If you search the Montreal consulate, there are many reviews with information posted, including recent ones. Regular AP (all cases go through some level of AP) or was a 221g or a DS5535 issued? If it's regular AP, as long as everything was in order and as long as your name isn't super common, it shouldn't be too long. If your name is common, expect more time. If it's a 221g or the DS5535, check out the thread posted above because it will take some time.

As long as your spouse's L1 is valid and their I-94 doesn't have any errors, should be fine. The interview is with USCIS and they have access to FBI records, hence why you never need to get an American PRC. @Froozion congrats! Sounds like your interview was pretty much the same as our IR interviews were back when we did them. Rant here...anyone else as completely over UPS and I am these days? Ordered a power cable for a security camera because Kid1's car is being vandalized by someone that's targeting her and knows we have a Ring camera doorbell. Yup, you can live together right up until you want to emmigrate Canada. Montreal is just a stickler for having proof that your partner has a plan to reside in the US when the time comes. This might be in the form of a lease agreement with the in-laws, your own property, etc. Remember, there's the I-130 that has to be filed and approved by USCIS, then the case gets transferred to the National Visa Center where you'll have to fill out the DS-260 and your spouse an Affidavit of Support. Because you're both potentially residing in Canada, your spouse may need a joint sponsor to prove they have the means to support you unless they can prove their job and income will continue when you guys relocate to the US. Once that is approved, you're put in line for your interview. This is why I say get legally married ASAP and file...18mo+ is not an exaggeration. 3 months and filing before this US election are a big deal because who knows what's going to happen and what immigration reform may or may not happen after November.

Canadian common law isn't accepted by USCIS. I'd honestly head to the courthouse and get married like yesterday and file tomorrow. Your timeline is unrealistic in the reality of things. The sooner you get started, the better off you'll be. As mentioned, you cannot work remotely while in the US without work authorization. The good thing is once you've processed through the Consulate, you'll enter the US with a greencard and have no issues with work authorization.

It's like a get out of jail free card...technically you're breaking the law by not leaving when your allotted time is up, but because you've made some effort, we'll allow you authorized stay until we make a decision. If USCIS and the government perceived this as being a real threat to national safety, they'd remove the option full stop. But, there's record of a tourist showing up. The AOS process is very visible. It's also highly revenue generating due to the number of forms filed. Anyone who's actually done any type of immigration proceedings knows it's a time consuming (and often painful) process. It seems rather unfair that none of that time and effort spent and none of the financial input required to file will all be waived. 100% rewarded for criminal activity and flying under the radar for however long. Most foreign criminals are expedited back to their home country but in this instance, they'll be made permanent residents of the USA - the exact opposite of that happens for any other rule breaking PR who've agreed to the T&C of permanent residency which includes complying with the laws in the United States. Most people want justice when people break the law, not for the law breaker to receive a reward.

This is the operative here. These people haven't ever left, many of whom have been for many years. The Biden Administration is trying to change it so they are pardoned for not righting their wrong and won't face an entry ban for unauthorized presence. It's a bit of a kick in the teeth for those who have adhered to the immigration rules and left, went through processing and returned legally. Lots of heartbreak and time apart to do things correctly. Many feel the Biden Administration is essentially ok'ing grown adults to break the rules for their benefit.

I know you read on here about stacks of evidence you have to provide - I don't believe it's necessary when the evidence is strong. I'm not dissimilar - hubs and I had been together for years before we'd filed, so it seems really difficult because you just take your daily life for granted. Don't stress too much! Our income tax were filed as married. We had each other listed as beneficiaries of our respective pensions, retirement savings plans and life insurance policies. We had credit cards with one another listed as authorized users. We had each other listed as drivers on respective vehicle insurance plans. We had some plane ticket stubs and hotel receipts - not many because we usually shredded them, thinking why would we need this in addition to personal data security. We had some photos from trips we took (not tons) and I have kids so we were fortunate enough to have photos where the school visitor name tag and date were visible when we were attending events. Quality and legitimacy of evidence will win every time. Good luck!

CBP and USCIS aren't the same. It should trigger in USCIS' system that you're an IR1, not a CR1. If you receive your GC and it's a 2yr, file an I-90 to have it fixed. Just be careful that your kids don't lose their healthcare from the Canadian provincial standpoint. Information is shared and the expectation is that once that visa is activated, they are LPR's of the US. You can pay the GC fee before you even leave Canada.

You can keep working for the Canadian entity. However, I would probably purchase gap insurance for medical until it's sorted. Yup, income tax will be messy. Just find a good cross border accountant and run away! LOL Different visa type, but both of my kids were with me. The CO actually asked them questions to verify information. The CO was really sweet to them. Kid1 was 13 and Kid 2 was 10 at the time.

Expedite just puts you at the front of the line. It doesn't excuse the wait for the next available agent. It also doesn't excuse you from other things like extended AP or being issued a DS-5535, just for the sake of awareness.
