    Yeah, it kind of is. There's currently no way to even get to each other without going through a third country first, since they don't give NIEs for ESTAs. You're also talking about starting the whole process over after some of us are over a year into this mess of a system, which is completely ridiculous. On top of that, for some people there's no other option because they can't actually get married in their country because of various reasons including that they're not allowed to marry their partners in their home country.
    There's a reason that the K1 process exists and it's completely ridiculous to suggest that people should give up after all of this and try again.
    Also praying doesn't do anything. What the hell is praying going to do?

    Sorry your spouse was unfaithful.
     
    There's nothing you can do about his US citizenship.
     
    Divorce and move on with your life.  This is the only healthy path forward.

    You should read the proclamations yourself, yes, there are multiple. Can't discuss this when you don't even know what the travel ban is... What you're talking about is not the travel ban, which bans entry of all people who have been to certain countries, regardless of visa types, and it's certainly being used as the reason not to start K1 interviews.

    US Embassies and consulates decide whether they re-open or not, local governments don't have the right to decide for them.
     
    Besides that, embassies don't have to fully re-open to do K1 interviews. It's a matter of priority, many are doing CR1 interviews while being closed to other catogories. State Department has announced embassies are authorized to give K1s  high prioritiy.
     
    For some countries it comes down to the travel ban, a Trump Presidential Proclamation. Guangzhou consulate replied in an email that the travel ban is the reason they haven't started K1 interviews, and they won't start until that's lifted.

    Well I submitted my notification of readiness in February after I got every single document, incliding medical in hand, sorted. They then got back to me a few days later with my interview date and gave me instructions to pay the fee and schedule courier delivery. Oh and from what I remember you don't schedule the interview, they automatically schedule it after you submit the notification of readiness. 
    From what you have told me, its not because you didn't pay the fee. Its probably because you submitted the notification of readiness so close to when they closed in March, which is why you didn't get an interview date and further instructions to pay the fee. I understand this is all so confusing and frustrating, but from what I'm reading you didn't do anything wrong! We just need to wait for the embassy to get back to us.

    Agreed, seems there are bigger problems with this relationship than just the (non)withdrawal of the petition.

    It took a lot of time and effort to get the amount of plaintiffs required on board. I think plaintiffs were patient enough during the summer but with mine and others' medicals running out and no end in sight there was soon a matter of urgency to file.

    The DV case gave them access to internal communications that made it clear that it hadn't just slowed down because of the pandemic.
    After that it was just trying to get the necessary amount of plaintiffs together, build the case and get everyone's information. It actually looks like there's a chance that they'll win this and it's super exciting.
     
    They're hoping that it'll have an effect on other cases as well. I hope it does, but considering some of the vicious reactions in some facebook groups and on some forums, I'm going to be pretty happy even if this only helps the plaintiffs. Let's hope it does have some more far-reaching effects though.

    Suit name is Milligan et al V. Pompeo et al. The PACER efiling got messed up a bit. It put two plaintiffs against each other 😅

    I'm pretty sure it was a combination of this and the case building on other recent successful visa lawsuits as part of its basis

    Yes but this is a minor issue. I think majority of applicants would gladly redo medical if they can interview.

    The tl;dr is this suit challenges a) the lack of K-1 visa issuance and b) the 14 day ban for K-1 holders from "banned" countries.

    I have to repeat the medical test... did mine in March and now I have an interview on October 5th, and they told me that I need to get a new medical.

    Don't immigrants that move here and start working pay taxes for the programs that they are not allowed to us? 
    If they are tax payers then why are they not allowed to use a program they are paying into?
     
     Seems like a bad system that allows one tax payer to receive a benefit another tax payer legally can't use.

    Legally you’re right but morally you’re not. Let’s say I’m a US citizen and a Tax payer as well. So around 30% of my income is gone and part of it goes to support other US citizen in need ( knowing that a lot of US citizens are rigging the system). Let’s say I sponsor a family member that means the world for me and while they’re here they really needed some sort of help now I can’t help them because my money is gone to help others that means nothing to me. So I have to sit and watch my loved one suffering?  If only the wealthy and healthy will be able to come here, what’s the American dream is for then? The public system truly suffering but this isn’t because of the legal immigrants or their few loved ones that most of them are not actually seeking public means but instead paying taxes and contributing to the system But the real problem is the corruption, the citizens that are rigging the system and maybe illegal immigration but definitely not the legal immigration.
    Yourself might be fortunate enough to support your loved ones but walk yourself in other people shoes If you can and wouldn’t you want them to get help? 
    I personally don’t have parents that want to come here but I think about my fellow immigrant and it hurts.

    Yeah the government is making its own citizens criminals. Sounds like Mafia is running the country. Have they checked the trillions wasted in Iraq, Afghanistan, all wars and bailing out wall street.

    He said the Plaintiffs are likely to succeed on all of their challenges to the Implementation of 10014 and 10052 except for one that was not commented on.
     
    If 2020DV winners receive their visa this month, they'll have until dates into March 2021 to enter.

    Pretty stoked at Judge  Mehta's injunction order today, he seemed to be tracking on that entry vs. visa issuance argument 😂... Congrats to all the 2020DV winners who now have hope to receive their visas!!
     
    Excited to see how the rest of this case develops and hope it provides relief to the rest of the plaintiffs!

    The argument in these suits has never been about entry restrictions as there are loopholes and ways around that. It's about the non issuance of visas. 
    Take the K visa for example, the presidential proclamation applies to me but I can still travel to a third country to quarantine before entering the USA. Yet I still have my consulate tell me they are not processing said visa type because of the presidential proclamation. Even on their FAQs on their website they acknowledge that you can travel to a third country to quarantine! Therefore should not affect the issuance of that visa type... But it is. Hence, people are turning to litigation.

    Unfortunately a recent medical is an immigration law requirement.  Nothing to do with current times or conditions.  And although K1 is tecnically a non-immigrant visa, it is immigrant intent and therefore the required medical.
     
    I would definitely recommend waiting until a firm interview schedule before redoing the medical.

    Yeah I figured this would be a thing. But tbh it seems silly. We should have to do a covid test and that's it. Someone I spoke to had their medical done (their visa expired too), and a covid test was OPTIONAL. Like, really?  smh. Anyhow, I don't want to have mine done just yet until I know what's going on with my visa. I don't want to risk getting a second medical, just for that one to expire all over again. I don't have the finances for a third time. Even a second one is going to be a challenge.

    I hope the consulates first re-schedule all those cancelled interviews in the order of their previous schedule before opening it up to newer cases....after that point, I'm sure it will a battle royal  for open slots.
