    A recent reply to this post just brought my attention to it. With i360, you do not need the i130.. with the i130, it was your spouse petitioning for you..but with the i360, you are a self petitioner. In my case my spouse never withdrew the i130.. after my i485 interview, the update on my i130 read “case closed, benefits gotten through other means” that was the end of it! So don’t worry too much from now on… wether it is withdrawn or not, you do not need to depend on it anymore!😊👍

    God will make a way for you. I pray all goes well and hope you get a chance to explain everything to uscis. Thanks for the info. We'll no one knows what mine will say if he is called for an interview but God sees it all and I hope those incharge can see his lies. I hope and pray We all come out as winners.

    they can send him a notice for interview.  The I-130 is technically his petition, you are the benificiary.  If he does not show for the interview, then it will be denied.  Also, you will not know what he says at the interview if he does show up.

    If it is not withdrawn, it will still be processed.  It is a seperate petition than I-360 and you cannot combine the two.

    I-360 does not replace I-130 (people used this term replaces) but what happens is once your I-360 Vawa USCIS transfer the priority date of the Form I-130 to the Form I-360, and uses form I-360 instead of form I-130 to prove a qualified relationship, good faith marriage, plus abuse claim evidence, Meaning you will not depend on I-130 filed by an abusive spouse to gain an immigration benefits. Do not worry Once you file I-360 this will be your Base to AOS, In my case my I-130it still show Approved is irrelevant once I-360 is filed.

    I didnt file for I-485. In my own understanding, after my vawa is approved it will be send to NVC and I will be  notified when visa is available and thereafter will have to go through a consular process to get a greencard. Therefore I won't have to adjust status like those inside the USA have to do. I left USA before I applied my vawa and I didn't file i-485 therefore the Ap doesn't apply in my case. I never overstayed any visa as well. I left by choice.
    I haven't found any similar story similar of anyone who have succeeded with this before yet. Doesn't mean there isn't anyone though. I have faith and hope that all will go well but I wouldn't advice you to leave. Its better to wait out there. You don't want to abandone your I-485 if you don't have AP.  Maybe it's better to use AP to travel and return but don't leave because you Don't know the outcome of this. I have the prima facie but its useless because I can't use it outside the USA. But it's good to have it because it shows that my case is heading to the right direction but I also know that having one doesn't definitely mean that my case will be approved.  But I am hopeful.

    I got a status update on my I360 today on 30MAR21 "New Card is Being Produced".
    Receipt date is 24APR19.
    Total 3 Prima Facie's and 3 EAD+AP Cards while pending.

    One more question. I have i-485 from my marriage is pending since 2017. Once my i-360 gets approved, will my local field office follow that priority date of 2017  or it would be start from my Vawa case?

    The VAWA process from outside the US is similar to the visa process. For a marriage based GC if you are in the US you would file the 130 (the underlying form) and the 485 (to adjust status/get GC). If you are outside of the US you file the 130 and then do consular processing at the Embassy where you are interviewed and a visa is printed in your passport. When you enter the US with it you become an LPR and the plastic GC is then mailed to you. You can review the guides section at the top of the forums for a more detailed breakdown. For VAWA the underlying form is the 360 instead of the 130. The general process is the same. If in the US you fill out the 360-485 and do an interview at a local office - once approved the GC is mailed to you; overseas you file the 360 and once approved its sent to the Embassy where you interview and get a visa printed to enter the US and become an LPR upon entry.  There is no "AOS" for those overseas as they are not 'adjusting status' that is only done when you are in the US. Hope that all makes sense! They also do send prima facie to those overseas but the prima facie isnt really good for anything in those cases. In the US a prima facie notice can make you eligible for various welfare benefits and such, its not going to give you any benefits overseas but is still good to get. The prima facie basically means they are saying you generally appear to qualify for VAWA, they have to still go through your case in detail and as long as everything checks out OK you should be approved. Also if you do decide to temporarily move overseas while your VAWA is processing (and will return once its approved with the visa) be aware that you are most likely NOT going to be allowed back in as a tourist (B or ESTA) due to presumed immigrant intent. You will have to wait for it to be approved and the visa printed. You will also need to do a medical overseas and pay a variety of NVC fees at different points which needs to be paid using a US bank account (checking or savings) or US credit card. Some people overseas run into problems trying to do this if they dont have any US accounts so thats another thing to consider before making a decision like this.

    Im Dec 2019 filler. I used both apps. Both were showing that they recieved a correspondence and reviewing it. Never received prima facie.

    You honor me by listing me right after the "Big Three" of this thread.  I do nothing here except cheer (mostly in my heart), keep the peace when necessary, and periodically post dumb jokes that invariably cause a bunch of approvals to flood in.

    You need to attend therapy at least 5/7 sessions and have a psychological evaluation done. If you have a diagnose of depression and/or PTSD then you can prove abuse. I had several cases approved with zero commingling finances. Get police clearance from al places that you resided for more than 6 months in the past 3 years.When you have these documents ready let me know and I will help you  at no cost (I am an attorney), but I need to be convinced that you have a VAWA case tho.

    Congratulations, you vawa was approved in 16 months, very fast. Filed October 2019, 14 months this month no rfe so far. Hope mine get approved fast too😊😊

    Guys, I just got an update on my 360...am posting this bcos I just want to encourage someone out there who feels all hope is lost. I was once like that and shout out to @sandranj, @Stillwinning!!!😊, @luminarc, @Godschild @a1d1  @Blunt& many others who had encouraged me in this forum...God is great, He is a strong tower  and  a shield to those who trust him ! My case literally had 2 RFE'S and I was crying out in this forum in search of anyone who has such but no one showed up, so I was loosing hope. But all of  a sudden, miraculously I saw an update. It only took 16 months for my case

    I do believe there are quite a lot of us with priority date as back as 2018 or even 2017 who are still not approved, I have a word for you" HOLD ON & DONT GIVE UP". GOD will come through for you. Cos I had 2 RFE's and I lost all hope and was even crying out to Attorney Sandra and my friend Luminarc who introduced me to this forum.
