Security checks for those of us American born are so normal, i see nothing unusual about I had a neighborhood check along with calls to the references i gave when i applied to house a foreign exchange student My late husband had worked all his summers off from college for IBM but after graduation and going for a job with Federal systems division of IBM, they talked to neighbors, a couple of his teachers and 2 at his golf club 3 years ago FBI came here to inquire about a young man in our neighborhood that had gone into the military (didn't tell me why so i asked his parents later and they told me he had been trained for submarine duty and would now go to a nuclear sub.) any time you give references for a job, etc, don't be surprised if the people are called so its always best to ask them 1st if you can give out their name and number. and if applying to work with children , schools are checking criminal reports even for bus drivers / they have to in this day and age So to become a citizen , your standard of conduct should be above reproach

Thinking of Remarriage
JeanneAdil replied to csh2020's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
suggest that after marriage the 2 of u could permanently reside in her country as your attorney says it is considerable cheaper to live there and that lawyer is also prepared to write up the prenuptial agreement to protect your US properties / let that idea sink into her and then watch what happens -
What Demise is saying is "she smuggled herself by paying Coyote" Did she smuggle anyone else in and /or pay cayote to do that after 1997?

Moreso information
JeanneAdil replied to SquirtySplashy's topic in Adjustment of Status from Work, Student, & Tourist Visas
you can not plan to come (if you are not already here) on a ESTA or other and Adjust to stay Planning to do this is visa fraud If u r here in USA now and have decided marriage is for u, marry and do the AOS to stay If bene is outside the country , the spouse visa is superior to the K1 as u stated -
France is not a high fraud country so either visa will work As for signing marriage certificate (as needed in France) , if CO thinks to married for K1 , how do you prove u aren't married ? its really hard to prove a negative . Can you prove thru modus tollens? Modus tollens is a valid logical argument form in which a conditional statement (If P, then Q) and the negation of its consequent (Not Q) lead to the negation of the antecedent (Therefore, not P). This form is also called "denying the consequent" because it involves denying the "then" part of a "if-then" statement to conclude the denial of the "if" part. for you, its not that the K1 is faster or more expensive its the timeframe for the K1 and then the timeframe for the AOS and then the timeframe for the I 751 to get the 10 year green card and then , finally, the N 400 for citizenship read thru some K 1 timelines , like crazycats and know how long you will be dealing with immigration under a K1. the different petitions and all the documentation can drive a sane man crazy/ proving over and over that the relationship is real and providing all this personal info to USCIS again and again is a hassle Wishing u both a good life TOGETHER

what is his home country ? this makes a real difference in the timeframe BTW My vote for CR 1

Serious question, what's the truthful answer here?

"Have you EVER been a member of, involved in? these questions are about u not your former spouse -
Marry in France and do a CR1 for spouse / many many benefits to doing this have a celebration with family here in US after the visa and POE OR go thru with K1, marry in USA and after completion of the long and expensive AOS, take a long awaited honeymoon to France and celebrate there with family But DO NOT HAVE ANY kind of marriage or celebration in France ahead of the visa if going for K1 engagement party is normal but that;s all An engagement party in France is known as fiançailles and is a formal gathering to unite families and announce the couple's intent to marry

Job offer abroad with active N-400
JeanneAdil replied to TQueue's topic in US Citizenship General Discussion
you do not have to notify USCIS of anything , at all, after the oath and you have the certificate in hand if you accept job offer research the tax requirements for both countries to know what is involved We do have tax agreement with Canada but of course the 1st year , you could be filing for both countries and as a USC , u will always file US tax returns the salary you earn, whether company is a US (with office in Canada), and many other factors come into play with taxes For your benefit in the future upon retirement , its always good idea to pay into the US SS system when working outside the US (its under other taxes owed on 1040 form) -

We all know they don't say age as they can't but too big an age difference triggers CO to look for a reason to deny -

Ds 160 help for permanent residency question
JeanneAdil replied to Traveller786's topic in Tourist Visas
all say refused till the CO decides to issue or deny a visa / the status for visa is really issued or denied (refused means "in limbo during AP"/ and some embassys are slow to update status so can remain saying refused even after you are notified of the outcome -
of course it is worth it as the deduction for 2 is twice the amount and you could be eligible for higher refund if u do not owe current or past taxes/ we go not know your circumstances since 2019 IRS allows amend tax returns electronically for past 2 years 1040x is the form foreign income exclusion form is 2555 The maximum Foreign Earned Income Exclusion (FEIE) was $120,000 for the 2023 tax year and increased to $126,500 for the 2024 tax year. These are the amounts that a qualifying U.S. citizen or resident alien living abroad could exclude from their U.S. federal income tax. you could have filed as MFJ in the appropiate years using IRS guides for nonresident alien spouse saving a lot of paperwork

Reasons for a K-1 Rejection
JeanneAdil replied to Rahima's topic in K-1 Fiance(e) Visa Case Filing and Progress Reports
`1. do not pass medical exam 2/ current or past drug use 3. security risk 4. large age difference (over 10 years if the USC woman is older) 5. bene has poor or little knowledge of USC 6. do not spend quality time together to know each other 7. bene could become public charge if USC income is too low 8. criminal history 9. failure to meet requirements for immigration 10. failure to attend immigration appointments 11. past overstays of a visa 12. fraudulent documents complete list is in following list of Ineligibilities and waivers laws that are listed by immigration https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/waivers.html -
If brother feels pressure to marry , then he is not ready to commit to marriage at this time To AOS as the lawyer says is quite expensive and he would need to completely support her till she has the green card and that can take some considerable time. Being forced to marry under these circumstances would hardly make for a favorable union. He should let her visit till admit date on the I 94 and then the 2 can decide to continue with the relationship B2 visa and he a USC can make trips to meet and decide on their future without someone forcing it on them for "a huge attorney fee" If she returns as the admit date requires, the B2 will not be cancelled

yeah, a lot of money just to deport Overall Funding: Congress allocated a total of roughly $170 billion for immigration enforcement and border security efforts, with $75 billion specifically designated for ICE over the next four years, according to CBS News. This funding makes ICE the largest federal law enforcement agency. Detention: $45 billion is allocated for building new immigration detention centers, including facilities for families. This represents a 265% increase in ICE's detention budget, and could enable ICE to detain more than 100,000 individuals at any given time, essentially doubling its current capacity. Enforcement and Deportation Operations: Approximately $30 billion is allocated to ICE to track down, arrest, and deport immigrants. This portion of the budget allows for: Hiring an additional 10,000 deportation officers. Increasing the capacity for transportation and removal of non-citizens, including chartering deportation flights. Expanding agreements with state and local jurisdictions to assist with immigration enforcement. Modernizing ICE's fleet of deportation planes and hiring more agency prosecutors to handle deportation cases. It's important to note The additional funding represents a massive increase compared to previous years. The legislation allows for significant flexibility in how ICE allocates and utilizes these funds for immigration enforcement. The funding increase is expected to lead to a significant expansion of ICE's enforcement activities, including increased arrests and deportations.
