    Hi fellow members,
    My apologies if it has been answered before. I’m USC and I filled i130 for my wife and it was approved in Dec 2018. She went for an interview and got 221(g) white. We submitted the needed documents after 2 days and the case has been in Ap from Dec 2018. I’m from Nepal and we haven’t married religiously. Couple of months ago, the embassy called my parents as well as my in-laws to verify the marriage. Since, it is a bonafide marriage, they gave the same reply. Whenever I inquire the embassy, I always get the same generic reply but last one said, your case has been placed for “mandatory administrative processing”.  What does this mean. The last update was made in June 5th.
    Does this have anything to do with her stay in Bangladesh for 5years? We did provide the police clearance certificate from Bangladesh.
    I heard when it is mandatory, they have something to do with FBI, is it true?
    All of your answers and feedback are welcome.

    No its not. Whats common is many people do not meet the income threshold there to have to file. Two completely different things. I think the limit is 2.5 Lakh after deduction. Basically if her salary is less than INR ~20k she is not filing taxes if she doesn't want a refund.
     
     
    But you have to include her income if you are filing your taxes as MFJ, you do have to report her income when you file in the US. People rarely do tough.
     
    He literally didn't say anything negative. You posted a vague question without any background. This is the internet, what did you expect? If you dont like the reply, ignore it. Its not that hard

    they didn't  need affidavit of support from u to begin with (as said above)
    and they applied for the visa and had to prove ties to Morocco
    it is their responsibility / not yours
    just don't invite them to stay in your home

    Yeah, it seems the CO has the serious doubt on whether the marriage is real. Not sure what was asked in 221g and what was submitted post interview, but at this time all you can do is wait for the decision. Doing traditional marriage does not help AP at this time as it will simply suggest you two just got married and that the previous marriage did not happen. Wait for AP to resolve or if they ask anything more before doing anything. Good luck.

    The fact that they called parents of both spouses suggests they have doubts in your marital relationship, that could be the reason for lengthy AP, definitely not the FBI involvement. What sort of supporting evidences were provided during i130 and during the interview?

    All cases go through administrative processing.  It is mandatory for all cases........it takes longer to complete for some cases and some countries.  It can not be waived or expedited.......it can be days, weeks, months, or even years........there is no remedy other than patience.
    Where did you hear this?

    No effect on the case at all - you can email the embassy and request they send it back to you.
    When they are ready to issue the visa, they will contact you and have you re-send it to them.

    Wow, it sucks to be in AP for unknown amount of time. Seems they had a serious doubt on your marriage, as calling parents is extremely rare. Hope you get the approval soon.
     
    In the mean time, I suggest your your wife to get a new police certificate . It’ll be valid for one year from the issue date and it will be handy if the embassy asks for it.

    There is no way to expedite AP.   You can ask for congressional inquiry but there is nothing they can do to speed it up since it is AP.

    The police report has to be valid at the time of the interview.    If a newer one is needed they will let her know.   Generally it isn't.
     
    Can't tell by your post about where you filed so nothing to say about AP.

    Normally,  your husband is receiving the K-1's from the company, or he should get an estimate from the Accountant of the company . as you mentioned earlier, he filed an extension, he should have estimated tax paid, while filing the extension. as long as the estimated tax has been paid, you are good but you never know the decision of the embassy.

    I'm surprised why you accountant filed married filling jointly if your husband has never been to US. you cannot file unless he has SSN. your filling status would be single before your husband is in US and has SSN. Even though IRS and immigration two different thing, the TAX fillings makes a difference.
