Can you please fill out your timeline? https://www.visajourney.com/timeline/profile.php?id=421923 You will interview at the Consulate, they will take your passport and complete additional background checks before issuing your visa and returning your passport. There is always the possibility of being issued a 221g or the dreaded DS-5535. So no, you will not be able to pick up your passport on the same day. It's also why people who are going through consular processing are instructed not to book travel or make plans to move until after they have received their passport back from the Consulate.

  3. How do you plan to reenter Canada? Do you have a citizenship certificate or NEXUS?
  4. Does SHE want to change her last name? If so, she needs to change her passport first and you'll want that done before the interview, which isn't for a while. Fill out paperwork as her ID currently is and indicate at the interview that she wants her name changed, as per her new passport. If she doesn't update that passport, the greencard will be issued in her maiden name and you'll have to pay the fees to change her newly issued greencard. It's a rip off IMO. It's a domino effect from there with SSN, DL...just a mess.

Nah, the general advice is the be acutely aware that she could be denied entry at any time (any non-citizen or LPR potentially could) and that she'll need to demonstrate strong ties to indicate intent to return to Canada to finish the immigration process. Be honest with CBP and you're unlikely to have any issues. If they ask, them you're re-establishing domicile as required by the immigration process and you'll be waiting for your wife's LPR to be issued. CBP can be jerks, but they also know the process.
  6. In general, there are a lot of user paid services that are being completely mis (or completely absently) managed. If I'm paying, be it small or big like immigration, where's the service I paid for? Total first world problem here (not belittling anyone stuck in this I-5535 Groundhog Day nightmare), but I can't update my NEXUS online to add my greencard. The only NEXUS offices open are on the State side at the northern border, COVID is still being used as an excuse for the offices in Canada and yet, it's a service I pay for. The amount of hoops I've jumped through and the amount of security vetting between various visas, my greencard and my original NEXUS application - you'd think this shouldn't be so hard. Yet, it somehow is. Epic fail, all around. Those of you filing your WoM, sincerest good luck. You're 100% correct that it shouldn't cost additional fees from an unrelated lawyer service to be reunified with a spouse because the government can't get their proverbial sh!t together.
  7. It can be risky. Echoing others - she'll need to demonstrate strong ties to Canada. Lease agreement for a property, employment letter, return ticket to get back to Canada. CBP can still deny her entry if they think she's going to stick around in the States.

I'm guessing you weren't aware, but information for the other poster asking about your experience - typically, you can still attend your original interview when stuck in an experience where no medical dates are available, unless instructed otherwise by the consulate. The Consulate will put you into AP until your medical is completed and they've received the results.

  12. Correct. No temporary SSN’s. That SSN will still be useable and the ITIN unnecessary. The caveat on the original SSN card would have been it’s validity with proper work or school authorization only. Regardless, she’s not in the US working or attending school and once she has her IR-1, she’s allowed to work.
  13. Also, when your wife has to fill out the DS-260, she's going to have to list all the addresses she's lived at since she was 16. She may want to start a spreadsheet now if she's lived a few places because it's a pain to try and figure out of you're trying to fill things out timely and efficiently.

If you've never filed for an ITIN (it's a tax identification number for individuals who don't qualify for a social security number), then she won't have one. As for any investments, it's usually in your personal information. Name, address, beneficiaries in the event the investment needs to be paid out for unfortunate reasons. List her. Even if she doesn't live in the US, you'd want that money to go to her, correct? There are multiple stages to the IR process. The first is USCIS where you filed the I-130. You'll then get sent to the NVC where she'll have to provide her information in addition to you proving your financial ability to look after her as a new immigrant. Once all that is approved, she'll have a medical, interview, undergo the remaining checks in AP and then have her visa issued. You may want to have a good look at the I-864 and ensure being self employed that you have all of your ducks in a row to not require a co-sponsor.
  16. We only submitted what was asked which was the marriage certificate. Both kids were approved shortly there after. As pushbrk noted, the stepparent/stepchild relationship is established by the marriage certificate.
  17. You need to fix those income taxes ASAP. Married is married in the eyes of the IRS. You have to present them as part of the IR process and if they aren't filed correctly, that will have a negative impact on your case. I suggest you get your wife listed as a beneficiary on any pensions and long term investments ASAP as well. They don't have to be together per se, but just listed as the beneficiary. Does your job know you as married? Does her job back in Bulgaria have you as her spouse? Keep those tickets!
  18. Have you been filing your US income tax correctly as married? Does your wife have an ITIN? You you have long term investments like life insurance policies that name each other as the beneficiary? Is she the beneficiary of a pension you have in the US? Do you still have evidence of your trips to visit? Plane tickets, car rentals, airport parking receipts? There are a number of ways to prove your union, but you probably don't give much though to it because you've been married for a while.
