Chasunmee reacted to pushbrk in What is a certified translation for the NVC?
This is incorrect, for US immigration.  There are some country specific exceptions like China, but otherwise, the translator can be anybody competent to translate.  The translator "certifies" the translation.

IMPORTANT NOTE:.  If the you are born in Israel and interviewing in Israel, you don't need your birth or police certificate translated at this stage.  Only if your birth certificate is not in the local language where you will interview, or in English, would you need a translation.

For the CR1 petition, eloping is fine, as long as you can get a valid marriage certificate.  There is no requirement from USCIS or the consulate for guests to be at the wedding.  For your peace of mind, as part of your evidence, you can submit photos of the two of you spending time with family or friends on other occasions, like holidays or get-togethers.

The point is that your evidence should show that you are really part of your partner's life, not just the wedding.  In any case, it looks like you already have lots of evidence of financial commingling.

For the CR1 affidavit of support, the requirement is for your petitioner to maintain domicile in the US, not that she has to be physically residing in the US at the time of filing.  This official site describes how your partner can do that even while living temporarily in Australia --

    https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/i-864-affidavit-faqs.html#aos22

Assuming your joint sponsor has sufficient income, your partner not having a job will not be an issue for CR1.  Also, she can stay with you in Australia to wait out the process, as long as she returns to the US anytime before you OR together with you when you first enter the US with a CR1 visa.

Here's an example of how another couple in Australia addressed the domicile requirement --

i did an elopement as well and we were approved with no issues. All I had from my wedding were 3 selfies and that is enough. They don’t care about the wedding reception at all, all they need is a valid marriage certificate and that is all.

A fancy wedding is not required to file a petition for CR1.  A simple legal wedding will do.  Stronger proof for a bona fide relationship is evidence of time spent together and commingling of financial assets.  You and your fiancee probably have loads of that kind of evidence already since you live together in Australia.

Note also that there are no guarantees with the timeline for visa processing, as COVID has taught us.

There is no federal requirement for quarantine, but each state has its own rules.  Check the destination state's requirements.

All of my photos were digital, so I put them in a word document, 4-5 pictures on a page. I typed labels in the document showing the date, place, and people in the photo. I printed it on white paper using colored ink. The final document had 4 pages and about 18 pictures.

I've read that some people send in actual photos. They put labels on the back of each photo and put them all in a zip-lock bag.

The Chicago Lockbox is just where the documents are being sent. It's essentially a payment processing and sorting facility. So that is not the location you use.

On your tax transcripts or 1040, what's in the Total Income line (not Adjusted Gross Income unless you filed 1040 EZ)? That's what they ask on the 864.

The 2555 exempted income should be listed on wages/income on the 1040 and as a negative number on other income on schedule 1 part 1. Making the total income 0, if all the income is from abroad. At least that's how our accountant filed my and my partner taxes this year.

If the number you put on the form doesn't match what's on the tax transcript, that's probably why you got a RFE.

Honestly, it only works about 50% of the time.  When you go through processing at your point of entry, the system at POE is supposed to send a notice to the SSA system to generate a number if you have checked the box.  But it doesn't always seem to work.  If you are close to a Social Security Office where you live, take the time to go and apply in person.  My spouse got her card in less than a week.

Chasunmee got a reaction from wd250g in Questions about the financial documents required for I-864
I'm also working on submitting the I-864. My joint sponsor is submitting all the documents you have listed above.

My joint sponsor is married and files taxes jointly with their spouse, so I am having the spouse fill out an I-864A and submit their w-2. Some embassy officers will ask to see proof that the spouse knows of the financial commitment.(This isn't always the case, but I have seen many others recommend having the document.)

Tax return/Tax transcripts: You only need to provide one or the other. There is no need for both.

Uploading documents: The documents should be uploaded in separate files. When you add documents to CEAC, there is a menu to indicate the type of document (w-2, passport, tax return, etc.).

Chasunmee reacted to Fullbien in AOS PAYMENT IN PROCESS
This is still happening but I was able to get it fixed and wanted to share the info to save others time- I paid on July 20, payment went through on the 22nd, and AOS fee was marked as "paid" just a few days later. However, my IV fee was marked as "in process" for about three weeks (until today), even though I had transaction IDs for both payments and they had both successfully been deducted from my account. Here is what I did:

    1) I put in a request through "Ask NVC" for them to look into the issue, and I attached only my receipt for the IV fee. I got a response within a few days saying that it was simply still in process and to continue to wait, but it didn't feel right since it has been almost a month.

    2) I decided to call NVC and spoke to an agent who was super helpful: she told me that in order for them to have proof that the transaction is not actually still "in process" and that there is a problem on their end that they need to fix, I needed resend all the info I had sent to "Ask NVC" but to ALSO attach a screenshot of the transactions from my bank account when the money was taken out. She said that this would then trigger a ticket to be made in the IT department and they would look into my issue. She told me that there was no timeframe she could give me as to when it would be fixed but that I should expect an email from IT so that I can at least know that my issue has been sent somewhere and is being dealt with.

    3) While I have not received any email correspondence from NVC, they have dealt with my issue and my IV fee is now marked as paid and I can access the DS 260! Wooooo

TLDR: If one or both of your fees are marked as "in procees" for an extended period, fill out the "Ask NVC" form with the info for your payment and attach both the receipt and a screenshot of the transactions from your bank account. This does NOT need to be your account statement- just a screenshot of the transactions from your mobile banking page will do.

Hopefully this will help save someone else an hour of hold time on the phone with the NVC!

    Hi, everyone.
This post might get moved but I'm not sure where to properly post it.
I want to offer you words of encouragement.
I married my American husband in October 2014. Nine months later, I got my green card, and moved to the U.S.
I became a citizen in March of 2019 (and had a huge party that May).
Forum, I have not looked back.
Immigration no longer consumes my thoughts, nor is it effectively a second job.
You will come out the other side of this. I know it's extremely frustrating now, but you WILL.
If you're reading this and have questions, please absolutely reach out to me and I'll do whatever I can to help you.
    Anthony

This happened to me. It took a good month from when I pad for it to clear. I submitted all documents I was able to and just waited...and waited...and waited. I eventually did the "ask nvc" and never heard back but a couple days later I was able to start AOS. I'm not sure if they fixed it after reading my message or what but it was very annoying but eventually got there!

Yes , as they file MFJ,  it shows she is aware of and agrees with the decision to sponsor. Not always needed but avoids getting an RFE if the adjudicator decides it is needed

Your uncle’s evidence of income. Last few paychecks, employment letter like these.

Eithet include (IRS tax transcript) or (1040 copy, W2 and all schedules). Your uncle’s tax return transcrops can be downloaded from IRS online.
No need to worry if you uncle doesn’t get SS income.
No need to worry if you uncle’s income is sufficient.

Like I said, if your mother is married, her husband files an I-864a no matter what.  If she is not married and has enough qualifying income, then no household member is involved.

Correct, but the Petitioner in this case will complete an I-864 of her own.  Her mother will be a Joint Sponsor not a household member, assuming she qualifies on her own.  A petitioner with no income has no income to combine with a household member, so the I-864a is not used in such a case.  Petitioner AND Joint Sponsor parent will each provide I-864 forms and if Mom is married, her spouse will provide an I-864a whether they have any income or not, and no matter what their income is.
