I wouldn’t worry about that at this time. There’ll lawsuits up the yin yang on that healthcare rule that a judge is gonna throw an injunction on it until the courts battles are finished, which will take years.

Life is Life reacted to naz94 in Notarized (or Not Notarized) Affidavits of a Bona Fide Marriage from Family and Friends
I wrote a affidavit letter with family. I just wrote the the family members name and DOB, their relationship to me and how they knew about my husband and I marriage. Wrote a statement towards the end of the letter stating that everything is true and had my family member notarize and sign it.

The validity of the police certificates depends on how long the reaffirmation takes.  Police certificates expire just like the medical, so all you can do at this point is wait and see how the process of reaffirmation goes.  If it's fast, you may not need new police certificates.  If it is long, you will need new ones.  Wait and hope for the best, the process is long and takes a lot of patience.  Good luck!

    Not the application
    but the AOS
    and her medical
    and her ds 260
    and her criminal reports
and anything else USCIS or the embassy wants at the interview

if they revoke the petition,  you apply again and do it all

Oh my man, you're testing my patience.

The answer is YES. They will send you a piece of mail, also called a letter, through the post office, that is going to be delivered to you, the petitioner. In that letter, they will list the reasons why they think this petition should be revoked. You, then have around 30 days (or whatever date they specifies in that letter) to respond to the letter, providing your evidence that will counter their reasons to revoke, point by point. Yes, you need to send your response and evidence also by post office mail, back to USCIS. If your response satisfies USCIS, they will send the petition back to the Consulate/Embassy for another interview. If not, your petition will be revoked.

You will receive a letter from USCIS. You respond to that letter and send in evidence. As I said, you have to address everything point by point.

    @Sam17 @George George @Rupi
Read what happens when you file single as a married person.  It's recent.

It's fixable. You file an amendment to the taxes. Only problem you can't do is e file. It was supposed to be a paper filing when your spouse has no social security
  13. Sad
Life is Life reacted to Crazy Cat in Consular Return
A letter...in about 6 months.  Once you get the letter, you will know to address the denial issues.....Until then, there isn't much you can do...good luck.
  14. Thanks
Life is Life reacted to USS_Voyager in Consular Return
You will get a letter of intent to revoke (of the I-130 petition) and it will list the reasons, and give you 30 days to respond. It is essential that you respond within 30 days and address every single point that letter says.

A letter once it gets back to USCIS.  this can take anywhere from 2 to 6 plus months.  Spending more time together, co mingling of finances and adding proofs of a Bona Fide marriage are good things to do.

    Also fix your taxes!

If you don't understand something you can ask here, search online, or hire an attorney.

We met in one country, got married in a second, lived in a third and now live in the US.  Overall it was a pretty easy process to follow and we had zero issues despite having some red flags.

Life is Life reacted to Illiria in * Visa Denial (Next Steps?) *
Yeah that’s most likely your problem - embassy didn’t  like it when you filed as single - sometimes makes them doubt the validity of the marriage esp. if there are other things that are giving them pause.
And..... when it comes to immigration don’t rely on others always check with the source material yourself - in this case the tax codes - reading the filing instructions would have told you this.

Life is Life reacted to geowrian in Spouse Visa and Lottery Visa Question
If the petition is sent back to USCIS, it would be due to either an error on itr or that they believe it is invalid (not a bona fide marriage). Anything else would have the petition remain at the consulate.

you can apply for spouse and dv lottery at the same time
however,  your wife was denied (found ineligble under one of the rules) so this may also apply ?????
others may know more but this is from the DV lottery rules:

No. Visa application fees cannot be refunded. You must meet all qualifications for the visa as detailed in these instructions. If a consular officer determines you do not meet requirements for the visa, or you are otherwise ineligible for the DV under U.S. law, the officer cannot issue a visa and you will forfeit all fees paid.

Always best to read the instructions all the way thru when doing any immigration process

Was it denied? OP said case is “open”.
Agree any underlying inadmissibility will remain regardless visa type.

No issue entering the DV lottery.

The only second opinion you need is in the DV lottery instructions, which confirm you can enter with another immigration visa case in process.

Childhood pictures/records don't prove bona-fide marriage. Chats do show communication between partners which could prove a bonafied marriage or fiance relationship. Airline tickets do show at least people visited each other or went on vac together, etc. Childhood pictures; nope, it proves nothing. Save the child pictures/records for when your sponsoring your parents; not your wife. I sponsored my wife just 3 months after our wedding in GH and just after 1 day of becoming a US citizen, and got approved at the embassy easily; you need to put your time and efforts in assembling the right and good supporting evidence and not waste time on those that won't add value. Goodluck with your case.
  24. Thanks
Life is Life reacted to geowrian in * Visa Denial (Next Steps?) *
It shouldn't make them mad, and it won't change the end result negatively for inquiring about the case. Contacting them too often is not a reason for refusal. They also have no say if the petition is reaffirmed or not - only USCIS can adjudicate that.

I concur that childhood photos have no relevance in the case whatsoever. (Some) Medical records would only be relevant if there was something like a severe condition and the partner was there with them through it (of which the latter is really the basis, not the medical records).
    Focus on quality > quantity.
  25. Thanks
Life is Life reacted to LilyJ in * Visa Denial (Next Steps?) *
Chats and airline tickets have to do with showing evidence of a genuine relationship between the petitioner and beneficiary. Your childhood pictures and your personal medical records don’t have anything to do with showing evidence of your relationship between yourself and your wife
