    While he sounds like somewhat of a jerk, what you've described in more a crummy marriage----not really signs of greencard fraud.  On an aside, I never got an engagement ring until my 10th wedding anniversary, we didn't have a wedding night/honeymoon, my husband initially didn't want a child during the first years of our marriage (simply wasn't ready financially), and he didn't want to buy a home (due to not wanting to enter into a mortgage at his age)..we live in an apartment. 
     
    I'm not saying this to make light of your feelings/outlook---just only to say that what you've mentioned above doesn't mean he married you just for a green card.
     
    I'm not sure what the timeline is from when you hit him to when he left....and obviously at that time emotions must have been running very high...but, honestly, he had every right to leave the marital home if you hit him as you say you did...just as you would have had every right to leave him should he have put his hands on you.  
     
    Without any concrete evidence of fraud on his part, there's nothing you can prove.  Accusations/intuition/gut feeling/personal statement etc. is not going to be enough to make USCIS look into anything---they are going to want documented evidence.  Text messages of him saying he doesn't love you is not going to be enough, either.
     
    Something else to think about:  If you'd married an American citizen, and then later filed for divorce from him---you wouldn't be thinking "well, he needs to leave the country".  I understand you're angry in part, and perhaps even feeling a bit vengeful (which is normal when you feel hurt by what someone's done)....but he does have a right to remain in the US and continue his immigration journey so long as he entered the marriage with bonafide intent, and can prove it.  Right now, it presumably much easier for him to prove that, as opposed to you trying to prove fraudulent intent.
     
    Keep this in mind:
     
    With the K1 filing, you had to send tons of evidence to prove it was a valid relationship. 
    With the AOS you had to send even MORE evidence to prove it was a valid marriage. 
    With the ROC, more evidence was sent to prove the continuing bonafide marriage.
    How would you now be able to turn about-face and claim everything sent before was a "lie" without actual evidence?
     
    I can feel your frustration, and I can feel your pain coming through your posts.  I'm very sorry that your marriage has now broken down, and I hope with time and distance from the situation you're able to begin to mend yourself and move on to someone who's your true Mr. Right----he's out there, somewhere, and this experience will serve to make you a much stronger person in the end when you do finally find him.

    That’s your opinion.  On limited facts.  You’re free to express it, but the OP is looking for actual advice, not judgment.
     
    Processing times for a green card aren’t as quick as they used to be, so it’s not like she’s only been married for 2 months.  Also, 2 people can enter a marriage with the best of intentions and have it fall apart  quickly, especially when it’s a marriage involving immigration.  My husband and I have struggled every day since I moved here with minor things (changes in living together), so for some people those struggles may be larger and of more significance.
     
    Until you’ve walked the mile in her proverbial shoes....

    Got my card yesterday!
    After case approved on 01/03, USCIS has been really good about keeping me updated.
    So happy this is finally over.

    Hello all,
     
    Happy New Years ~ Yesterday I received a notification saying "card is being produced" and just want to share my experience.
     
    NOA date is 08/01/17, jointly filed in CA office
    02/xx/18 Case Transferred to Local Office (cannot remember the exact date but this appears to be a bug maybe)
    Summer of 2018, I switched to a divorce waiver after receiving the final decree
    10/16/18 Transferred to Nebraska
    01/03/19 Card is being produced
     
    NO RFE, NO INTERVIEW
     
    For the divorce waiver, I submitted a personal statement explaining the relationship, the final decree, some photos, 3 letters from my friends and that was all.
     
    Personally, I came to the US when I was 15 for high school. I met and married my ex-husband in college. We then moved to Colorado where I attended law school.
    During law school, our relationship went sour and we decided to separate. I switched from jointly filed to a divorce waiver after receiving the final decree.
    There was no violence, abuse, cheating, or anything like that. We just grew apart.
     
    I am sharing my experience to reassure that even with a divorce waiver with no violence, people can still pass I-751 without RFE or Interview. Just tell the truth!

    Just FYI- a conditional GC is a special kind of GC. Generally your status is your status until taken by an immigration judge- however the conditional GC has special rules. One of which was mentioned- failing to file ROC means (to USCIS) that you no longer want your status and failure to file ROC is taken as you surrendering your status. Now nothing is quick or automatic with USCIS; so for those that fail to file- nothing happens the first day, nothing happens the second day. Nothing will happen for a long time on average, but at some point USCIS will forward your file to a judge who will 'confirm' you didnt file and rule that your not filing means you dont want the status and officially strip it from you. The delay in this happening is why people are able to file late (sometimes even up to a year late) and still be OK.
     
    In order to show you have status still when your conditional GC expires you need the expired card + the NOA. Everyone gets a NOA- even those that file a G-1145. Recently there has been a lot of petitions filed- so the wait time for the NOA can take up to 60 days to receive. Some people never get one and have to ask for a copy. Hopefully the OPs NOA comes in a timely fashion.
     
    The wife will not be allowed to board the plane with out her expired GC and NOA extension letter. Embassies do NOT give 551 stamps, and she can not get a boarding foil unless she shows they proof of her status being extended (copy of the NOA + expired GC). If she has both those documents she does not need a boarding foil. A boarding foil is for someone who lost their documents. its a one time use only thing. So forget about going to the Embassy. They can not help her with any of this.
     
    Her options at this point is to return home before her card expires, or remain overseas after the card expires but then she can not return home until the NOA arrives (will be mailed to US address) and then someone sends/brings her a copy of the NOA. She also needs to have someone watching the US mail for the biometrics notice. If she is still overseas when the biometrics appt comes it will have to try to be rescheduled. There is no guarantee they will reschedule or how long it could take to get biometrics rescheduled. Biometrics must be done in the US. Typically biometrics notices are sent between 30-120 days after filing and give you at least 2 weeks notice in advance of when the appointment is.
     
    Since the ROC packet sent was very minimal it is most likely an RFE will be issued at some point. RFEs are generally not issued until someone actually goes through the packet and sees the evidence is lacking or needs explanation. There is plenty of time to gather up more evidence for ROC. OP- read through the ROC forum and see what other people have submitted. You probably have more things you can add. At the very least you can include a statement of your financial situation and how she is a homemaker with no income. 
     
    The way the ROC process works is you send in your packet, the mail room processes it and a NOA is issued. Then it sits for a very long time. When an officer gets to it and actually looks at the contents they will issue a RFE if needed. If they are not satisfied with the RFE response they will schedule you for an interview. If they are not satisfied at the interview you will get a NOID (notice intent to deny). You may also get a second interview. It will then go to the immigration judge. Point is there are many many chances to submit evidence and explain things. 
     
    Do NOT send unsolicited mail. There is no guarantee it will make it to your file. Send stuff if you want but do not be surprised if it doesnt make it to your file. So keep copies of what you send if you do decide to send anything, but honestly you are better off waiting for the RFE. 
     
    RE black ink/blue ink- USCIS uses scanners. Blue ink sometimes doesnt scan. Very few people though get their forms rejected for this. It can happen but usually ink color is a non issue.

    I have been told by an attorney that having a child together is very strong evidence.  Both your names will be listed on the birth certificate so that is good.  You do seem to be missing the marriage certificate which is usually a requirement.  When we did our original GC interview the officer led me to believe that if the evidence at the original interview was strong enough we might not be called back for an interview at the ROC.  When we filed for ROC we did not have any joint financial accounts but we had three years of tax transcripts, a marriage certificate, joint health insurance, and some photos. Oh and my spouse's birth certificate and my GC.  That was it.  We neither received a RFE nor did we get called in for an interview we just got approved (just over a year later).  I think it had also been pointed out that once they get your package, if it is complete, you will get your I-797 with an extension shortly thereafter (mine was issued the very day they received my package).  So provided they get your package and the form is complete and the check is fine (they don't look at the evidence just yet) you will have the extension letter to carry with you shortly.  Or have it sent.
     
    I think the point I am trying to make is that we often hear only the horror stories on here but not the times things went smoothly so I am just sharing my experience which went fairly smoothly.  So take a deep breath and give it a couple of days before freaking out.

    Well the extension later will come within 30 days usually. Do you have anyone that can check your mail for you and scan the letter to you. That way you don;t have to return.
     
    The RFE wouldn't come until months later when they adjudicate your petition at that time you will have created even more evidence.
     
    Get a joint account, joint credit cards, add her to your 401K, you have a child you both should have a will now. You said you had her on your 2017 taxes what of 2016 and 2018? Where are they?
     
    Affidavits of family attesting to your marriage, pictures of trips together and cards and letters to you both.
     
    Drivers license showing same address. Bills aren't that big of deal since you are the sole provider. You need to show more that she is sharing your income which shows trust.

    We received the same extension letter. It will act as GC validation until you receive a new card. We met with USCIS a couple of weeks ago because we're leaving the country and were a little concerned with using a letter to get back into the U.S. They do not stamp your foreign passport (or anything) until after the letter expires. However, they said, we should receive a new GC before the letter expires - or she becomes a U.S. citizen. They said to carry the GC and the letter when entering the country or doing anything that requires a GC. We made several copies and even mailed one to her parents in Vietnam - just in case.

    My N400 application just got approved today. Th system shows your final step to becoming a citizen is to attend your naturalization ceremony.
    Finally the journey is finished!!!

    You seem to have good info.  Don't bother with sending stuff with only one name.  Concentrate on those items with both names.
     
    Also don't worry about only one name on the deed/mortgage, but DO include a note in your cover letter stating that you owned the house prior to the marriage, and because of credit considerations, only your name appears on the mortgage and deed.  This will prevent you from getting an RFE about why only one of you is on the deed/mortgage.  It's not unusual for only one half of the couple to do this - but do explain it up front.

    I went for my interview on May 14, it was a combo interview for I-751 (May 2017) and N-400 (June 2018). My I751 file had dust on it.
    I got an RFE  for Taxes, but the officer did all the questions and forms and tests and signatures that I needed for my N-400. She told me once I submitted the
    documents she would approve my application. Not a happy camper was I. We requested the transcripts from the IRS , it took 10 calendar days. We dropped them off in person on Tuesday May 28th, by Friday I had my oath letter for June 6th.  The oath ceremony was very nice, 36 people from 19 countries. I registered to vote the same day and  I applied for my passport the next day at the tax collector. Now I still think someone will come and tell me I forgot to dot an i or cross a t. I have PTSD from 5.5 years of filling out forms. I am done. Good luck my friends, Visa Journey has helped me from day one.
