I-751 Switch to Divorce Waiver, NO RFE, NO INTERVIEW

Since we filed out divorce jointly and had no assets or children, it was finalized in 90 days.

 

But for people that filed jointly and are waiting on their divorce process, there are probably 2 scenarios:

 

1. USCIS is unaware of the divorce proceeding and the joint filing got approved before the divorce is finalized

2. USCIS is aware of the divorce proceeding and will wait to adjudicate the case after the divorce is finalized 

 

In either scenario, once the divorce is finalized, you should send an update to USCIS so you don't run into any problems when applying for citizenship.

Yes, I filed in CO which has a 90-day waiting period.  

In CA, the waiting period is 6 months, from the date of service.

my I-751 file window is going to be opened at March 1

for the pass year the marriage went really south, I am really worry I am not going to have enough evidence, and I still in divorce process now

hope my case can be smoothed as yours

 

N-400 Timeline

 

2022/03/01: 90 days filing window open

2022/03/20: Filed N-400 online

2022/03/21: Case received, no biometrics required

2022/03/21: Online status change to Case is being Actively Reviewed by USCIS

2022/08/15: Interview was scheduled

2022/09/20: Interview Date

2022/09/20: Citizenship Approved

When did you file you I-751? My friend filed in August but hasn’t heard anything yet and the website said there is a validation error when she searches the receipt

Good Luck! I don't have a very strong paper trail either. Just be confident and explain to them what happened to the marriage.

I haven't file yet, my window is going to open in March, so I plan to file by the end of March

now I am gathering data, but all the papers just looks really poor...

I am not sure I will have the final divorce decision by March

so if in that case, I have to file join and explain I am under the process?
