  1. you can file mandamus on your own. naturalization is a simple case.. it only costs 402$ as court fee. it can be done with some studying of immigration law.
  2. never said its easy. just said it can be done. there are people waiting for 2-3 years to get adjudications. there is a way out of the frustration.
  3. https://www.law.cornell.edu/cfr/text/8/216.4 or you can google it
  4. you really dont need a lawyer. you can write in simple English. Dont listen to lawyers. i have filed a mandamus after 90 days of filing my ROC. Court has given USCIS 90 days to adjudicate. each lawyer will have a different story. one firm will say 6 months another will say 12 months and another will say 2 years. what they say is as good as uscis processing time
  5. anyone waiting for more than 90 days for ROC approval should file a mandamus in court. it only cost 400$ but you will get adjudication of case within 4 months once the case is filed in court.. 2 years is a very long time from what congress wrote in immigration bill
  6. you can apply for naturalization on or after July 1st 2023
  7. here is what it means as per uscis 12 months - your application could be processed in 12 months or 10 months or 9 months or 6 months or 18 months or 36 months or 48 months or 60 months.
  8. dont worry. human brains worry too much.. it will be easier than you imagined
  9. its no different than any other landing airport in US. you land, deboard the plane, complete your immigration, collect luggage and go home
  10. odds of some one getting denaturalize is pretty much zero.. i dont see why people worry about things that never happen. human nature always think about the worst case scenario.
  11. I want to fly to Europe in the end of this month ( April ) I read that is "recommended" that you apply 60 days before you travel....but what I understand is that is "recommended" not "mandatory"? Is that correct? What you guys think about that? You have to apply for reentry permit from us soil. when you apply is your problem 2- IF the previous question (1 ) answer is not "mandatory"........ If I apply TODAY, lets say, how many days after that I can go overseas ( I read on the internet that USCIS needs to "receive" the application before I leave but I don't know if that is accurate ) I saw some people saying that they applied from the US and left the country on the same day .Also if USCIS really needs to receive the documents how many days that usually take? safest is to wait for receipt to show up or your credit card to get charges for the fees 3- Lets say I Apply now APRIL 2023. I read that is taking about 1 year for the Reentry permit to be approved...so let's say its approved on APRIL 2024......ALL this time ( between April 2023-April 2024 ) Im not protected against the "green card abandonment" problem? Im only "protected" once the Reentry permit is Approved? Or they see the "good faith" on it ? I probably gonna be coming to America every 8-10 months, so having the Reentry permit application PENDING gonna protect me from CBP in any way? correct the protection is only after reentry is approved. 4- Is there any chance they waive the fingerprints like they did with my Removal of conditions in 2020? because im gonna have to return to the US to do fingerprints coz its taking months only uscis computer can answer that question
  12. should not be an issue. traffic violations dont matter unless you caused an accident or bodily injury like hit and run
  13. most likely n-400 will be denied due to not meeting the residency breaking ( > 6 months outside US)
  14. file a mandamus in court and get your 751 approved if n-400 does not trigger 751 decision
  15. only a judicial ceremony with a judge swearing you will allow you to change name. these are not scheduled daily. most uscis offices offering same day oath are done by USCIS officers and they do not have legal power for name change approval. Only a judge can do that
  16. Yes i have filed. 30 days for AUSA to respond to mandamus. 90 day adjudication settlement time given by AUSA.
  17. Its not. you dont need a legal degree to file mandamus. all you need to is some home work and write a pro se complaint.. most mandamus are quickly adjudicated cause law of least effort by AUSA and courts dont want to waste resources. Mandamus is a DIY case if you are ready spend some weekends researching the law.
  18. you dont need to pay 5k for mandamus. it costs 402$ for court case filing and some research on immigration law to write up the mandamus.. n-400 mandamus is not that difficult to file Pro-se
  19. we need to replace the entire congress and government. its not USCIS but the bureaucracy of 90 year olds in congress for like 50 years
  20. you wont know anything.. some times your case could go to secondary review before they clear check . that can take up to 60 days.
