposed to be getting a 10 year CG is common knowledge within USCIS, neither the officer who adjusted us.. CG

DialNoises reacted to Mark11 in My Wife (Brazilian immigrant) died from Covid during AOS -- how do I withdraw the application?
    Dear Group,
I write with a very heavy heart.  My beloved wife came to the US on a K-1 visa in June 2020.  We married immediately and filed the whole I-485 packet including all the supporting forms and received the NOAs for all.  While waiting for the AOS interview, she died from covid and that has pretty much destroyed my life.  I called the USCIS hotline for advice on how best to withdraw the application, but they seemed very befuddled and recommended that I file form I-140 (which has nothing do with withdrawing a petition -- completely wrong) with the center that is handling my case.  They gave me an address based on my zip code, but I'm questioning if that's correct based on their recommendation of an incorrect form.

I just got notice yesterday that the AOS interview has been scheduled and a notice has been sent out.  Should I wait for this notice and then send a letter with a copy of the notice and death certificate to the address on the notice.  That seems to make the most sense.  Thank you for any advice.  Normally I would be able to figure this stuff out on my own (we got this far . . .), but my brain is very muddled these days.  My apologies.

    Thank you,
    Mark

@DialNoises's I-485 is still pending. Thus he can be proactive in the upcoming interview and make it clear to the IO that he should receive the 10-year GC.

ohhhhhhhh!!!! this whole time I thought that it was for just enrolling a medical insurance! I always saw mentions on VJ and other sources about that there are specific dates for enrollment but never a mention that it was for when you exchange an insurance, I always thought it was silly but now it makes more sense!
    Thank you!!

For the record, we were approved! The letter from my roommate worked out just fine. The officer read the letter in full, asked a couple of questions about splitting the rent and seemed to agree with what was said. I didn't show anything else besides my roommate's ID (the letter was also notarized). I took a copy of the rental agreement but the officer didn't ask for it, so I didn't offer it. Good luck to everyone!

No they will NOT deny you for a missing i-693. You will have to bring it with you to the interview. Should they waive the interview since you have already had one then they will send an RFE for it.

You do not need w2/1099 or pay stubs. I guess you can include them just to be thorough. What is required is tax return for most recent tax year. The income for the other 2 years is just filled into the form. Also a tax transcript for the previous might be helpful. Do NOT worry about the missing w2.

You will have to do a new medical as it is already a year since you last did one. You just don have to do it right away.

DialNoises reacted to azblk in AOS denied due to missing supporting Affidavit Of Support documents.
i-693 is the sealed medical form from a civil surgeon and you do NOT have to submit it right away. Read the USCIS policy itself, They will NOT deny you because you didnt include it in your initial filing.

DialNoises reacted to little immigrant in AOS denied due to missing supporting Affidavit Of Support documents.
Agreed, don't call USCIS again. Send in your forms. The sooner you send them, the sooner you get your receipt notice and are in authorized stay. That's what you need now. I hope you can gather all the forms and send it out soon. Good luck and keep us updated if you want. Come back for questions too.

Why, oh why would you call the Misinformation Line again? It serves no purpose. The last 2 times they gave you the wrong information. What makes you think it will be different this time?

I can do that??? I'm very afraid that they will again not send an RFE and deny my forms for missing medicals, I'm wondering if I can squeeze a medical redo in the time that I have left
I'll look it up! Thank you!!

Basically the USCIS is saying you overstayed your visa or were otherwise out of status. Since you are the spouse of a us citizen - that point is moot. Just make sure you refile your application as quickly as possible before the issue an NTA as that will delay and complicate your case alot.

DialNoises reacted to azblk in AOS denied due to missing supporting Affidavit Of Support documents.
You do not have to file the medical right away. Just file i-485, i-131, i-765 and i-864 right away. Basically the same package you filed with i-864 included this time. You can do the medical later, it is not required with initial filing.
  22. Thanks
DialNoises reacted to azblk in AOS denied due to missing supporting Affidavit Of Support documents.
Yes you can do that. You are NOT required or even advised to send medical with initial application because you have no idea how long it will take and medicals expire after 2 years.
  23. Thanks
DialNoises reacted to azblk in AOS denied due to missing supporting Affidavit Of Support documents.
You dont have to include anything about the denied case. Look at it like you are filing a new case with the missing documents(i-864). Good luck this time round

This may be one of those rare instances when hiring an experienced immigration attorney may be a good idea to help you respond correctly to the denial letter.  Don't wait to do this as you have less than 30 days to reply and with the holidays coming up, finding a good attorney may take some time.  Good luck!
